ADU rules in Midvale

1 source

These are the primary sources for accessory dwelling unit regulations in Midvale: the city's own zoning code, planning department pages, and permit guides. Start here before talking to anyone: the rules below are what your permit reviewer will apply.

Rules at a glance

Detached (backyard) ADU
Allowed

External accessory dwelling units (EADUs) are listed as an Allowed use (by right, with use-specific standards) in the SF-1, SF-2, RM-12, and RM-25 residential zone use tables. An EADU may only be built on a lot with one detached single-family dwelling, on a lot larger than 6,000 sq ft, not with a mobile/manufactured home, and only one EADU per property.

§17-7-1.2 (Table 17-7-1.2), §17-7-1.2.1(D); parallel tables §17-7-2.2, §17-7-3.2, §17-7-4.2
Attached or internal ADU
Allowed

Internal accessory dwelling units (IADUs) are listed as an Allowed use (by right, with use-specific standards) in the same four residential zone use tables. Same conditions: one detached single-family dwelling on the lot, lot must exceed 6,000 sq ft, not within a mobile/manufactured home, one IADU per property.

§17-7-1.2 (Table 17-7-1.2), §17-7-1.2.1(E); parallel tables §17-7-2.2, §17-7-3.2, §17-7-4.2
Maximum size
Larger of 900 sq ft or 13% of lot area (EADU, cumulative with all unoccupied accessory structures)

The cumulative maximum building area of all unoccupied accessory structures and an EADU is the larger of 900 sq ft or 13% of the lot area; height max 20 ft pitched roof / 16 ft flat roof, 1 to 1.5 stories. No explicit floor-area cap found for internal ADUs.

§17-7-1.8(D)-(F); identical standards in §17-7-4.8(D)-(F) for RM-25
Owner occupancy
Required

The property owner must occupy one of the dwelling units on the property as their permanent residence for as long as the EADU or IADU remains on the property; a notice must be recorded against the property title before a certificate of occupancy is issued.

§17-7-1.2.1(D)(1), (D)(8), (E)(1), (E)(8)
Extra parking
1 space per ADU

Table 17-7-1.7 requires 1 off-street space per IADU/EADU unit, in addition to the 2 improved off-street spaces required for all residential lots (§17-7-1.7(A)). The ADU criteria state an EADU/IADU 'must provide off-street parking as described within this chapter'.

§17-7-1.7 (Table 17-7-1.7); §17-7-1.2.1(D)(5), (E)(5)
Approval process
Permitted use

Both EADU and IADU carry an X in the 'Allowed' column (not Administrative or Conditional) of the residential zone use tables, subject to use-specific review criteria in §17-7-1.2.1 and counterparts; a building permit is required before construction.

§17-7-1.2 (Table 17-7-1.2); §17-7-2.2; §17-7-3.2; §17-7-4.2; §17-7-1.2.1(D)(2), (E)(2)
Rental restrictions
No rentals under 30 consecutive days

An EADU or IADU may not be rented or leased for a period of less than thirty consecutive days, which prohibits short-term rental of ADUs.

§17-7-1.2.1(D)(9), (E)(9)
The fine print: 7 caveats that can change the picture
  • ADU rules are repeated per zone chapter (SF-1 §17-7-1, SF-2 §17-7-2, RM-12 §17-7-3, RM-25 §17-7-4); values here are cited from the SF-1 chapter, and the parallel use tables in SF-2, RM-12, and RM-25 were verified to list both ADU types as Allowed, but zone-specific standards sections were only read in full for SF-1 and RM-25
  • ADUs are only allowed on lots containing exactly one detached single-family dwelling; lots of 6,000 sq ft or less cannot have an ADU
  • The EADU size cap is cumulative: 900 sq ft or 13% of lot area is shared with all other unoccupied accessory structures on the lot, so existing sheds/garages reduce allowable EADU size
  • Limit of one EADU and one IADU per property; separate utility meters and separate addresses are prohibited for ADUs
  • ADUs may not be built on the same lot as (or within) a mobile home or manufactured home
  • A title notice describing the ADU must be recorded before a certificate of occupancy is issued
  • The curated directory link (§17-7-4.8) is the RM-25 zone's EADU development-standards section only; permit type, owner occupancy, parking, and rental rules live in the use tables and §x.2.1 review-criteria sections of each residential chapter

Summarized from Midvale's ordinance text, read July 2026; every row links the code section it came from. Rules often vary by zone and lot, so treat this as orientation, not a permit determination, and confirm with the planning department before you commit to a design.

Utah statewide law also applies

Utah sets baseline ADU rights at the state level. Where local rules are stricter than state law allows, state law usually wins, so both are worth reading.
