ADU rules in West Bountiful

The chapter defines an ADU as a unit created within, or attached to, a single family dwelling, and §17.82.040.B allows an ADU only within or attached to an owner-occupied single family dwelling. §17.82.050 goes further: detached accessory structures may contain bathroom or cooking facilities but may not contain sleeping facilities or be used as a dwelling, dwelling unit, or ADU, and a recorded non-residential accessory structure agreement is required as a condition of the building permit.

§17.82.040.FThe owner of record must reside on the property as their principal residence, in either the primary dwelling or the ADU. Absences for business, medical, military service, or religious reasons are allowed for up to three continuous years, during which an on-site manager must be designated. A recorded ADU agreement runs with the land; a new owner must submit a new application and occupy the property or the ADU must be immediately vacated.
§17.82.040.B, .I, .JOne additional off-street parking space must be provided and designated for each ADU, whether the primary dwelling is existing or new construction; garage and driveway space counts. If the ADU is created within a garage or carport, replacement off-street parking must be provided. Stalls may be concrete, masonry, asphalt, pavers, or gravel. Also subject to the residential parking requirements of Chapter 17.52.
§17.82.040.DA city ADU application is required for all ADUs and is processed as a permitted use (§17.82.040.A). A building permit under the adopted construction codes (§17.82.040.G) and a recorded ADU agreement (§17.82.040.J) are also required.
§17.82.040.A, .G, .JAt no time may both the ADU and the primary dwelling be rented as separate units (§17.82.040.I): the owner must live in one of them. Any lease of the ADU must include language that the lease terminates upon sale of the property (§17.82.040.L). No explicit minimum lease term or short-term rental provision appears in the chapter.
