These are the primary sources for accessory dwelling unit regulations in Dallas: the city's own zoning code, planning department pages, and permit guides. Start here before talking to anyone: the rules below are what your permit reviewer will apply.

Conditional

No by-right ADUs citywide. A detached rentable ADU needs either a Board of Adjustment special exception (available in any district) or location inside an adopted Accessory Dwelling Unit Overlay, which a neighborhood must petition for (50%+ of property owners).

Same two paths apply. The overlay expressly regulates attached ADUs (max floor area the greater of 700 sq ft or 25 percent of the main use); the base special exception covers a rentable accessory dwelling unit without distinguishing attachment. A separate non-rentable 'additional dwelling unit' special exception also exists (51A-4.209(b)(6)(E)(i)), which requires a deed restriction against rental.

Maximum size
In an ADU overlay: detached ADU 200 sq ft minimum, maximum the greater of 700 sq ft or 25 percent of the main structure; attached ADU maximum the greater of 700 sq ft or 25 percent of the main use; one story maximum. Outside an overlay (special exception path), general accessory structure caps apply: an individual accessory structure may not exceed 25 percent of the main building's floor area (excluding parking), all accessory structures combined 50 percent, and height may not exceed the main building.

Overlay height generally cannot exceed the main dwelling, except ADUs over detached garages may reach the overlay's maximum height.

Owner occupancy
Required

Special exception path: the board must require a deed restriction requiring owner occupancy on the premises. Overlay path: if one unit is rented, the owner must reside in the main structure or the ADU during the tenancy (director may approve a one-year absence).

Extra parking
Overlay: minimum one off-street space, waived within 1,200 feet of a DART bus or transit stop, and reducible via the overlay petition (75 percent of owners) or by council on steering committee recommendation. Approval process

Not by right anywhere in most cases (the city's own ADU page says so). Either a Board of Adjustment special exception (discretionary, $600 fee per the city page) or a city-council-adopted neighborhood ADU overlay, after which ADUs are permitted within the overlay subject to its standards.

Rental restrictions
ADUs are the only rentable accessory structures (accessory structure rental is otherwise prohibited). Special exception path: property must be annually registered in the city's single family non-owner occupied rental program. Overlay path: the rental unit must be registered in the city single family rental program, and the ADU may not be sold separately from the main building. The general ban on advertising accessory structure rentals does not apply to ADUs.

Neither ADU section sets a minimum lease term or addresses short-term rentals; Dallas STR rules live elsewhere in city code and were not extracted here.

The fine print: 5 caveats that can change the picture
  • There is no by-right ADU path citywide: every ADU needs either a discretionary Board of Adjustment special exception or must sit inside a neighborhood-petitioned ADU overlay adopted by city council, so a flat 'allowed' reading is misleading.
  • An ADU overlay may only be placed on areas that allow single family uses and do not expressly prohibit ADUs, must generally contain at least 50 single family structures (or be an original subdivision), and requires signatures from more than 50 percent of property owners.
  • Size, setback, and parking standards differ sharply between the two paths: the overlay has its own ADU-specific floor area (700 sq ft / 25 percent) and 3-foot side/rear setbacks for structures under 15 feet, while special exception ADUs fall back on the general accessory structure limits of the underlying zoning.
  • Dallas's separate 'additional dwelling unit' special exception (51A-4.209(b)(6)(E)(i)) is a different animal: it must be deed restricted against rental use.
  • Planned development districts, conservation districts, and historic overlays can carry their own rules that displace these citywide provisions.
