Owner occupancy
Required

The property owner must occupy either the principal dwelling or the ADU as their permanent residence at least eight months per year and may receive no rent on the owner-occupied unit. The building permit application must include a sworn, notarized owner-occupancy statement.

Approval process
Permitted use

The Sec. 6.2 allowed use table lists ADU as a Limited use (L) in R-85, R-60, R-50, RS-17, RM-18, RM-22, RM-43, and PO: permitted by right subject to the use standards, with no public hearing. Approval runs through a building permit application to the Zoning Administrator with the owner-occupancy affidavit. ADUs are not permitted in NMU, C-1, C-2, C-3, MU, or I districts.

Rental restrictions

  • Zone-dependent: ADUs are a Limited use only in R-85, R-60, R-50, RS-17, RM-18, RM-22, RM-43, and PO; not permitted in NMU, C-1, C-2, C-3, MU, or I (UDO Sec. 6.2).
  • An ADU is only allowed as accessory to a single-family detached house, duplex, or walk up flat (UDO Sec. 6.3.1.G.1); an ADU accessory to a four-unit walk up flat is subject to the inclusionary dwelling standards of Sec. 6.3.1.F and gets no density bonus or parking reduction (Sec. 6.3.1.G.2).
  • Only one ADU per lot of record, and no more than two accessory buildings per lot excluding structures under 100 sq ft (UDO Sec. 6.8.3.A.2; 6.8.1.D).
  • Detached ADUs sit inside the general accessory building envelope: 1,000 sq ft total floor area inclusive of ADU, garage, and storage; 25 ft and two stories max (UDO Sec. 6.8.1.E), on top of the 800 sq ft / 40 percent / two-bedroom ADU caps.
  • Owner-occupancy is enforced by a sworn, notarized affidavit at building permit application, and the owner may receive no rent on the unit they occupy (UDO Sec. 6.8.3.A.3, A.8).
