ADU rules in Hesperia
These are the primary sources for accessory dwelling unit regulations in Hesperia: the city's own zoning code, planning department pages, and permit guides. Start here before talking to anyone: the rules below are what your permit reviewer will apply.
Rules at a glance
HMC 16.12.360(D)(1) allows an ADU on any lot zoned for agricultural, single-family, multifamily or mixed uses that holds an existing or proposed home, and (E)(1) lets it stand detached, including in a converted detached garage; the residential use table (HMC 16.16.085, row C) lists accessory dwelling units as an accessory use ("A") in all five residential designations (R1, R3, RR, A1 and A2). The local text still allows only one ADU plus one JADU on a single-family lot (D.3.a) and no more than two detached ADUs on a multifamily lot (D.3.b), but Gov. Code 66323(a), as amended by SB 543 from 1-1-2026, requires ministerial approval of "any combination" of a conversion ADU, one detached new-construction ADU and a JADU, and of up to eight detached ADUs beside an existing multifamily building (never more than its existing units). HCD flagged both local limits on 6-19-2025; the city's answer, Ord. 2025-05, was introduced in October 2025 but never adopted. Lots without sewer must be at least one gross acre or install an approved supplemental treatment septic system (D.10, a Lahontan Regional Water Quality Control Board rule).
Hesperia Municipal Code 16.12.360(D)(1), (D)(3), (D)(10), (E)(1) (last amended Ord. No. 2025-01, 5-20-2025); HMC 16.16.080, 16.16.085 (row C); Gov. Code 66323(a)Under HMC 16.12.360(E)(1) an ADU may be attached to or built within the existing or proposed home, including an attached garage, storage area or accessory structure, and on a multifamily lot it may be converted from non-habitable space. An attached ADU needs its own entrance, which may not sit on the same wall plane as the main entrance (E.3); new attached space gets 4 ft side and rear setbacks and conversions of existing space need none (E.4, E.5). JADUs of up to 500 sq ft must sit within the walls of an existing or proposed single-family home, attached garages included (B.c, F.2.c), with a separate entrance and an efficiency kitchen (F.2.d, F.2.e). The local text confines JADUs to lots zoned agricultural or single-family (D.2), while Gov. Code 66323(a)(1) requires ministerial approval of a JADU with any single-family home in a residential or mixed-use zone.
HMC 16.12.360(B)(c), (D)(2), (E)(1), (E)(3)-(5), (F)(2)(c)-(e); Gov. Code 66323(a)(1), 66333(d)HMC 16.12.360(E)(2) caps a detached ADU at 1,200 sq ft of livable floor area (garage and accessory structures excluded) "on any parcel" and an attached ADU at 50 percent of the main home's area up to 1,000 sq ft; (E)(7) guarantees an attached or detached 800 sq ft ADU with 4 ft side and rear setbacks regardless of lot coverage or nonconformity, which is what owners of homes of 1,600 sq ft or less get (E.2 still routes those homes to subsection (E)(6), a construction-standards clause, a drafting carry-over HCD flagged in 2024). No ADU may be smaller than 150 sq ft, and JADUs top out at 500 sq ft (F.2.c). Heights track the state floors in Gov. Code 66321(b)(4): 16 ft detached, 18 ft within a half mile of a major transit stop (plus 2 ft to match the main roof pitch) or beside a multistory multifamily building, and 25 ft or two stories attached (E.8). HCD's 6-19-2025 finding 5 says units built under Gov. Code 66323 carry no local size cap (a conversion is limited only to the existing space plus 150 sq ft for access, and the up-to-eight detached units on a multifamily lot have no size limit); the city disagreed in the unadopted Ord. 2025-05, so the codified 1,200 sq ft cap still reads as covering every detached unit while state law exempts 66323 units from it.
HMC 16.12.360(E)(2), (E)(6)-(8), (F)(2)(c) (Ord. No. 2024-13 and 2025-01); Gov. Code 66314(d)(4)-(5), 66321(b), 66323(a)-(b)No owner-occupancy rule applies to ADUs: Ord. No. 2024-13 (adopted 12-3-2024) deleted former subsection (D)(5), which had required the owner to live in the main home or the ADU (suspended until 1-1-2025), consistent with Gov. Code 66315. The JADU text still requires owner occupancy of one of the units in every case, through the purpose clause (F.1) and the recorded deed restriction (F.2.h(iv)), but Gov. Code 66333(b), as amended effective 1-1-2026, allows that requirement only when the JADU shares sanitation with the house. The city's April 2026 ADU/JADU application nonetheless asks the owner to certify under penalty of perjury to being "the legal owner and occupant of the primary residence," a statement Gov. Code 66315 bars as a condition for ADUs. Owner residence still matters for rental licensing, since HMC 5.72.030(A)(5) exempts ADUs that are part of an owner-occupied single-family residence from the Rental Housing Business License program.
HMC 16.12.360(F)(1), (F)(2)(h) (former (D)(5) deleted by Ord. No. 2024-13); HMC 5.72.030(A)(5); Gov. Code 66315, 66333(b)Ord. No. 2024-13 deleted the one-space ADU parking rule (former E.8), and the residential parking table (HMC 16.20.080, Table 16.20.080(A)) has no ADU row, so no space is required for any ADU anywhere in the city. HMC 16.12.360(E)(10) says garage, carport or covered spaces demolished or converted for an ADU "do not need to be replaced," matching Gov. Code 66314(d)(11). For JADUs, Ord. No. 2025-01 (adopted 5-20-2025) struck "Additional parking shall not be required" and added (F)(2)(g): a JADU may not convert an attached garage holding the house's required parking (a two-car garage for one to four bedrooms) without a replacement enclosed garage elsewhere on the lot. Gov. Code 66334(a) bars a JADU ordinance from requiring additional parking as a permit condition and 66323(a)(1) requires ministerial approval of a JADU within existing space, so the replacement rule likely yields; HCD's 2025 review covered Ord. No. 2024-13 and has not addressed it.
HMC 16.12.360(E)(10), (F)(2)(g) (Ord. No. 2025-01); HMC 16.20.080 (Table 16.20.080(A)); Gov. Code 66314(d)(11), 66323(a)(1), 66334(a)HMC 16.12.360(C)(a) makes ADU review "administrative review without notice (ministerial)" under HMC 16.12.005(A)(3), a Development Review Committee decision on adopted standards with no hearing or neighbor notice, followed by a building permit; applicants file the Planning Division's ADU/JADU Planning Approval Application. Subsection (C)(b) requires the city to act within 60 days of a complete application, and Gov. Code 66317 adds the 15-business-day completeness check and deems an application approved if it is not approved or denied within 60 days. Article X labels its uses special uses (HMC 16.12.355), but Gov. Code 66317(a)(1) requires ministerial approval notwithstanding any special use permit ordinance, and the ADU text itself says applications are considered "without discretionary review or a public hearing." The Planning Commission hears appeals of Development Review Committee decisions (HMC 16.12.055).
HMC 16.12.360(C)(a)-(b); HMC 16.12.005(A)(3), 16.12.055, 16.12.355; Gov. Code 66317(a)HMC 16.12.360(D)(7) bars renting an ADU for less than 30 consecutive days, a floor Gov. Code 66315 allows for ordinary ADUs; the JADU deed restriction carries the same 30-day wording (F.2.h(iii)), while Gov. Code 66333(g) and 66323(e) require terms longer than 30 days for JADUs and state-exempt units. Hesperia has no short-term or vacation rental ordinance (none in the code; the 9-10-2026 Development Code Update workshop proposed adding one), so the 30-day rule is the operative bar on nightly rentals of ADUs. An ADU may be rented but not sold separately except through a qualified nonprofit under (D)(8) and Gov. Code 66341; the city has not opted into Gov. Code 66342 ADU condominiums. Rented residential property needs an annual Rental Housing Business License with inspection or self-certification (HMC 5.72.050 to 5.72.120), and HMC 5.72.030(A)(5) exempts "Accessory Dwelling Units which are part of a single family residence occupied by the owner."
HMC 16.12.360(D)(7)-(8), (F)(2)(h)(iii); HMC 5.72.030(A)(5), 5.72.050, 5.72.110; Gov. Code 66315, 66323(e), 66333(g), 66341The fine print: 11 caveats that can change the picture
- Unadopted amendment: Ord. No. 2025-05 (DCA25-00003), the city's answer to HCD's 6-19-2025 findings, was recommended by the Planning Commission on 9-11-2025 (Res. PC-2025-12, 4-0) and introduced by the Council on 10-21-2025, but on 11-4-2025 the Council approved its consent ordinances "minus item 5" and continued Ord. No. 2025-05 to 11-18-2025; it never returned to a Council agenda (Legistar agendas and minutes swept through the 10-8-2026 Planning Commission agenda) and is absent from Municode's Code Comparative Table and ordinance bank. Its approve-or-deny wording, eight-detached-ADU multifamily count, new multifamily garage-parking rule (D.12), statement that 66323 units are approved ministerially (D.13) and JADU garage wording are therefore not law, and its Gov. Code 66326(b)(2)(B) findings rejecting HCD's unit-combination and size findings were never adopted.
- State-law overrides in force: the one-ADU-plus-one-JADU limit for single-family lots (16.12.360(D)(3)(a), (F)(2)(a)) yields to Gov. Code 66323(a), which since SB 543 (1-1-2026) reads "any of the following units, or any combination of the following units" (a conversion ADU, one detached new-construction ADU, which that pathway lets a city cap at 800 sq ft, and a JADU); the two-detached cap on multifamily lots (D.3.b) yields to 66323(a)(4) (up to eight beside an existing multifamily building, not exceeding its existing units; two with a proposed one), alongside conversions of non-livable multifamily space (at least one, up to 25 percent of existing units); and 66323 units escape the local 1,200 sq ft cap and other local standards (66323(b)).
- HCD status: findings letters 6-3-2022, 5-23-2024 (14 findings on Ord. No. 2022-13, answered by Ord. No. 2024-13) and 6-19-2025 (six findings on Ord. No. 2024-13: approve-or-deny wording, unit combinations, the multifamily detached count, the Building Code reference, size caps on 66323 units, JADU garage wording). HCD's index records a response to the 2025 letter, so no Gov. Code 66326(d) void appears, but the city has neither amended the ordinance nor adopted a findings resolution under 66326(b)(2), which leaves HCD free to notify the city and the Attorney General under 66326(c). No later HCD ADU letter appears on the dashboard (newest statewide row 9-23-2026). HCD's 2025 review covered Ord. No. 2024-13 only; no public record shows Ord. No. 2025-01 (adopted 5-20-2025) was sent to HCD within 60 days.
- JADU clauses that yield to state law: universal owner occupancy (F.1, F.2.h(iv)) versus Gov. Code 66333(b) (only where sanitation is shared); the 30-consecutive-day rental floor (F.2.h(iii)) versus 66333(g) (longer than 30 days); the attached-garage replacement-parking rule added by Ord. No. 2025-01 (F.2.g) versus 66334(a); and JADUs limited to agricultural or single-family zoned lots (D.2) versus 66323(a)(1) (any lot with a single-family home in a residential or mixed-use zone).
- Stale city form: the ADU/JADU Planning Approval Application (DocumentCenter 13830, 'ADU Application 2026', uploaded 4-15-2026 and linked from the city FAQ and the Applications / Fees / Handouts page) reprints most of 16.12.360 but carries pre-2024 text: a 120-day decision period (the code and Gov. Code 66317(a) say 60 days), a 36-month permit life that Ord. No. 2024-13 deleted, the old purpose clause and a JADU definition limited to existing homes, and an owner certification to being "the legal owner and occupant of the primary residence" (Gov. Code 66315). It is not curated.
- Main Street and Freeway Corridor Specific Plan: the city's posted plan (DocumentCenter 15940, July 2021 compilation, the edition the city's specific plan page links) still uses 'second dwelling unit' rules: permitted in the Low Density Residential zone only on parcels of at least 10,000 sq ft and listed as conditionally permitted otherwise, both permitted and conditionally permitted in the Mixed-Use zone, and permitted 'pursuant to the HMC' in Very Low Density Residential. Gov. Code 66317(a)(1) (ministerial approval notwithstanding special or conditional use permit ordinances) and 66321(b)(3) (no minimum lot size that blocks an 800 sq ft ADU) override those listings, and the city's 10-21-2025 staff report says 16.12.360 allows ADUs and JADUs in all single-family, multifamily and mixed-use designations; owners of specific-plan parcels should confirm with Planning. Other specific plans (Tapestry and others) set their own uses.
- Septic and manufactured homes: lots not on sewer need at least one gross acre or an approved supplemental treatment septic system (16.12.360(D)(10)), and JADUs must meet the Lahontan Regional Water Quality Control Board's minimum septic tank capacity (F.2.b); for 66323 units the city may ask for a percolation test no older than five years (ten if recertified) under Gov. Code 66323(f). A manufactured home qualifies as an ADU (16.12.360(B)(a)(ii)) but cannot get an installation permit outside a licensed manufactured home development if more than ten years old (HMC 16.20.160(C); the application repeats the limit).
- Design and drafting: ADUs must be architecturally compatible with and match the colors and materials of the main home (E.11) and meet the single-family construction standards of HMC 16.20.160 (siding, roofing, 12-inch eaves; its 1,000 sq ft minimum home size exempts second units) unless 16.12.360 says otherwise (E.6). E.2's pointer to (E)(6) for homes of 1,600 sq ft or less is a leftover from the earlier 16.20.360 citation error HCD flagged in 2024; the 800 sq ft guarantee in (E)(7) is what applies.
- Fees: HMC 17.52.010(B) still requires park land dedication or an in-lieu fee for every 'second dwelling unit' building permit, while Gov. Code 66311.5(c) bars impact fees (including 66477 park fees) on ADUs of 750 sq ft of interior livable space or less and requires proportional fees above that; development impact fees are set by council resolution (HMC 16.12.076). SB 1117 (Chapter 809, Statutes of 2026, effective 1-1-2027) amends 66311.5 so impact fees on an ADU over 750 sq ft are charged only on the area above 750 sq ft.
- AB 956 (Chapter 791, Statutes of 2026, effective 1-1-2027) amends Gov. Code 66323 to allow two detached new-construction ADUs on a single-family lot under the state-exempt pathway, with no JADU owed where two exist, and extends the Civ. Code 714.3 and 4751 CC&R anti-restriction rule to any lot zoned to allow single-family use; the local one-ADU count is already overridden.
- Pending rewrite: the city hired PlaceWorks on 4-21-2026 for a 12 to 18 month Comprehensive Development Code Update; Community Meeting #1 (9-10-2026) proposed relocating the ADU rules to the residential development standards, tightening guest-house rules so they cannot serve as ADUs, and adding short-term and vacation rental regulations, and the Planning Commission held a workshop on 10-8-2026. Re-verify when draft ADU or STR text appears, after any revival of DCA25-00003, after an HCD notice under 66326(c), at the next Municode supplement, and after 1-1-2027 for AB 956 and SB 1117.
Summarized from Hesperia's ordinance text, read October 2026; every row links the code section it came from. Rules often vary by zone and lot, so treat this as orientation, not a permit determination, and confirm with the planning department before you commit to a design.

California statewide law also applies
California sets baseline ADU rights at the state level. Where local rules are stricter than state law allows, state law usually wins, so both are worth reading.
