ADU rules in King County

These are the primary sources for accessory dwelling unit regulations in King County: the county's own zoning code, planning department pages, and permit guides. Start here before talking to anyone: the rules below are what your permit reviewer will apply.

Unincorporated areas only

County zoning applies only outside city limits. If your property is inside a city or town, that municipality's own ADU ordinance governs instead, even though it sits within King County.

Detached (backyard) ADU
Allowed

In the urban area (inside the urban growth area), up to two ADUs per lot are allowed in any configuration, including one or two detached structures. In the rural area or on natural resource lands, a detached ADU is allowed only when there is no more than one primary dwelling on the lot and the lot is at least 3,200 sq ft (rural towns) or meets the minimum lot area for the zone (elsewhere); otherwise the ADU must be in the same building as the primary dwelling. ADUs are prohibited entirely in the Forest (F) zone.

Attached or internal ADU
Allowed

Attached ADUs must share at least one common wall with the primary dwelling and appear contained within one structure; a breezeway or covered pathway connection only counts as attached if it is under 10 feet, shares a common wall with both units, is completely enclosed, and is heated. Units wholly within a basement or attic of the primary dwelling are also allowed (and exempt from the size cap).

ADUs not wholly contained within an existing dwelling also may not exceed the base height for the zone (21A.08.030.B.7.a.(2)).

The current ADU standards in KCC 21A.08.030.B.7.a (as amended through Ord. 19881, 2024) contain no owner-occupancy requirement; a full-text search of Title 21A finds none for ADUs. The county's March 2026 ADU bulletin likewise omits it. Caution: an older county permit-guide FAQ page still says one unit must be owner-occupied; that reflects pre-2024 code.

Applies countywide (urban and rural). Urban-area ADUs are also exempt from public street improvements (B.7.a.(7)(c)).

Approval process
Permitted use

ADUs are a residential accessory use marked P (permitted, condition 7) across residential and rural zones in the use table, subject to the B.7.a standards rather than a hearing; applications go through a standard building permit via MyBuildingPermit.com. Before permit approval the applicant must record a notice on title identifying the unit as accessory (B.7.a.(5)).

Rental restrictions
None ADU-specific in the zoning code; no minimum lease term. The county's ADU bulletin describes ADUs as usable for long-term rental or family members

Title 21A contains no ADU rental-term or short-term-rental provisions. County business-licensing titles outside the zoning code were not audited for general short-term-rental rules.

The fine print: 7 caveats that can change the picture
  • This entry covers unincorporated King County only; Seattle, Bellevue, and other cities in the county have their own ADU codes.
  • Rules split sharply at the urban growth area line: urban lots get two ADUs per lot (any attached/detached mix), garage conversions even in nonconforming structures, the 1,500 sq ft heated-area trade-up, and no street improvements; rural-area and natural-resource-land lots get one ADU per lot and detached ADUs only if the lot has a single primary dwelling and meets the lot-area gate (3,200 sq ft in rural towns, the zone's minimum lot area elsewhere).
  • ADUs are prohibited in the Forest (F) zone, and the county's ADU bulletin states that in the Agriculture (A) zone only attached ADUs accessory to a primary commercial agriculture use are permitted.
  • A notice on title identifying the unit as accessory must be recorded with Records and Licensing before any ADU construction permit is approved, and it runs with the land (KCC 21A.08.030.B.7.a.(5)).
  • In the RA zone, a detached ADU counts as a separate dwelling unit for subdivision lot calculations, and converting one to a primary unit on a new lot blocks further detached ADUs on either lot unless the lot is at least twice the zone's minimum lot area (B.7.a.(8)(f)).
  • WA HB 1337 (RCW 36.70A.680) applies only inside urban growth areas; King County's 2024 omnibus update (Ord. 19881) implemented it, which is why urban lots get two ADUs with no owner-occupancy or parking mandates while rural standards remain more restrictive.
  • Septic and sewer: ADU construction may require public health (on-site sewage system) approval or a sewer certificate per the county bulletin, a practical gate on many rural lots.
