ADU rules in Downey
These are the primary sources for accessory dwelling unit regulations in Downey: the city's own zoning code, planning department pages, and permit guides. Start here before talking to anyone: the rules below are what your permit reviewer will apply.
Rules at a glance
Downey makes ADUs a permitted use on lots with an existing or proposed home in the R-1, R-2, R-3, R-3-O and M-U zones and anywhere else single-family or multifamily housing is allowed (§ 9414.06). A single-family lot may have up to two ADUs, one new-construction attached or detached unit plus one conversion, plus one JADU (§ 9414.08(a)); a lot with an existing multifamily building may add up to eight detached ADUs but no more than the number of existing units, and a lot with a proposed multifamily building two (§ 9414.10(a)). A vacant lot can add an ADU only together with a new home (§ 9414.06(a)(2)). New detached units need 4-foot side and rear setbacks and may be 16 feet tall, or 18 feet plus 2 feet for a matching roof pitch within one-half mile walking distance of a major transit stop or high-quality transit corridor.
Downey Municipal Code §§ 9414.06, 9414.08(a), (c) and (d), 9414.10(a) (Ord. 25-1523, adopted 4-8-2025; amended by Ord. 26-1544, adopted 6-9-2026)Attached additions and conversions of existing space (attached garages, storage areas, accessory structures) are allowed on single-family lots; conversions of permitted space carry no size cap and may expand up to 150 sq ft for ingress and egress (§ 9414.08(b)(6)). One JADU of up to 500 sq ft of interior livable space may be carved out of a single-family home, but JADUs are barred on multifamily-zoned properties (§ 9414.06(a)(1), § 9414.08(a)(2)). On multifamily lots, new ADUs must be detached from the multifamily building, while conversions of non-livable space inside it are allowed for at least one unit and up to 25 percent of the existing units (§ 9414.10(a)). Attached ADUs may be 25 feet tall or the zone's height limit, whichever is lower, and no ADU may exceed two stories (§ 9414.08(d)(3)).
Downey Municipal Code §§ 9414.06(a)(1), 9414.08(a)(2), (b)(2), (b)(6) and (d)(3), 9414.10(a)(3) (Ord. 25-1523; Ord. 26-1544)Section 9414.08(b)(1) caps a new detached or attached ADU at 850 sq ft for a studio or one bedroom and 1,000 sq ft for two or more bedrooms, the same caps on single-family and multifamily lots (§ 9414.10(b)(1)). An attached ADU is further limited to 800 sq ft or 50 percent of the existing home, whichever is more, never above 1,000 sq ft (§ 9414.08(b)(2)). An ADU of 800 sq ft or less is exempt from FAR, lot coverage, front setback, design and open-space standards, while larger units must also meet the zone's lot coverage and FAR (§ 9414.08(b)(3)-(4)). Conversions of permitted space are uncapped and JADUs are limited to 500 sq ft of interior livable space. The headline numbers match the state floors in Gov. Code 66321(b)(2), although the local text still says 'floor area' rather than interior livable space (see caveats).
Downey Municipal Code §§ 9414.08(a)(2)(i), (b) and (d), 9414.10(b) and (d) (Ord. 26-1544, adopted 6-9-2026); Gov. Code 66321(b)Downey imposes no owner-occupancy requirement on ADUs, consistent with Gov. Code 66315. Ord. 26-1544 (adopted 6-9-2026) narrowed the JADU rule so that owner occupancy, backed by a deed restriction recorded before final inspection, applies only when the JADU shares sanitation facilities with the main home (§ 9414.08(a)(2)(vii), § 9414.14(f)), matching Gov. Code 66333(b) as amended by AB 1154; government agencies, land trusts and housing organizations are exempt. The city's September 2025 R-1 fact sheet still describes a universal JADU owner-occupancy deed restriction and is out of date on this point.
Downey Municipal Code §§ 9414.08(a)(2)(vii), 9414.14(f) (Ord. 26-1544); Gov. Code 66315, 66333(b)Section 9414.14(a)(1) requires one uncovered off-street space for each ADU, which may sit on the existing legal driveway in setback areas or in tandem, unless the ADU is within one-half mile walking distance of public transit, in an architecturally and historically significant historic district, part of the home or an accessory structure, in an area where on-street permits are required but not offered to the occupant, within one block of a car share stop, or filed with a new home and otherwise meeting one of those criteria; the list mirrors Gov. Code 66322(a). JADUs need no parking (Gov. Code 66334(a)), and spaces lost to a garage conversion need not be replaced (Gov. Code 66314(d)(11)). On a plain reading the one-space rule exceeds Gov. Code 66314(d)(10)(A) for studio ADUs (one space per unit or per bedroom, whichever is less) and cannot be imposed on a state-exempt unit under Gov. Code 66323(b).
Downey Municipal Code § 9414.14(a) (Ord. 25-1523; Ord. 26-1544); Gov. Code 66314(d)(10)-(11), 66322(a), 66323(b), 66334(a)ADU and JADU permits are approved ministerially without discretionary review or a hearing (§ 9414.16(a)) and must be acted on within 60 days of a complete application or are deemed approved (§ 9414.16(b)); a denial must list the deficient items within the same period (§ 9414.16(c)). Plans are filed electronically through the city's Accela Citizen Access portal for Building and Safety and Planning review, and a demolition permit for a detached garage being replaced by an ADU is issued with the ADU permit (§ 9414.16(d)). Objective design standards (front entrance toward the street, matching roof slope and materials, frosted second-story windows, enclosed staircases) apply to ADUs and JADUs except new units of 800 sq ft or less and units built under Gov. Code 66323 (§ 9414.08(b)(3)-(4), § 9414.12).
Downey Municipal Code §§ 9414.12, 9414.16 (Ord. 25-1523; Ord. 26-1544)ADUs may be rented long term but never for a term shorter than 30 days, regardless of when the ADU was built (§ 9414.14(c)), a floor Gov. Code 66315 allows for ordinary ADUs. State law requires terms longer than 30 days for state-exempt units (Gov. Code 66323(e)) and JADUs (Gov. Code 66333(g)), which the local text does not mention. ADUs may not be sold or conveyed separately except as Gov. Code 66341 requires (§ 9414.14(d)), so there is no 66342 condominium opt-in. Downey has no short-term rental permit or registration program: § 9158 defines 'Short-Term Rental' as occupancy of 30 consecutive days or less, but no regulation uses the term, and § 9312.08(b)(1) bars commercial use of residential lots.
Downey Municipal Code §§ 9414.14(c)-(d) (Ord. 25-1523; Ord. 26-1544), 9158, 9312.08(b)(1); Gov. Code 66315, 66323(e), 66333(g), 66341The fine print: 10 caveats that can change the picture
- JADU use-table conflict: Table 9.3.2 in § 9312.06 (restated by Ord. 26-1543, adopted 6-9-2026) lists 'Junior accessory dwelling units' as NP in the R-1, R-2, R-3 and R-3-O zones, while § 9414.06 and § 9414.08(a)(2) (Ord. 26-1544, adopted the same night) allow one JADU on a single-family lot and the city's fact sheets do too. Gov. Code 66323(a)(1) requires ministerial approval of one ADU and one JADU per lot with a single-family dwelling in a residential or mixed-use zone, so the table entry yields. The § 9414.06(a)(1) bar on JADUs on multifamily-zoned properties answered a 2023 HCD comment but may not hold for a single-family home on an R-2 or R-3 lot under 66323(a)(1).
- Parking conflicts: § 9414.14(a)(1) requires one space for every new ADU, including studios, while Gov. Code 66314(d)(10)(A) caps parking at one space per ADU or per bedroom, whichever is less. § 9414.12(m) exempts state-exempt (66323) units from lot coverage, front setbacks and design standards but not from the parking rule, which Gov. Code 66323(b) bars ('A local agency shall not impose any objective development or design standard that is not authorized by this section').
- Size measurement: § 9414.08(b)(1) states its caps as 'maximum floor area' and § 9132 defines Floor Area as the area within the exterior walls, while Gov. Code 66321(b)(2) frames the 850/1,000 sq ft floors in interior livable space. The 5-6-2026 Planning Commission staff report says Ord. 26-1544 moved the code to SB 543's livable-space measurement, and Ord. 26-1544 added a Livable Space definition (§ 9144) and rewrote the JADU, porch and fee clauses that way, but (b)(1) still reads 'floor area'; expect the state measure to control.
- Rental terms: § 9414.14(c) permits a 30-day term for any ADU; Gov. Code 66323(e) (state-exempt units) and 66333(g) (JADUs) require terms longer than 30 days, and the local text does not address JADUs at all.
- Chaptered 2026 law effective 1-1-2027: AB 956 (Ch. 791, Stats. 2026) amends Gov. Code 66323 to allow two detached new-construction ADUs on a single-family lot under the state-exempt pathway (no JADU owed where two exist), so the one-new-construction-ADU limit in § 9414.08(a)(1) yields from that date; SB 1117 (Ch. 809, Stats. 2026) amends 66311.5 so impact fees on an ADU over 750 sq ft attach only to the area above 750 sq ft, replacing the proportional formula in § 9414.18(a)(2). Re-read both on or after 1-1-2027.
- HCD record: no ADU letter is public. HCD's ordinance-review index (current to 7-14-2026) has no Downey row, and the enforcement dashboard shows only two Housing Accountability Unit letters (a 3-14-2025 Housing Element rezone inquiry and a 7-8-2026 SB 4 technical-assistance letter). Ord. 25-1523 recites an 8-17-2023 HCD review that found the city's prior ordinance noncompliant; the 2-19-2025 staff report ties HCD's comments to the 2023 ordinance (Ord. 23-1507), tables them (unit combinations, JADUs only on single-family lots, height measurement, deed restrictions only for JADU owner occupancy, rent reporting, the 800 sq ft floor, entrance orientation, washer and dryer hookups) and marks each resolved by Ord. 25-1523. The 5-6-2026 staff report committed to sending Ord. 26-1544 to HCD within 60 days under Gov. Code 66326; no public record confirms it, and a missed submission would void the ordinance under 66326(d) in favor of the state standards.
- Multifamily lots: new ADUs must be detached from the multifamily building (up to eight with an existing building, capped at the existing unit count; two with a proposed building), conversions of non-livable space are limited to 25 percent of the existing units (at least one), and the 18-foot detached height applies where the multifamily building has more than one story.
- Stale city handouts: the Planning Division's R-1 and multifamily fact sheets on the ADU page (September 2025) predate Ord. 26-1544; the R-1 sheet prints a universal JADU owner-occupancy deed restriction, and both list only two of the six parking exemptions; the April 2026 ADU newsletter is informational. The Pre-Approved ADU Plans page says no pre-approved plans were available as of 7-28-2026.
- SB 9 lots: the two-unit development rules in § 9312.08(c) count ADUs and JADUs as units and let only a lot not created by an urban lot split add the ADUs and JADUs state law requires on top of its two units, so lots created by an urban lot split get no ADU allowance beyond the two units.
- Fees: impact fees are waived for ADUs of 750 sq ft of interior livable space or less and JADUs of 500 sq ft or less (§ 9414.18(a)). § 9414.18(b)(3) requires a separate utility connection for every new detached ADU unless the City is the provider, while (b)(2) exempts conversions, JADUs and units allowed under Gov. Code 66323 from new connections and connection fees; the two clauses overlap for a new detached state-exempt unit, and Gov. Code 66311.5(d) exempts only 66323(a)(1) conversion units.
Summarized from Downey's ordinance text, read October 2026; every row links the code section it came from. Rules often vary by zone and lot, so treat this as orientation, not a permit determination, and confirm with the planning department before you commit to a design.

California statewide law also applies
California sets baseline ADU rights at the state level. Where local rules are stricter than state law allows, state law usually wins, so both are worth reading.
