ADU rules in Henderson
These are the primary sources for accessory dwelling unit regulations in Henderson: the city's own zoning code, planning department pages, and permit guides. Start here before talking to anyone: the rules below are what your permit reviewer will apply.
Rules at a glance
ADU defined as a building or structure, including a tiny house, on the same lot as a principal dwelling, 'either detached, attached, or built within the primary residence'. Permitted subject to use-specific standards ('S') in the RS, RM, RH, MC, and MN zoning districts per Table 19.9.1-2; not permitted in other districts (including RMH and MR).

- Zone dependence: ADUs are allowed only in the RS, RM, RH, MC, and MN districts ('S' in Table 19.9.1-2); they are not permitted in RMH, MR, or any commercial, industrial, downtown, or public districts.
- One ADU per lot maximum (HMC 19.9.4.B.6.b.iii); Nevada AB 396 caps any local authorization at two per property but does not require more than one.
- Setbacks depend on height: detached ADUs 14 feet or less get 5-ft side and rear setbacks; taller ADUs must meet the principal dwelling's setbacks; front and corner-side setbacks always match the principal dwelling (19.9.4.B.6.b.i).
- Detached ADUs must be at least 6 feet from other buildings or be roof-connected to the principal structure and treated as attached (19.9.4.B.6.b.i(a)(3)).
- Design compatibility with the principal structure is required (materials, colors, mass); ADUs in a front or corner side yard must match the principal structure; rear-yard tiny houses are exempt but must sit on a permanent foundation (19.9.4.B.6.b.v).
- Tiny houses are a distinct ADU subtype capped at 400 sq ft excluding lofts; ANSI 119.5 manufactured structures must also meet the IRC as adopted by Henderson (19.9.4.B.6.b.ii, b.vii).
- Private CC&Rs and master plan communities (large parts of Henderson: Green Valley, Anthem, Inspirada, Cadence, Lake Las Vegas) may separately restrict ADUs; AB 396 sections 5-8 also changed what HOAs can do about rental restrictions.
