Allowed

An ADU may be a detached structure on the same lot as a single-family dwelling. Must be permanent construction with permanent utility hookups; mobile tiny homes and RVs are prohibited. Max height 25 feet; not permitted in front yards; counts toward the two-accessory-building limit.

Allowed

An ADU may be established within the building envelope of a single-family dwelling (attic, basement, internal conversion) or as an addition to it. A separate exterior entrance independent of the main dwelling's entrance is required.

Maximum size
No fixed cap; ADU may not exceed the finished square footage of the principal single-family dwelling. Detached ADU footprint on lots of 4,000 sq ft or more: max 15% of lot area or 800 sq ft, whichever is greater; on lots under 4,000 sq ft, combined footprint of house plus ADU capped at 60% of lot area or 800 sq ft, whichever is greater. Conversions of existing accessory structures are exempt from the coverage caps if the footprint is not expanded.

Detached ADU height limit is 25 feet (or the existing height of a converted accessory structure, whichever is greater).

Required

The owner, or a designated responsible person with authority to operate and manage the property, must maintain a residence in either the principal dwelling or the ADU for as long as the ADU exists. Requires a recorded covenant, ADU registration with the Zoning Administrator, and renewal by December 31 of every odd-numbered year; noncompliance is a Class F civil offense.

Permitted use

ADUs are a permitted accessory use with limitations (designation L13 in all SF subdistricts, L17 in all RM subdistricts): allowed by right when subordinate and incidental to a single-family dwelling that is the principal use of the lot. No conditional use hearing; requires building permits, ADU registration, and the recorded occupancy covenant. Modifying a numeric or dimensional limitation requires a variance under Chapter 1445.

Rental restrictions
No minimum lease term in the zoning code. An ADU may be operated as a short-term rental in accordance with Chapter 856 (STR registration required); long-term rentals fall under the city's residential rental registration program (Chapter 874). In all cases the owner or designated responsible person must keep their residence in one of the two units on the lot.

STR allowance is explicit in the ADU ordinance itself.

The fine print: 6 caveats that can change the picture
  • ADUs are allowed only as an accessory to a single-family dwelling that is the principal use of the lot; properties whose principal building is a duplex or multi-family building cannot add an ADU, even in RM districts.
  • One ADU per lot, and no more than two accessory buildings of any type (including a detached ADU) per lot (§ 1421-06(a), (e)).
  • The lot must meet the minimum lot size for single-family dwellings in its zoning district or the lots-of-record rule in § 1421-09, whichever is less restrictive (§ 1421-06(c)).
  • Owner-occupancy compliance is enforced through a recorded covenant (irrevocable without Zoning Administrator consent), initial registration, and biennial renewal; the city cites a fine of up to $15,000 (Class F civil offense) for violations.
  • ADU legalization came from Ord. No. 266-2023, effective Oct. 2, 2023; it predates and is separate from the Connected Communities reforms (Emer. Ord. No. 199-2024, effective July 1, 2024), which amended other parts of Chapters 1403/1405 but not the ADU standards.
  • Cincinnati also has a form-based Land Development Code (Title XVII) applying in specific plan areas and various overlay/historic districts; ADU standards were verified for the base SF and RM districts in the Title XIV Zoning Code, and additional review can apply in overlay, hillside, or historic districts.
