ADU rules in Bellevue

2 sources

These are the primary sources for accessory dwelling unit regulations in Bellevue: the city's own zoning code, planning department pages, and permit guides. Start here before talking to anyone: the rules below are what your permit reviewer will apply.

Rules at a glance

Detached (backyard) ADU
Not allowed

Bellevue's zoning ordinance has no accessory dwelling unit use, and every residential district allows "only one building for living purposes" per zoning lot. Guest houses "not rented or otherwise conducted as a business" are a permitted accessory use in AG, RA, RE, RS-120, RS-84, RS-72, RD-60 and the RG districts, but the term is undefined; the code's defined term for living quarters in an accessory building, "accessory living quarters", must have no kitchen facilities and may not be rented or used as a separate dwelling unit. A detached backyard home with its own kitchen is therefore not allowed; a kitchenless guest house for visiting guests is.

Bellevue Zoning Ordinance §2.04 (Accessory Living Quarters), §4.06.01, §5.10.04(4) and §5.10.06(4) (RS-72; parallel text in §§5.05 to 5.15)
Attached or internal ADU
Conditional

In the single-family districts (RS-120, RS-84, RS-72, RE, RA) a single-family dwelling is defined as a building with one dwelling unit, so no internal or attached second unit is allowed. The only route to a second attached unit is a two-family dwelling (duplex), a permitted use by right in RD-60 on lots of at least 12,000 sq ft and 80 ft wide, and in RG-50, RG-28, RG-20 and RG-8 on lots of at least 10,000 sq ft. That is a duplex conversion or build, not an accessory unit, and most single-family lots in those districts are 5,000 to 6,000 sq ft.

Bellevue Zoning Ordinance §2.07 (Dwelling, Single Family; Dwelling, Two Family; Dwelling Unit), §5.10.02 (RS-72), §5.11.02(3) and §5.11.05 (RD-60), §§5.12 to 5.15 (RG districts)
Maximum size
No ADU size standard; guest houses follow the accessory-building cap: 750 sq ft or 50% of the house footprint, whichever is greater, max 1,200 sq ft (lots of 1 acre or less), 1,200 sq ft on larger lots; 15 ft height

Because no ADU use exists, the only size rules that reach a guest house are the general accessory-building limits. On lots of one acre or smaller the footprint may be no larger than the greater of 750 sq ft or 50 percent of the principal building's footprint, never more than 1,200 sq ft; on larger lots the cap is 1,200 sq ft. Accessory buildings are 15 ft tall at most (one more foot per two feet of extra setback, never taller than the house), sit 5 ft from side and rear lines, stay out of the front yard, and count toward district ground coverage (30 percent in RS-72). A two-family dwelling in RD-60 or RG has no unit-size cap beyond the district floor area ratio and coverage limits.

Bellevue Zoning Ordinance §4.13.09(1), (2), (4), (5) and (6); §2.04 (Accessory Structure); §5.10.05 and §5.10.06 (RS-72)
Owner occupancy
Not required

No owner-occupancy rule appears anywhere in the zoning ordinance. The two-family dwelling route has no owner-residency condition, and the code's definition of a dwelling unit contemplates "owner occupancy or lease on a weekly, monthly, or longer basis". A guest house is tied to the household only through the bar on renting it.

Bellevue Zoning Ordinance §2.07 (Dwelling Unit; Dwelling, Two Family); §5.11.02 (RD-60)
Extra parking
1 space per dwelling (a duplex needs 2); no separate guest-house rule

The Group A parking table requires off-street parking for "Dwellings: One (1) for each" (the row is printed truncated in the ordinance), read as one space per dwelling unit, so a two-family dwelling needs two spaces. Each district also requires off-street parking for all uses established in it. No parking standard is written for guest houses. Parking areas must be hard-surfaced (concrete or asphalt).

Bellevue Zoning Ordinance §8.03.11 (Group A table), §8.03.04, §5.10.06(3)
Approval process
Permitted use

Guest houses are a permitted accessory use and two-family dwellings a permitted principal use in their districts, so either needs only a building permit, with Planning Department zoning review and no hearing. Nothing ADU-like is listed as a conditional use (which in Bellevue needs a Planning Commission recommendation and City Council approval). A self-contained second unit in a single-family district would need a rezoning or a text amendment.

Bellevue Zoning Ordinance §11.04.01 and §11.04.02; §5.10.03 and §5.10.04 (RS-72); §5.11.02 (RD-60); Art. 6 (conditional use permits)
Rental restrictions
Guest houses may not be rented; duplex units may be leased (weekly or longer); no city short-term rental licensing

Every residential district limits guest houses to those "not rented or otherwise conducted as a business", and accessory living quarters may not be "rented or otherwise used as a separate dwelling unit". A unit in a two-family dwelling may be leased; the dwelling unit definition covers lease "on a weekly, monthly, or longer basis". The Bellevue City Code (American Legal, 2026 S-12) has no short-term rental licensing or registration chapter, and bed and breakfasts are a conditional use in residential districts.

Bellevue Zoning Ordinance §5.10.04(4) (and parallel guest-house clauses in §§5.05 to 5.15), §2.04 (Accessory Living Quarters), §2.07 (Dwelling Unit), §5.10.03(1); Neb. Rev. Stat. 18-1758
The fine print: 6 caveats that can change the picture
  • Bellevue's zoning ordinance is not in the American Legal code: Bellevue City Code App. A, §A-1 adopts it by reference, and the operative text is the city's own PDF (Ord. 4146 as amended, updated June 5, 2026).
  • Guest houses ("not rented or otherwise conducted as a business") are permitted accessory uses in AG, RA, RE, RS-120, RS-84, RS-72, RD-60, RG-50, RG-28, RG-20 and RG-8, but the code defines accessory living quarters as having no kitchen facilities and not used as a separate dwelling unit, and allows only one building for living purposes per lot; a guest house is not a self-contained ADU.
  • Residential districts also permit as an accessory use "living quarters for not more than two persons regularly employed on the premises", and the AG district (20-acre minimum lot) permits ranch and farm dwellings for owners, tenants and employees; neither is a general ADU right.
  • The attachedAllowed value reflects duplexes: a two-family dwelling is a permitted use only in RD-60 (12,000 sq ft lot) and RG-50, RG-28, RG-20 and RG-8 (10,000 sq ft lot). In RS-120, RS-84, RS-72, RE and RA no second dwelling unit is allowed.
  • The guest-house bar on renting reaches short-term rental too; Neb. Rev. Stat. 18-1758(2) and (6) bar a city from prohibiting short-term rental of a property and require land-use rules to apply to it as to similar property, so a ban on renting an accessory building nightly could be contested under that statute.
  • Rewrite pending: the city's October 2026 RFQ for a full zoning ordinance and subdivision regulations update (submittals due 10-30-2026, project February to November 2027) follows the 2022 Affordable Housing Action Plan's finding that the city has no ADU definition; re-check when the new ordinance is adopted.

Summarized from Bellevue's ordinance text, read October 2026; every row links the code section it came from. Rules often vary by zone and lot, so treat this as orientation, not a permit determination, and confirm with the planning department before you commit to a design.

Nebraska statewide law also applies

Nebraska sets baseline ADU rights at the state level. Where local rules are stricter than state law allows, state law usually wins, so both are worth reading.
