ADU rules in Carlsbad
These are the primary sources for accessory dwelling unit regulations in Carlsbad: the city's own zoning code, planning department pages, and permit guides. Start here before talking to anyone: the rules below are what your permit reviewer will apply.
Rules at a glance
Detached ADUs are allowed in every zone that allows one-family, two-family, multiple-family or mixed-use dwellings when a home exists or is proposed (CMC 21.10.030.D.1): they are an accessory use in the R-A, R-E, R-1, R-2, R-3, R-P, R-T, R-W and RD-M tables and the C-2 and C-L tables, in the P-C zone through 21.38.025, and in the Village and Barrio Master Plan districts. Approval is ministerial, by building permit outside the coastal zone and with an added Minor Coastal Development Permit inside it (21.10.030.B). On a single-family lot the city allows one local-track attached or detached ADU (detached up to 1,200 sq ft) plus one conversion ADU and one JADU, or the state-exempt detached unit of up to 800 sq ft with 4-ft side and rear setbacks (Gov. Code 66323(a)(2)). Outside the coastal zone Ord. CS-506 defers multifamily counts to 66323(a)(4) (up to eight detached ADUs beside an existing multifamily building, never more than its units, two with a proposed one); inside the coastal zone the city still applies the certified 2023 text and allows two (IB-111).
CMC § 21.10.030.B, D.1, D.4, E.3.c as amended by Ord. CS-506 (adopted 2-3-2026, effective 3-5-2026 outside the coastal zone); § 21.10.020 Table A; § 21.38.025; IB-111 (Aug. 2026); Gov. Code 66314, 66323(a)(2), (a)(4)Attached ADUs (new additions sharing a wall with the home) and conversion ADUs inside the existing or proposed home or an accessory structure are allowed on the same terms as detached units (CMC 21.10.030.D.1, E.3.a-b), and one JADU of up to 500 sq ft is allowed within a single-family home or its attached garage in zones that allow one-family dwellings (D.2, E.3.d). A conversion may add up to 150 sq ft for ingress and egress (IB-111; Gov. Code 66323(a)(1)). On two-family and multifamily lots ADUs may be converted from non-livable space (storage rooms, basements, garages) up to 25 percent of the existing units, at least one (66323(a)(3)); JADUs are not allowed there. Inside the coastal zone attached ADUs and JADUs are exempt from a coastal development permit unless a 21.201.060(B)(1) exception applies.
CMC § 21.10.030.D.1-2, E.3.a, E.3.b, E.3.d (Ord. CS-506); § 21.201.060(A)(2), (B)(1); IB-111 (Aug. 2026); Gov. Code 66323(a)(1), (a)(3), 66333Ord. CS-506 caps a detached ADU on a one-family lot at 1,200 sq ft and an attached ADU that adds new floor area at 50 percent of the main dwelling or 1,200 sq ft, whichever is less, but never below 800 sq ft; a conversion must stay inside the existing or proposed home or accessory structure, a JADU stops at 500 sq ft, and detached ADUs on two-family and multifamily lots follow Gov. Code 66323 with no stated cap (21.10.030.E.3). The state-exempt detached unit is 800 sq ft of livable space with 4-ft side and rear setbacks, which may intrude into the front setback when nothing else fits (IB-111). Heights: detached 16 ft, 18 ft within one-half mile walking distance of a major transit stop (Carlsbad Village or Poinsettia station) or a high-quality transit corridor with 2 more feet to match the main roof pitch (20 ft maximum), 18 ft on a lot with a multistory two-family or multifamily building; attached 25 ft or the zone height, whichever is higher, up to two stories; an ADU above or below a detached garage keeps to the zone height and one story (E.4). Detached ADUs over 800 sq ft, and attached ADUs over 800 sq ft and taller than 16 ft, count against the zone's lot coverage limit (IB-111). Inside the coastal zone the certified 2023 text carries the same size caps and pairs the 16-ft detached limit with a one-story limit.
CMC § 21.10.030.E.3.a-d, E.4.a-f (Ord. CS-506); IB-111 (Aug. 2026) pp. 3-6; certified LCP text of § 21.10.030.E.3-4 (Ord. CS-449, certified 2-6-2025); Gov. Code 66314(d)(4)-(5), 66321(b), 66323(a)(2)Carlsbad imposes no owner-occupancy requirement on ADUs: IB-111 (Aug. 2026) states 'ADUs are exempt from owner-occupancy requirements,' as Gov. Code 66315 requires, and Ord. CS-474 (2024) deleted the clause that let the city keep enforcing owner occupancy on ADUs permitted before 2020. For a JADU the owner must live in the main home or the JADU only when the JADU shares sanitation facilities with the home (IB-111; Gov. Code 66333(b) as amended by AB 1154). Ord. CS-506 removed the code's own JADU owner-occupancy language outside the coastal zone, and its JADU deed restriction now covers only the ban on separate sale and the unit's size and attributes (21.10.030.E.11). The certified coastal-zone text still says the owner must reside in the primary residence or the JADU for every JADU, a clause that yields to 66333(b).
IB-111 (Aug. 2026) p. 5; CMC § 21.10.030.E.11 (Ord. CS-506); former § 21.10.030.E.11.c (Ord. CS-449, still the certified coastal-zone text); Ord. CS-474 § 10; Gov. Code 66315, 66333(b)An ADU needs one off-street space, covered or uncovered and allowed as tandem parking on a driveway or in the front or side setback, on top of the primary home's parking (CMC 21.44.020 Table A; 21.44.060 Table C), unless a Gov. Code 66314 or 66322 exemption applies (21.10.030.E.9.a): within one-half mile walking distance of public transit (IB-111 counts the Carlsbad Village and Poinsettia stations and bus stops), in a historic district, part of the existing or proposed home or an accessory structure, where on-street permits are required but not offered, within one block of a car share vehicle, or filed with an application for a new home on the lot. JADUs need none (E.9.b; 66334), and the state-exempt 66323 units carry no parking under 66323(b). A garage, carport, covered or uncovered space demolished or converted for an ADU need not be replaced, except on lots west of the rail corridor and between the rail corridor and I-5 from Avenida Encinas to Batiquitos Lagoon (the mapped ADU Parking Replacement Areas), where lost spaces must be replaced as covered, uncovered, tandem or lift spaces (E.9.c). Inside the coastal zone the certified text exempts only garages, carports and covered structures, so uncovered spaces must also be replaced there (IB-111).
CMC § 21.10.030.E.9.a-c (Ord. CS-506); § 21.44.020 Table A; § 21.44.060 Table C; IB-111 (Aug. 2026) pp. 4-5; Gov. Code 66314(d)(10)-(11), 66322(a), 66323(b), 66334ADU and JADU applications are ministerial, with no discretionary review or public hearing when 21.10.030 is met (B.1), and the city acts within the Gov. Code 66317 clock (completeness in 15 business days, a decision within 60 days, per IB-111). Outside the coastal zone a building permit is the only approval (B.2). Inside the coastal zone a detached ADU also needs a Minor Coastal Development Permit (Form P-6) that the City Planner decides after a 10-day neighbor notice, with no administrative hearing and no appeal to the Planning Commission or City Council (21.201.080.B.1, C.1.a.ii; 21.201.120.A); attached ADUs and JADUs need no coastal permit unless a 21.201.060(B)(1) exception applies (beach or bluff-edge sites, 10 percent expansions near the beach, or a home nonconforming with habitat buffers or geologic setbacks). Gov. Code 66329 bars hearings on ADU coastal permits, sets the same 60-day clock and, since AB 462 (10-10-2025), removes Coastal Commission appeals of the local decision.
CMC § 21.10.030.B.1-3 (Ord. CS-506); § 21.201.060(B)(1), 21.201.080.B.1, C.1.a.ii, C.1.d; § 21.201.120.A; IB-111 (Aug. 2026) p. 7; Gov. Code 66317, 66329(a), (c)ADUs and JADUs may be rented long term, but CMC 5.60.020 (Ord. CS-383, 2020) excludes every ADU and JADU issued a building permit on or after 1-1-2020 from the short-term vacation rental definition, and the city's STVR page applies that as a bar ('prohibited from being an STVR'). STVRs of any dwelling are allowed only in the coastal zone and the La Costa Resort and Spa Master Plan area (5.60.030), with an annual STVR permit (new $231 fee for applications after 9-1-2026), a business license and transient occupancy tax, so only a pre-2020 ADU in those areas can be rented by the night. IB-111 says ADUs must be rented for at least 30 days and JADUs at least 31 days, matching Gov. Code 66315 (terms of 30 days or longer) and 66333(g) and 66323(e) (longer than 30 days for JADUs and state-exempt units). Inside the coastal zone the certified LCP text still requires a recorded notice of restriction barring rentals under 30 days for units permitted since 2020. An ADU may be sold separately only under the 66341 nonprofit path; the city has not opted into 66342 condominium sales (IB-111; 21.10.030.E.12).
CMC § 5.60.020, 5.60.030, 5.60.050; § 21.10.030.E.11-12 (Ord. CS-506); former § 21.10.030.E.11.a (Ord. CS-449, certified coastal-zone text); IB-111 (Aug. 2026) pp. 4-5; city STVR page; Gov. Code 66315, 66323(e), 66333(g), 66341, 66342The fine print: 13 caveats that can change the picture
- Two texts govern. Ord. CS-506 (adopted 2-3-2026, effective 3-5-2026) applies only outside the coastal zone; inside it, the certified LCP version of CMC 21.10.030 (Ord. CS-427 of 2022 as amended by Ord. CS-449, which the Coastal Commission approved as submitted on 2-6-2025) governs until the Commission certifies LCPA 2025-0023, which is still pending (the 9-24-2026 eCode360 import and the August 2026 IB-111 both treat it as uncertified, and the October 2026 Commission agenda carries no Carlsbad ADU item). The certified text pairs the 16-ft detached limit with a one-story limit, exempts only garages, carports and covered structures from parking replacement, requires a recorded notice barring rentals under 30 days for units permitted since 2020, carries a universal JADU owner-occupancy clause (yields to Gov. Code 66333(b)), and cites Gov. Code 65852.2 'effective Jan. 1, 2023', which the city reads as capping detached ADUs on multifamily lots at two (state 66323(a)(4) allows up to eight).
- IB-111 says that in the coastal zone 'If there is a conflict with state government code ADU regulations and the LCP, the LCP shall apply,' and the 1-27-2026 staff report says the 2024 state bills superseded the code only outside the coastal zone. Gov. Code 66329(a) preserves the Coastal Act but not every uncertified local limit, so the two-detached multifamily cap and similar non-resource limits inside the coastal zone are contestable; HCD has not addressed Carlsbad's ordinance.
- Coastal permits: a detached ADU needs a Minor CDP (Form P-6) decided by the City Planner after a 10-day notice; attached ADUs and JADUs are exempt unless a 21.201.060(B)(1) exception applies (a 2024 attached 800 sq ft ADU in the Commission's appeal area, CDP 2024-0027, still needed one). CMC 21.201.130 still lists Coastal Commission appeal areas, but Gov. Code 66329(c) (AB 462, effective 10-10-2025) makes local ADU coastal permit decisions unappealable under Public Resources Code 30603. In the Agua Hedionda deferred-certification segment and the other areas the city's coastal zone map shows as Commission-permitted, the Coastal Commission itself issues the CDP under 66329(b).
- Replacement parking: CMC 21.10.030.E.9.c still requires lost spaces to be replaced in the mapped ADU Parking Replacement Areas (the beach strip west of the rail corridor and the area between the rail corridor and I-5 from Avenida Encinas to Batiquitos Lagoon), which on the city's maps appear to lie wholly inside the coastal zone; the California Housing Defense Fund told the city (11-19-2025 and 1-27-2026) that this and the citywide parking rule for state-exempt units violate Gov. Code 66314(d)(11) and 66323(b). A one-space-per-ADU rule that binds studios also exceeds the 66314(d)(10)(A) cap of one space per unit or per bedroom, whichever is less, on a plain reading.
- CMC 21.10.030.E.6 applies habitat preserve buffers, geologic stability setbacks and visual resource policies from the LCP, the Habitat Management Plan, the General Plan and geotechnical reports to every ADU and JADU citywide; the California Housing Defense Fund argues that only the LCP standards can reach state-exempt 66323 units (66323(b), 66329). Staff replied that HCD's preliminary review found the draft 'harmonized' with state law.
- Gov. Code 66326(d): CS-506 had to reach HCD within 60 days of 2-3-2026 (by about 4-4-2026); the staff report said it would be submitted, but no public index records the submission. HCD has never sent Carlsbad an ADU ordinance letter (not in the index current to 7-14-2026; the dashboard lists only nine Housing Accountability Unit letters, including a 6-24-2025 letter holding that ADUs and JADUs cannot serve as for-sale replacement units).
- Chaptered 2026 law, effective 1-1-2027: AB 956 (Ch. 791, Stats. 2026) amends Gov. Code 66323 to allow two detached new-construction ADUs on a single-family lot with no JADU owed where two exist, against the city's one attached or detached ADU plus a conversion and a JADU; SB 1117 (Ch. 809, Stats. 2026) limits impact fees on an ADU over 750 sq ft to the area above 750 sq ft, which changes the proportional whole-unit formula IB-111 describes. Re-read both after 1-1-2027.
- IB-111 (Aug. 2026) still prints a one-story limit for detached ADUs that CS-506 removed outside the coastal zone (the 16-ft limit stays), exempts from impact fees ADUs 'less than 750 square feet' against Gov. Code 66311.5(c)(1) '750 square feet ... or less', omits the 66322(a)(6) exemption for an ADU filed with a new home, and links the dead library.qcode.us platform for the code (now eCode360 CA4913).
- Zone traps: the E-A and L-C use tables list a single-family farm house and a guest house but no ADU row, although 21.10.030.D.1 and Gov. Code 66314 allow ADUs wherever a home is allowed. The posted Village and Barrio Master Plan (doc 15621, file dated 6-26-2025) still prints the pre-2020 Table 2-1 row limiting ADUs to a lot with a single one-family dwelling and cites old section numbers; the Commission's 2022 certification of the city's 2020 ADU update contemplated ADUs with any dwelling type except on ground-floor street frontage in the VC and HOSP districts, and state law allows ADUs with multifamily and mixed-use dwellings regardless.
- Short-term rentals: the STVR page says ADUs and JADUs permitted 'after Jan. 1, 2020' are barred while CMC 5.60.020 says 'on or after'; pre-2020 ADUs inside the coastal zone or the La Costa Resort and Spa Master Plan area may still operate with an STVR permit, a business license and TOT. The literal 5.60.020 wording removes post-2020 units from the STVR definition rather than banning them; the city treats it as a ban, and inside the coastal zone the certified notice of restriction bars such rentals directly.
- No separate sale except the Gov. Code 66341 nonprofit path; Ord. CS-507 (2-3-2026) only updated Title 6 and Title 20 cross-references and did not opt into 66342 condominium sales. The JADU deed restriction (21.10.030.E.11) bars separate sale of a JADU.
- The Permit Ready ADU Program's pre-approved plans are offline while being updated for the 2025 California Building Code (the page still says 'by summer 2026'), so the program page is not curated.
- Re-verification triggers: Coastal Commission action on LCPA 2025-0023 (watch the monthly agenda API and the San Diego Deputy Director's report; the 2023 ADU amendment took 15 months from submittal to approval), certification of LCPA 2024-0020 (Ord. CS-474), the next IB-111 revision, and a 1-15-2027 re-read for AB 956 and SB 1117.
Summarized from Carlsbad's ordinance text, read October 2026; every row links the code section it came from. Rules often vary by zone and lot, so treat this as orientation, not a permit determination, and confirm with the planning department before you commit to a design.

California statewide law also applies
California sets baseline ADU rights at the state level. Where local rules are stricter than state law allows, state law usually wins, so both are worth reading.
