ADU rules in Encinitas

5 sources

These are the primary sources for accessory dwelling unit regulations in Encinitas: the city's own zoning code, planning department pages, and permit guides. Start here before talking to anyone: the rules below are what your permit reviewer will apply.

Rules at a glance

Detached (backyard) ADU
Allowed

Detached ADUs are a permitted use in all areas zoned to allow single-family or multifamily residential use (EMC 30.48.040.T.1) and are approved ministerially through a building permit, with Development Services plan-review and inspection fees waived. The code and the January 2026 city guide (PLN-118) allow one ADU, attached or detached, plus one JADU on a single-family lot (T.2-T.3), but Gov. Code 66323(a) also requires the city to approve a conversion ADU, a JADU and one detached new-construction unit of up to 800 sq ft with 4-ft side and rear setbacks in combination. On a lot with an existing multifamily building the guide allows up to eight detached ADUs, never more than the existing units (66323(a)(4); the codified T.19.b still says two), and two beside a proposed multifamily building. Inside the coastal zone, which covers most of the city, a detached ADU also needs a coastal development permit decided without a hearing (T.21; Gov. Code 66329), and the coastal bluff and hillside overlays restrict where it can sit.

EMC § 30.48.040.T.1-3, T.13-14, T.19, T.21, T.25 (Ords. 2020-10, 2022-03, 2022-11); ADU and JADU Guide PLN-118 (Jan. 2026) p. 1; Gov. Code 66314, 66323(a)(2), (a)(4), 66329(a)
Attached or internal ADU
Allowed

Attached ADUs (structurally connected wall to wall with the home, per PLN-118) and ADUs converted from space inside the existing home or an accessory structure are permitted on the same terms (T.1-T.2, T.14.a); conversions need no setback and may add up to 150 sq ft for access (T.15.c.iii-iv). One JADU of up to 500 sq ft with an efficiency kitchen is allowed within a proposed or existing single-family home or its attached garage, alongside an ADU, but not on a multifamily site (U.1-U.2, U.6; PLN-118 p. 1). On a lot with an existing multifamily building, ADUs may be converted from non-livable space such as storage rooms, attics, basements and garages, up to 25 percent of the existing units and at least one (T.19.a; Gov. Code 66323(a)(3)). In the coastal zone a unit wholly contained in the home's existing habitable space needs no coastal permit, while one that adds habitable area or converts non-habitable space does (T.21).

EMC § 30.48.040.T.1-2, T.14.a, T.15.c, T.19.a, T.21, U.1-U.6 (Ord. 2018-02 as amended by Ords. 2020-10, 2022-03, 2022-11); PLN-118 (Jan. 2026) pp. 1, 3; Gov. Code 66323(a)(1), (a)(3), 66333
Maximum size
1,200 sq ft or the main home's living area, whichever is less (attached or detached), but never below 850 sq ft (studio or 1 bedroom) or 1,000 sq ft (2+ bedrooms); 800 sq ft with 4-ft side/rear setbacks always allowed; JADU 500 sq ft; detached 16 ft at reduced setbacks (18 ft near major transit, 20 ft with matching roof pitch), zone height (22 or 26 ft) at zone setbacks

EMC 30.48.040.T.14 caps an attached or detached ADU at 1,200 sq ft of living area or the total living area of the primary dwelling, whichever is less, and guarantees an 800 sq ft unit up to 16 ft tall with 4-ft side and rear setbacks regardless of the home's size (T.13-T.14.a); living area is interior habitable area including basements and attics but excluding garages (T.26), in line with the state's interior-livable-space measure. The January 2026 guide applies the Gov. Code 66321(b)(2) floors, so beside a small home a studio or one-bedroom ADU may still reach 850 sq ft and a larger one 1,000 sq ft; the code sets no separate 50 percent cap for attached units, a less restrictive rule that 66325(b) permits. An ADU that meets the zone setbacks or sits directly above a garage may reach the zone height (26 ft in RR and RR-1, 22 ft in RR-2 through R-25), while one using the reduced setbacks is held to 16 ft if detached (18 ft within one-half mile of major transit or 20 ft with a roof pitch matching the home, 18 ft beside a multistory multifamily building) and to 22 or 25 ft by zone if attached (T.16; § 30.16.010.B.6; PLN-118 p. 2). JADUs are capped at 500 sq ft (U.6.a).

EMC § 30.48.040.T.13, T.14.a-b, T.16, T.26, U.6.a; § 30.16.010.B.6.a; PLN-118 (Jan. 2026) pp. 1-2; Gov. Code 66314(d)(4)-(5), 66321(b)(2)-(4), 66325(b)
Owner occupancy
Not required

Encinitas imposes no owner-occupancy requirement on ADUs: the January 2026 city guide states 'No owner occupancy requirements,' as Gov. Code 66315 requires. For a JADU the guide requires the owner to live in the main home or the JADU only when the JADU lacks its own sanitation facilities, the Gov. Code 66333(b) rule as amended by AB 1154 (effective 1-1-2026). The codified JADU text (30.48.040.U.5 and the U.10.d covenant clause, 2018 to 2022) still requires owner occupancy for every JADU, a clause that yields to 66333(b) under the code's own state-law-controls provision (U.14). The May 2025 edition of the guide, still linked as the 'ADU FAQ' on the city ADU page, prints the older universal JADU rule.

PLN-118 (Jan. 2026) p. 3; EMC § 30.48.040.U.5, U.10.d, U.14; Gov. Code 66315, 66333(b)
Extra parking
1 space per ADU (tandem or in setbacks allowed) unless within 1/2 mile of public transit (any bus stop or the train station), a conversion of existing space, in a historic district, near car share or where street permits are not offered; none for JADUs, state-exempt units or (under state law) studios; lost parking replaced only west of Coast Highway 101 between Swami's and La Costa Avenue per the city guide

An ADU needs one off-street space, which may be tandem on an existing driveway or in setback areas (T.18.b), unless it lies within a one-half-mile radius of public transit (the guide counts the train station and all bus stops), in an architecturally and historically significant historic district, wholly within existing space, where on-street permits are required but not offered, or within one block of a car share facility (T.18.d); Gov. Code 66322(a)(6) adds units applied for together with a new home on the lot. JADUs need none (U.6.e), the 66323 state-exempt units carry no parking (66323(b)), and because 66314(d)(10)(A) caps parking at one space per ADU or per bedroom, whichever is less, the code's flat one-space rule cannot lawfully reach a studio. The certified code text still requires any required parking removed for an ADU to be replaced on the lot citywide (T.18.c), a rule the city kept in 2022 when it declined the Coastal Commission's suggestion to confine replacement to sites west of Coast Highway 101 (LCP-6-ENC-22-0014-1), yet the January 2026 guide requires replacement only in the coastal zone west of Coast Highway 101 between Swami's and La Costa Avenue. Outside the coastal zone Gov. Code 66314(d)(11), which since 1-1-2026 also covers uncovered spaces, bars replacement, while inside it 66329(a) preserves Coastal Act protections; Encinitas Ranch's single-family zones still print one space per accessory unit with no exemptions (Specific Plan 6.5.3.F.2), which 66322 overrides.

EMC § 30.48.040.T.18.a-d, U.6.e; Encinitas Ranch Specific Plan § 6.5.3.F.2; PLN-118 (Jan. 2026) p. 3; Coastal Commission staff report on LCP-6-ENC-22-0014-1 (6-28-2022) pp. 1-2; Gov. Code 66314(d)(10)-(11), 66322(a), 66323(b), 66329(a)
Approval process
Permitted use

Applications that conform to 30.48.040.T or U are ministerial permits without discretionary review or a hearing, decided within 60 days of a complete application (T.21, U.11; Gov. Code 66317), and outside the coastal zone the building permit is the only approval. Inside the coastal zone, ADUs and JADUs not wholly contained in the home's existing habitable space need a coastal development permit or administrative CDP (T.21): per PLN-118 the planner opens a CDP record from the building permit, the applicant posts a notice sign, a mailed notice allows 10 days for comments, and the Director signs a Notice of Decision with no public hearing, as Gov. Code 66329(a) allows, before the building permit issues. The guide and the city ADU page still describe a 10-business-day Coastal Commission appeal period in the appeal jurisdiction, but since AB 462 took effect on 10-10-2025 a local ADU coastal permit decision is not appealable under Public Resources Code 30603 (66329(c)). The code's coastal deadline reads 60 days 'to the extent feasible', softer than the mandatory 60-day clock in 66329(a), and the general CDP chapter's hearing and Council-appeal provisions (30.80.080, 30.80.150) yield to 66317 and 66329 for ADUs.

EMC § 30.48.040.T.21, U.11; §§ 30.80.080, 30.80.140, 30.80.150; PLN-118 (Jan. 2026) p. 4; Gov. Code 66317, 66329(a), (c)
Rental restrictions
Long-term rental only: terms over 30 days in the code (30 days or more per the 2026 city guide); ADUs and JADUs cannot be short-term rentals (STR permits cover only single-family and duplex homes; a few grandfathered ADU STR permits end when they lapse); no separate sale; recorded covenant

The code lets an ADU or JADU be rented only under agreements with terms greater than 30 days and writes that limit, the no-separate-sale rule and the unit's size into a covenant recorded before the building permit issues (T.6-T.7, T.24, U.3-U.4, U.10). The January 2026 guide says units may be rented for 30 days or more and may not be used as short-term rentals; for ordinary ADUs 66315 lets a city require terms of 30 days or longer, so the code's over-30-day wording is one day stricter than state law allows, while 66323(e) and 66333(g) require terms longer than 30 days for state-exempt units and JADUs. Short-term rental permits under EMC Chapter 9.38 cover only single-family and duplex units, and the 9.38.020 definition carves out accessory dwelling units, so an ADU cannot hold one; the city's STR permit page says STRs are prohibited within ADUs, with a few legally operating ADU STRs grandfathered until their permits expire, and Ord. 2026-15 (introduced 9-23-2026) keeps that exclusion. An ADU may not be sold separately from the home (T.6), and Encinitas has not opted into Gov. Code 66342 ADU condominiums.

EMC § 30.48.040.T.6-7, T.24, U.3-4, U.10; §§ 9.38.020, 9.38.030 (Ords. 2006-05, 2021-22); PLN-118 (Jan. 2026) pp. 3-4; City Short Term Rental Permits page (read 10-7-2026); Gov. Code 66314(d)(1), 66315, 66323(e), 66333(g)
The fine print: 13 caveats that can change the picture
  • Which text governs: EMC Title 30 is the city's certified Local Coastal Program Implementation Plan, so the same 30.48.040.T and U (Ords. 2020-10, 2022-03 and 2022-11; Coastal Commission concurrence 11-16-2022) governs inside and outside the coastal zone, which covers most of the city; inside it, units that add or convert floor area also need a no-hearing coastal development permit (Gov. Code 66329(a)). Because EMC 30.82.010 keeps any Title 30 amendment from taking effect until the Coastal Commission certifies it, the 2023 to 2026 state changes were never codified (the 2023 and 2024 initiation resolutions produced no ordinance), and the city applies the code 'or as amended in' Gov. Code 66314 to 66339 (PLN-118; the T.25 and U.14 state-law-controls clauses).
  • State-law overrides on the codified text: the one-ADU limit on single-family lots (T.2, still printed in PLN-118) yields to the 66323(a) combination of a conversion ADU, a JADU and an 800 sq ft detached unit; the two-detached-unit multifamily cap (T.19.b) yields to eight under 66323(a)(4), which the guide already applies; universal JADU owner occupancy (U.5, U.10.d) yields to 66333(b); the flat one-space parking rule cannot reach studios (66314(d)(10)(A)); and impact fees are waived only below 750 sq ft (T.22) against the 66311.5 exemption for units of 750 sq ft or less.
  • Replacement parking is unsettled: the certified text (T.18.c) requires replacing any required parking removed for an ADU anywhere in the city, the January 2026 guide requires it only in the coastal zone west of Coast Highway 101 between Swami's and La Costa Avenue, and Gov. Code 66314(d)(11) (amended 1-1-2026 to cover uncovered spaces) bars replacement outside the coastal zone; confirm with the Planning Division before removing a garage or driveway space.
  • Coastal Commission appeals: the city ADU page and PLN-118 (January 2026) still tell applicants in the appeal jurisdiction (between the sea and the first public road, within 300 ft of a beach or of a coastal bluff top, or within 100 ft of a wetland or stream; EMC 30.80.030.A.3) to expect a 10-business-day Coastal Commission appeal period, but Gov. Code 66329(c) (AB 462, effective 10-10-2025) makes local ADU coastal permit decisions not appealable under Public Resources Code 30603.
  • Coastal Bluff Overlay: on blufftop lots PLN-118 treats ADUs as additions limited to 10 percent of the existing residence's area or 250 sq ft, whichever is greater, behind the 40-ft blufftop setback with geotechnical review (EMC 30.34.020.B.1, B.9), and the Planning Commission is the authorized agency for discretionary approvals in that overlay (30.34.020.C); in the Hillside/Inland Bluff Overlay ADUs must stay off natural slopes of 25 percent or more (30.34.030). These LCP resource rules survive inside the coastal zone under 66329(a) but can block the 800 sq ft state-exempt unit on affected lots.
  • Sloped lots: on R-3 to R-25 lots averaging more than 10 percent slope, PLN-118 applies the 30.16.010.B.6.a.i height rule (12 ft or 16 ft measured from the uphill side of the lot or the crown of the road) to ADUs, a measurement that may conflict with the 16-ft detached floor of Gov. Code 66321(b)(4)(A) on some lots.
  • Recorded covenant: a covenant barring separate sale, limiting rentals to terms over 30 days and short-term use, and fixing the unit's size must be recorded before the building permit (T.24, U.10); Gov. Code 66333(c) mandates a deed restriction only for JADUs and 66315 bars ADU standards beyond 66314, so the ADU covenant is exposed if challenged, though HCD has never reviewed the Encinitas ordinance.
  • Void exposure: the 2020 to 2022 ordinance fails several current requirements of Gov. Code Chapter 13, so under 66316 (and 66326(d) if it never reached HCD within 60 days of adoption) it could be read as null and void, leaving the state standards (1,200 sq ft detached; attached 50 percent of the home with the 850/1,000 sq ft floors); HCD has sent Encinitas no ADU-law letter of any kind (letter index current to 7-14-2026, dashboard to 10-5-2026), and the city administers its code with state law layered on.
  • Stale city materials: the ADU page's 'ADU FAQ' link serves the May 2025 edition of PLN-118, which still requires owner occupancy for every JADU, and the page's January 2019 workshop downloads (ADU Handout, ADU Code Language) describe the 2018 rules, including a lot-coverage and floor-area bonus the current code no longer contains; rely on the January 2026 guide.
  • Chaptered 2026 law: AB 956 (Ch. 791, Stats. 2026, effective 1-1-2027) amends 66323 to allow two detached new-construction ADUs on a single-family lot under the state-exempt pathway (no JADU owed where two exist), widening the gap with the local one-ADU count, and SB 1117 (Ch. 809, Stats. 2026, effective 1-1-2027) limits impact fees on ADUs over 750 sq ft to the area above 750 sq ft, replacing the T.22 proportional fee base for larger units; re-read both after 1-1-2027.
  • Short-term rental changes pending: Ord. 2026-15 (introduced 9-23-2026, effective 30 days after adoption) re-enacts the 2022 Chapter 9.38 amendments (two-family dwellings, three-year permits) with SB 346 facilitator and TOT rules and keeps the ADU exclusion; the Title 30 STR chapter 30.50 (Ord. 2022-16) is not in effect because the council refused the Coastal Commission's two-night-minimum modification (Ord. 2026-08 denied 4-22-2026).
  • Fees: Development Services plan-review and inspection fees are waived for ADUs (T.22; PLN-118), school fees apply to units over 500 sq ft, and Ord. 2026-17 (moving development impact fees to a square-footage basis) was listed for adoption on the 9-16-2026 consent calendar.
  • Encinitas Ranch Specific Plan single-family zones (ER-SFR3, ER-SFR3V, ER-SFR5) still allow 'one accessory unit' with one off-street space and no exemptions, and cite a nonexistent Section 30.48.010W (Specific Plan 6.5.3.F.2 and H); Gov. Code 66322 and 66323 control.

Summarized from Encinitas's ordinance text, read October 2026; every row links the code section it came from. Rules often vary by zone and lot, so treat this as orientation, not a permit determination, and confirm with the planning department before you commit to a design.

California statewide law also applies

California sets baseline ADU rights at the state level. Where local rules are stricter than state law allows, state law usually wins, so both are worth reading.
