Detached ADUs (DADUs) are a 'Permitted with Conditions' (PC) use in AG/AR2a, RS, R, RM, RN1/RN2, RL1-RL3, OR20-OR40, and ORI districts per the 17.08.030 land use table, but only on lots inside the Urban Services District, inside a council-adopted DADU overlay in the General Services District, or where allowed by a Specific Plan; one DADU per lot and only with a single single-family principal structure.

Attached/internal ADUs exist only as 'accessory apartments': the home must be owner-occupied, the unit is capped at 25 percent of gross floor area, must connect internally (no street-facing entrance added for it), may not have separate utility meters, and the second unit must be occupied by a listed family member, so it cannot be rented to the general public.

Maximum size
DADU living space: 700 sq ft on lots under 10,000 sq ft; 850 sq ft on lots 10,000 sq ft or larger; never larger than the principal structure. Accessory apartment (attached): max 25 percent of gross floor area excluding garage and utility space.

DADUs also have height caps: eave height max 10 ft (single story) or 17 ft (two story), ridge line below the principal structure and max 27 ft from average finished grade; Chapter 17.38 controls height in RN1, RN2, RL1, RL2, RL3. No other accessory structure over 200 sq ft may share the lot with a DADU.

Owner occupancy

DADU: the DADU must be owned by the same person or entity as the principal structure, one of the two dwellings must be owner-occupied, and the DADU can never be divided from the property ownership. Accessory apartment: the single-family residence must be owner-occupied and the apartment occupied by a family member.

Access is tightly controlled: on lots without alley access, only one curb cut serves both dwellings; lots with alley access must take added access from the alley; a street-accessed driveway is limited to one, max 12 ft wide.

Approval process
Permitted use

'Permitted with Conditions' (PC): administrative approval through Metro Codes with no public hearing, provided every 17.16.030.G standard is met, plus a restrictive covenant recorded before permit issuance. Metro Codes does not allow homeowner self-permits for building a DADU or converting a garage into one; a contractor must pull the permit.

Rental restrictions
New DADUs (built or converted) on single-family-zoned, Residential Neighborhood-zoned, or Residential Limited-zoned lots may not be used as owner-occupied short term rental property; the DADU overlay imposes the same STRP ban on all new DADUs within it. Attached accessory apartments may only be occupied by a listed family member, so ordinary rental is not allowed.

No minimum lease term for long-term DADU rental was found in the ADU sections; long-term rental of a DADU is not prohibited (one of the two dwellings must be owner-occupied).

The fine print: 7 caveats that can change the picture
  • Geographic gate: DADUs are only permitted inside the Urban Services District, inside a council-adopted DADU overlay district in the General Services District (minimum 30 contiguous lots, 17.36.730), or where a Specific Plan (or UDO with DADU standards, per Metro Codes) allows them (17.16.030.G.11).
  • Zone dependence: the 17.08.030 land use table lists DADU as PC only in AG/AR2a, RS, R, RM, RN1/RN2, RL1-RL3, OR20-OR40, and ORI; in RN and RL districts the Chapter 17.38 Design-Based Multi-Family standards control lot area and height.
  • Only one DADU per lot, and only when exactly one single-family principal structure is present; two principal structures on a lot disqualify a DADU (17.16.030.G.3.c).
  • The DADU cannot be sold separately from the principal dwelling, and a restrictive covenant must be recorded with the register's office before a permit is issued (17.16.030.G.3.b, G.10).
  • Siting is constrained: the DADU may only sit behind the principal structure in the rear buildable area, with accessory-building setbacks per 17.12.040.E (17.16.030.G.4-5).
  • Attached 'accessory apartments' are far more restrictive than DADUs: family-member occupancy only, 25 percent of floor area cap, single utility meter, internal connection required (17.16.250.A). A DADU, by contrast, may have separate utility meters (17.16.030.G.13).
  • Design mandates apply: similar style, materials, and roof form to the principal house; dormers limited; historic overlay rules govern DADUs in historic districts (17.16.030.G.8-9).
