ADU rules in Fontana
These are the primary sources for accessory dwelling unit regulations in Fontana: the city's own zoning code, planning department pages, and permit guides. Start here before talking to anyone: the rules below are what your permit reviewer will apply.

Code sec. 66323): one detached new-construction ADU up to 800 sq ft on a lot with a single-family dwelling; on multifamily lots, up to 2 detached ADUs with a proposed multifamily building or up to 8 with an existing one (not exceeding the number of primary units). Larger detached ADUs, up to 1,200 sq ft, proceed under the Class 2 local standards.

Fontana Zoning and Development Code sec. 30-467(c)(6)(a), (e)(1)(a)-(b), (g)(1)ADUs created on or after January 1, 2020 have no owner-occupancy requirement. JADUs require owner occupancy only when the JADU shares sanitation facilities with the primary dwelling; a JADU with its own bathroom carries no owner-occupancy requirement, and the requirement never applies when the property is entirely owned by a government agency, land trust, or housing organization.

Completeness is determined within 15 business days; the City must approve or deny within 60 days of a complete application, and the application is deemed approved if it misses that deadline. Denials must list every defect and how to cure it; completeness and denial appeals go to the planning commission (decision within 60 business days).

- Two approval tracks set different numbers: Class 1 (state track under Gov. Code sec. 66323: conversions of existing space, one 800 sq ft detached ADU per single-family lot, multifamily conversions up to 25 percent of existing units, and 2 to 8 detached units on multifamily lots) versus Class 2 (local standards: 1,200 sq ft cap, parking, design rules, one-story limit for detached).
- Zone dependence: JADUs are allowed only on lots zoned for single-family residences; Class 1 ADUs on lots in residential or mixed-use zones; Class 2 ADUs on lots zoned for single-family or multifamily residential use (sec. 30-467(f)(1)).
- Height varies by context: detached ADUs 16 ft base, 18 ft within a half mile walking distance of a major transit stop or high-quality transit corridor (up to 20 ft to match the primary dwelling's roof pitch) or on a lot with a multistory multifamily dwelling; attached ADUs up to 25 ft or the zone limit, whichever is lower (sec. 30-467(f)(2)).
- Class 2 setbacks are 4 ft side and rear plus an 18 ft front setback, with no setback required where the ADU replaces a legal existing structure in the same location and dimensions; total lot coverage may not exceed 50 percent, but none of these standards may force the ADU below 800 sq ft (sec. 30-467(g)(1)(c), (g)(2), (g)(3)).
- Class 2 design standards: exterior materials, colors, roof slope, windows, and doors must match the primary dwelling; detached Class 2 ADUs are limited to one story; interior dimensions must be at least 10 ft in every direction; windows and doors within 30 ft of an interior lot line need clerestory or obscured glazing, and no direct line of sight to adjoining residential property is allowed (sec. 30-467(g)(6), (g)(8)).
- An ADU on or within 600 ft of a property listed in the California Register of Historic Resources must not be visible from any public right-of-way (sec. 30-467(g)(7)).
- On a single-family lot the allowed maximum combination is one JADU plus one conversion ADU plus one detached new-construction Class 1 ADU (sec. 30-467(e)(1); city info sheet states the combination explicitly).
- Impact fees are waived for ADUs under 750 sq ft and charged proportionately to the primary dwelling's floor area above that (sec. 30-467(h)(1)).
- JADUs require a deed restriction recorded before building permit issuance (sec. 30-467(f)(8)).
- The current section governs complete applications submitted on or after January 1, 2025; earlier applicants may elect in writing to proceed under the prior rules (sec. 30-467(a)(2)).
