Chula Vista repealed its local ADU ordinance (Ord. 3592, adopted April 15, 2025, effective 30 days later) expressly to defer all ADU and JADU regulation to the State Government Code, so state law applies directly. One detached new-construction ADU per single-family lot must be approved ministerially; up to 8 detached ADUs on a lot with an existing multifamily dwelling (not exceeding the existing unit count). The city's ADU page confirms ADUs are permitted in all areas zoned for single-family or multifamily residential use.

Attached ADUs and conversions of space within the primary dwelling or an accessory structure are allowed under the state standards the city now applies (no local ordinance). City standards table: one converted or attached ADU (not both) per single-family lot, in addition to one detached ADU and one JADU.

Detached ADU: 1,200 sq ft. Attached ADU (existing primary dwelling): 50 percent of primary dwelling floor area; city table applies 50 percent or 850 sq ft (studio or 1BR) / 1,000 sq ft (2+ BR), whichever is less; state law still guarantees at least an 800 sq ft ADU with 4-ft side and rear setbacks. JADU: 500 sq ft. No local minimum size; an efficiency unit cannot be prohibited.

With no local ordinance, the operative caps are the state statutory ones: 1,200 sq ft detached (Gov. Code 66314(d)(5)) and 50 percent of the existing primary dwelling for attached (66314(d)(4)), with the 800 sq ft floor of 66321(b)(3) and the 500 sq ft JADU cap of 66313(d). The city's published table (read via Wayback snapshot of Oct 2, 2025) states the same numbers with the 850/1,000 qualifier.

Owner occupancy
Not required

No owner-occupancy may be required for ADUs (Gov. Code 66315 bars it as a standard, and the city imposes no local standards after the Ord. 3592 repeal); the city's comparison table states no owner-occupancy for ADUs. JADUs are different: owner-occupancy with a recorded deed restriction is required when the JADU shares sanitation facilities with the main house (Gov. Code 66333(b), as amended by AB 1154 effective Jan 1, 2026; not required if the JADU has separate sanitation facilities or the owner is a governmental agency, land trust, or housing organization). The city page lists JADU owner-occupancy (deed restriction) as required.

Extra parking
None per the city's published ADU standards table ('No parking requirements', single-family and multifamily). State law would in any case cap parking at 1 space per ADU or per bedroom (whichever is less), allows tandem parking on a driveway, bans replacement-parking requirements when a garage, carport, or covered or uncovered space is demolished or converted for an ADU, and bars any parking requirement for conversion ADUs, ADUs within a half mile walking distance of public transit, and the other Gov. Code 66322 cases.

Gov. Code 66322 applies whether or not a local ADU ordinance exists. The flat 'no parking requirements' statement is the city's own published implementation (ADU page, read via Wayback snapshot of Oct 2, 2025).

Approval process
Permitted use

Ministerial building-permit review, no discretionary review or hearing. Because Chula Vista has not adopted an ADU ordinance, Gov. Code 66320 requires it to process applications ministerially under 66317: completeness determination within 15 business days, approval or denial within 60 days of a complete application, deemed approved if the deadline is missed. City Standard ADU Plan submittals (SnapADU program) are reviewed in 14 business days versus 21 business days for standard ADU applications, per the city ADU page. In the Coastal Zone, a coastal development permit is also decided within 60 days without a public hearing (Gov. Code 66329).

Rental restrictions
An ADU may be rented but not sold or conveyed separately from the primary residence (narrow state exception for qualified nonprofit tenancy-in-common arrangements; condo-style separate conveyance is unavailable because the city has adopted no Gov. Code 66342 ordinance). Rentals of ADUs approved under the state mandatory categories and of all JADUs must be for terms longer than 30 days. Separately, CVMC Chapter 5.68 (Short-Term Rentals, defined as stays under 30 consecutive days) excludes ADUs and JADUs whose construction permit was applied for on or after Jan 1, 2020 from short-term rental use; pre-2020-permit ADUs can operate only as partial-home STRs with the owner or long-term tenant residing on site.

The fine print: 8 caveats that can change the picture
  • Chula Vista has no local ADU development standards: Ord. 3592 (April 15, 2025) fully repealed CVMC 19.58.022 (ADUs) and 19.58.023 (JADUs) with the stated intent to defer all ADU and JADU regulation to the State Government Code, so every value above restates state law (Gov. Code 66310-66342) as the city applies it; the chapter binds charter cities (Gov. Code 66312)
  • State ADU law changes nearly every year; 2026 amendments (SB 543, AB 1154, AB 1170) are already reflected in the sections cited here, so re-verify against current Gov. Code text rather than cached summaries
  • Coastal Zone: state ADU law does not supersede the California Coastal Act, so ADUs in Chula Vista's coastal areas may also need a coastal development permit, though it must be decided within 60 days without a public hearing and is not appealable to the Coastal Commission when issued under a certified local program (Gov. Code 66329)

  • Short-term rentals: ADUs and JADUs with construction permits applied for on or after Jan 1, 2020 cannot be used as short-term rentals under CVMC Chapter 5.68
  • An ADU certificate of occupancy cannot issue before the primary dwelling's certificate of occupancy (Gov. Code 66328)
