ADU rules in Carson
These are the primary sources for accessory dwelling unit regulations in Carson: the city's own zoning code, planning department pages, and permit guides. Start here before talking to anyone: the rules below are what your permit reviewer will apply.
Rules at a glance
Yes. Since about April 18, 2024 the ADU rules for Carson's residential and mixed-use zones are Part 3-B, Division 10 (Secs. 93110.1 to 93110.4) of the New Zoning Code: Phase 1 adopted by Ord. No. 24-2405, and Table 9211.2 lists the accessory dwelling unit as 'P' (permitted subject to a zoning compliance determination) in all four residential districts (LDR, LMX, MDR and HDR). Sec. 93110.4.B allows one detached or one attached new-construction ADU on a lot with a single-unit dwelling, combinable with a JADU, and Sec. 93110.4.D.5 allows up to two detached new-construction ADUs on a lot with an existing or proposed multifamily dwelling. New units need only 4-foot side and rear setbacks and there is no minimum lot size. The local 'only one category may be used per lot' rule and the two-unit multifamily cap yield to Gov. Code 66323(a) as amended by SB 543 (any combination of the listed units; up to eight detached ADUs beside an existing multifamily building, never more than its existing unit count).
Carson Municipal Code Art. IX, Ch. 1A, New Zoning Code: Phase 1 (Ord. No. 24-2405, adopted 3-19-2024) Secs. 93110.4.B, 93110.4.D.5 and 93110.4.F.1 to F.2; Table 9211.2; Gov. Code 66323(a)Yes. Sec. 93110.4.A.1 allows one ADU and one JADU inside the space of a proposed or existing single-unit dwelling (including an attached garage), or an ADU inside an existing accessory structure plus up to 150 square feet of expansion, each with independent exterior access, and Sec. 93110.4.B allows one attached new-construction ADU in place of a detached one. On multifamily lots, ADUs may be carved out of non-livable space such as storage rooms, boiler rooms, attics, basements and garages, up to 25 percent of the existing units with at least one allowed (Sec. 93110.4.D). JADUs (up to 500 square feet) must meet the state JADU statute. Attached ADUs may rise to 25 feet or the zone's primary-dwelling limit, whichever is lower (20 feet in LDR), and no more than two stories.
Carson Municipal Code Art. IX, Ch. 1A, New Zoning Code: Phase 1 (Ord. No. 24-2405, adopted 3-19-2024) Secs. 93110.4.A.1, 93110.4.B, 93110.4.D and 93110.4.F.3; Table 9211.3Sec. 93110.4.F.4 caps a detached ADU at 1,200 square feet and an attached ADU at 850 square feet for a studio or one bedroom and 1,000 square feet for more than one bedroom, or 50 percent of the existing primary dwelling's floor area, whichever is smaller; ADUs converted from existing space are exempt from the caps and a JADU is capped at 500 square feet. The code bars open space, site coverage and FAR rules from cutting an ADU below 800 square feet, and Gov. Code 66321(b)(3) extends that 800-square-foot guarantee to the 50 percent rule, which the Phase 1 text (unlike the old Sec. 9122.1.E.4.d) no longer names. Heights: Sec. 93110.4.F.3 sets 18 feet (plus 2 feet for a roof pitch matching the house) for a detached unit within a half mile of a major transit stop or high-quality transit corridor, 18 feet beside a multifamily building, 25 feet or the primary-dwelling limit for an attached unit, and two stories over a detached garage; it sets no height for other detached units, so the state floor of 16 feet (66321(b)(4)(A)) governs. A state-exempt detached unit under 66323(a)(2) may be held to 800 square feet of livable space.
Carson Municipal Code Art. IX, Ch. 1A, New Zoning Code: Phase 1 (Ord. No. 24-2405, adopted 3-19-2024) Secs. 93110.4.F.3 and 93110.4.F.4; Gov. Code 66321(b)(2) to (4), 66323(a)(2)No. Division 10 imposes no owner-occupancy requirement on ADUs, and Gov. Code 66315 bars one. For JADUs, Sec. 93110.4.A.1.e defers to the state JADU statute (cited as 65852.22, now 66333), and since January 1, 2026, 66333(b) requires the owner to live in the house only when the JADU shares sanitation facilities with it. The pre-2024 Old Code text still printed on eCode360 (Sec. 9122.1.G.3, Ord. 22-2211) carries a universal JADU owner-occupancy rule, superseded in residential zones by Ord. 24-2405 and overridden by 66333(b) in any case. The city's December 2021 ADU application packet still describes ADUs on lots 'with an existing single owner occupied dwelling' and a universal JADU residency rule; neither is current law.
Carson Municipal Code Art. IX, Ch. 1A, New Zoning Code: Phase 1 (Ord. No. 24-2405, adopted 3-19-2024) Secs. 93110.4.A.1.e and 93110.4.F.11.d; Gov. Code 66315, 66333(b); old CMC Sec. 9122.1.G.3Sec. 93110.4.F.9 requires no parking for a JADU and at most one space per ADU, which may be tandem or on an existing driveway (but not in a rear setback abutting an alley, or in the front setback unless the driveway there is at least 20 feet deep); Table 9316.4 lists '0-1 per unit, which may be tandem'. No space is required for an ADU inside the existing or proposed home or an accessory structure, within a half-mile walk of public transit (defined to include a bus stop or train station served by fixed-route, set-fare service),in an architecturally and historically significant historic district, where on-street permits are required but not offered, or within one block of a car-share vehicle, and garage or carport spaces lost to an ADU need not be replaced (Sec. 93110.4.F.10). The local exemption list omits Gov. Code 66322(a)(6) (an ADU applied for with a new single-family or multifamily dwelling), and the flat one-space rule reaches studios and state-exempt units, which 66314(d)(10)(A) (one space per unit or per bedroom, whichever is less) and 66323(b) do not allow; state law controls.
Carson Municipal Code Art. IX, Ch. 1A, New Zoning Code: Phase 1 (Ord. No. 24-2405, adopted 3-19-2024) Secs. 93110.4.F.9 and 93110.4.F.10; Table 9316.4; Gov. Code 66314(d)(10)(A), 66322(a), 66323(b)Permitted. Sec. 93110.3.A requires any ADU or JADU that meets Division 10 to be 'approved ministerially without discretionary review or public hearing', within 60 days of a complete application (Sec. 93110.3.B), and Table 9211.2 makes the ADU a 'P' use subject only to a zoning compliance determination, the Director's ministerial review under Secs. 9413.1 to 9413.3 (appealable to the Planning Commission). The city's posted ADU application has the Planning Division issue an ADU approval before the applicant submits for building plan check. Since Ord. Nos. 25-2515U and 25-2514 (July 2025), every Director approval, including a ministerial zoning compliance review, needs the City Manager's prior concurrence, and any one council member may call a Director decision up for review within the appeal period; a review hearing on an ADU would collide with Gov. Code 66317(a)(1), and no record shows one has been held.
Carson Municipal Code Art. IX, Ch. 1A, New Zoning Code: Phase 1 (Ord. No. 24-2405, adopted 3-19-2024) Secs. 93110.3.A and 93110.3.B; Table 9211.2; Secs. 9411.4 and 9413.1 to 9413.3 as amended by Ord. No. 25-2514; Gov. Code 66317Sec. 93110.4.F.11.c bars renting an ADU or JADU 'for periods of 30 days or less', so every rental must run at least 31 days: that matches the longer-than-30-day terms Gov. Code 66323(e) and 66333(g) require for state-exempt units and JADUs, and is one day stricter than the 30-day minimum 66315 lets a city impose on other ADUs; longer rentals face no city registration or rent-control program. Division 62 (Secs. 93162.1 to 93162.3) separately prohibits short-term rentals (30 consecutive days or less, including advertising or offering one) in every zoning district citywide 'without exception'. Urgency Ord. No. 25-2503U (January 21, 2025) suspended that ban in residential and mixed-use zones for nine months to house wildfire evacuees; it sunset around October 21, 2025, and no extension appears in council minutes through September 1, 2026. A deed restriction recorded before the building permit notices the rental and conveyance limits, and Sec. 93110.4.F.12 allows separate sale only under 65852.26 (now 66341, qualified nonprofits); Carson has not opted into 66342 ADU condominiums.
Carson Municipal Code Art. IX, Ch. 1A, New Zoning Code: Phase 1 (Ord. No. 24-2405, adopted 3-19-2024) Secs. 93110.4.F.11.c, F.11.d and F.12; Secs. 93162.1 to 93162.3; Urgency Ord. No. 25-2503U; Gov. Code 66315, 66323(e), 66333(g), 66341The fine print: 15 caveats that can change the picture
- Two ADU texts sit on eCode360: the codified Article 9, Chapter 1 still prints Sec. 9122.1 as enacted by Ord. 22-2211 (adopted 6-8-2022: detached units one story and 16 feet, universal JADU owner occupancy), but Ord. 24-2405 Sec. 4.A put the New Zoning Code: Phase 1 in force for the residential and mixed-use zones about April 18, 2024, with the old chapter surviving only for non-residential zones, placeholders and Phase 2 matters. The operative ADU rules are Division 10 of the Phase 1 PDF attached under Chapter 1A, not Sec. 9122.1.
- State law overrides parts of Division 10: the 'only one category may be used per lot' rule and the single new-construction ADU per single-family lot (Sec. 93110.4.A to B) yield to Gov. Code 66323(a) as amended by SB 543 ('any combination' of a conversion ADU, a JADU and a detached unit of up to 800 sq ft), and the two-detached cap beside an existing multifamily building (Sec. 93110.4.D.5) yields to 66323(a)(4)(A)(ii) (up to eight, never more than the existing unit count).
- Parking conflicts: the one-space maximum applies even to studios and state-exempt units (contrary to 66314(d)(10)(A) and 66323(b)), the local exemption list omits 66322(a)(6) (ADU applied for with a new home), and Sec. 93110.4.F.10 still requires replacement parking when a garage is converted to a JADU, which 66334(a) bars (HCD treated a comparable JADU replacement-parking rule as a violation in its 7-7-2026 San Diego County findings).
- The 31-day rental floor in Sec. 93110.4.F.11.c is one day stricter than the 30-day minimum Gov. Code 66315 allows for ordinary ADUs; for state-exempt units and JADUs it matches 66323(e) and 66333(g).
- Sec. 93110.4.F.11.d requires a deed restriction for every ADU and JADU, recorded before a building or grading permit issues, covering conveyance limits, the short-term rental ban, the approved size and attributes and any owner-occupancy rule. State law prescribes a deed restriction for JADUs (66333(c)), and HCD has called comparable ADU deed-restriction requirements an unlawful added standard in letters to other cities (Irvine, Nevada County); Carson has no HCD letter on it.
- Mixed-use districts: Table 9212.2 (DMX, CMX and FLX) permits multi-unit housing but has no ADU row, and its preamble says unlisted uses are prohibited; Gov. Code 66323(a) requires ministerial approval of the listed ADU types in any residential or mixed-use zone, so state law controls on those lots.
- Height for an ordinary detached ADU away from transit is not stated in Sec. 93110.4.F.3 (the old Sec. 9122.1 said one story and 16 feet, and Table 9211.3 caps accessory buildings at 15 feet); the state floor of 16 feet in 66321(b)(4)(A) governs.
- Size measurement: Division 10 does not say its caps are interior livable space, as 66321(b) now does; the Phase 1 measuring rule takes floor area from the interior face of exterior walls (Part 1, Division 5), while the Part 5 definition of floor area measures to the outer surface of the walls.
- Separate sale: the Division 10 introduction says the new rules 'permit the sale of ADUs as condominium units', but the operative Sec. 93110.4.F.12 allows separate conveyance only under 65852.26 (now 66341, qualified nonprofits) 'notwithstanding' the condominium provision (former 65852.2(a)(10), now 66342), so there is no 66342 opt-in.
- Process: Ord. Nos. 25-2515U (urgency, 7-1-2025) and 25-2514 (7-15-2025) require City Manager concurrence before the Director issues any approval, including a ministerial zoning compliance review, and let any one council member call a Director or Planning Commission decision up for review; applied to an ADU, a review hearing would conflict with the no-hearing rule of 66317(a)(1). The city also screens ADUs through a Planning Division approval before building plan check, while 66321(b)(3) as amended effective 1-1-2026 now lists 'any requirement for a zoning clearance or separate zoning review' among the limits that may not block an 800 sq ft ADU.
- Short-term rentals: urgency Ord. No. 25-2503U (1-21-2025) suspended the Sec. 93162.3 ban in residential and mixed-use zones under City Manager regulations and sunset nine months after adoption (about 10-21-2025); no extension appears in council minutes through 9-1-2026. A council member asked staff on 10-21-2025 to report on the 2025 short-term rental bill, mentioned STR tracking software and the 2028 Olympics on 12-2-2025, and on 6-3-2026 raised short-term rentals and ADUs causing neighborhood parking problems (City Manager to report back); any ADU parking change remains bound by 66322.
- The city's only ADU handout is the Accessory Dwelling Unit (ADU) Application linked from the Planning forms page (ADU Application_rev.pdf, created 9-22-2021, modified 12-28-2021). Its standards pages are superseded: ADUs on lots 'with an existing single owner occupied dwelling', attached units capped at 50 percent or 1,200 sq ft whichever is less, 1,500 sq ft on lots of 20,000 sq ft or more, 6-foot separation, one story and 16 feet, a 150 sq ft minimum, universal JADU owner occupancy, a rule that violations be corrected before an ADU permit issues (contrary to 66322(b) and Sec. 93110.3.B.3), and a link to the retired Code Publishing site. The legacy site's 6-8-2019 'ADU Standards' PDF is likewise stale; neither is curated.
- HCD has never sent Carson an ADU letter (Excel index current to 7-14-2026; Power BI dashboard through 9-23-2026 shows only HAU0000281, a 5-19-2023 Housing Element letter of inquiry), and no public record shows Ord. 24-2405 was submitted to HCD within 60 days under 66326(a). If 66326(d) or 66316 voided Division 10, the state standards would apply (1,200 sq ft detached; attached 50 percent of the home), so the headline detached cap would not change.
- Chaptered 2026 law, effective 1-1-2027: AB 956 (Ch. 791, Stats. 2026) amends 66323 to allow two detached new-construction ADUs on a single-family lot under the state-exempt pathway (no JADU owed where two exist), further overriding Carson's one-detached-unit rule; SB 1117 (Ch. 809, Stats. 2026) limits impact fees on ADUs over 750 sq ft to the area above 750 sq ft, which matters little for city fees because CMC Sec. 11700(C) exempts ADUs from Carson's interim development impact fees.
- Historic properties: Sec. 93110.4.F.11.e approves ADUs on historic residential or mixed-use properties ministerially, but units listed on the California Register must meet the Secretary of the Interior Standards; Sec. 93110.4.F.5 requires matching architectural style, roof pitch, cladding and colors, which 66323(b) does not let the city impose on state-exempt units.
Summarized from Carson's ordinance text, read October 2026; every row links the code section it came from. Rules often vary by zone and lot, so treat this as orientation, not a permit determination, and confirm with the planning department before you commit to a design.

California statewide law also applies
California sets baseline ADU rights at the state level. Where local rules are stricter than state law allows, state law usually wins, so both are worth reading.
