ADU rules in Moreno Valley
These are the primary sources for accessory dwelling unit regulations in Moreno Valley: the city's own zoning code, planning department pages, and permit guides. Start here before talking to anyone: the rules below are what your permit reviewer will apply.

Detached new-construction ADUs are permitted ministerially on lots zoned single-family, multifamily, or mixed use allowing residential that contain an existing or proposed dwelling; the city also offers free pre-approved detached ADU plans (with mapped hazard-zone exclusions).

For JADUs, an owner-occupancy covenant is required only if the JADU shares sanitation facilities with the existing structure; it cannot be required if the JADU has its own sanitation facilities or the owner is a governmental agency, land trust, or housing organization.
MVMC 9.09.130.G.5Parking may be located in rear and side setback areas, or in a paved front driveway if rear and side placement is not possible, subject to front-yard landscaping standards.
MVMC 9.09.130.F and G.10Ministerial approval by the community development director, processed with a building permit (multifamily ADUs need an administrative plot plan plus building permit, still ministerial). Approve or deny within 60 days of a completed application, deemed approved if the city misses the deadline; completeness determination within 15 business days; denials must include a full list of defects and how to fix them per Gov. Code 66317.
MVMC 9.09.130.B, C.1, C.4, C.5, C.6Subsection K cites Gov. Code 66341 for condominium conveyance, but the condominium provision verified at leginfo.legislature.ca.gov is Gov. Code 66342 (66341 is the nonprofit separate-sale provision); this reads as a citation error in the local code.
MVMC 9.09.130.G.4, J, K, LThe fine print: 9 caveats that can change the picture
- Standards depend on which pathway the applicant elects: local development standards (Gov. Code 66314 to 66322) or by-right standards (Gov. Code 66323); by-right new detached units are capped at 800 sq ft but escape lot coverage, open space, and front setback standards, and the pathways may be combined.
- Unit counts vary by lot type: single-family lots get 1 ADU plus 1 JADU under local standards or 1 conversion ADU plus 1 detached ADU plus 1 JADU by right; lots with an existing multifamily building get conversion ADUs up to 25% of existing units plus up to 8 detached ADUs (never more ADUs than existing units); a proposed multifamily building allows up to 2 detached ADUs.
- Detached ADUs on the same parcel as a multifamily structure have no maximum size (MVMC 9.09.130.D.3.c).
- Attached ADU sizing has two overlapping provisions: 850/1,000 sq ft by bedroom count in D.3.d versus 50% of the primary dwelling with a 1,000 sq ft allowance in Table E-1 note 2.
- The pre-approved detached ADU plan program requires a residential lot with an existing single-family home or duplex and excludes geo-hazard, landslide, flood, and wildland-urban interface areas (city ADU page).
- An ADU up to 800 sq ft with 4 ft side and rear setbacks may encroach into the front setback when no other unimproved location on the lot fits it (Table E-1 exception 3); detached height limit is 20 ft under both pathways.
- Lots on septic must get Riverside County environmental health verification before applying (MVMC 9.09.130.C.7); no impact fees on ADUs under 750 sq ft or JADUs.
- Pre-2020 unpermitted ADUs have a permitting amnesty path (AB 2533, MVMC 9.09.130.M), and the city must delay enforcement against qualifying substandard ADUs for five years.
- The section was amended four times between mid-2024 and April 2026 following an HCD noncompliance review, so specific numbers may continue to move; check the posted code before relying on edge cases.
