These are the primary sources for accessory dwelling unit regulations in Norwalk: the city's own zoning code, planning department pages, and permit guides. Start here before talking to anyone: the rules below are what your permit reviewer will apply.

Rules at a glance

Detached (backyard) ADU
Allowed

New detached ADUs are allowed on any lot zoned for single-family or multifamily residential use, and an ADU is a listed permitted use in the R-1, R-2, R-3, R-4 and R-H zones (§ 17.04.210(E)(1); § 17.05.010(L) and its counterparts). The local text makes the two tracks alternatives on a single-family lot: either one new attached or detached ADU under local standards plus a JADU, or the state-exempt set of one detached new-construction ADU of up to 800 sq ft plus a conversion ADU and a JADU (§ 17.04.210(D)(1)(a), (F)(1), (Y)(2)); multifamily lots may add up to eight detached ADUs (never more than the existing units) or two beside a proposed multifamily building ((F)(4)-(5)). Detached units need 4-ft side and rear setbacks and 5 ft of eave-to-eave separation and may be 16 ft tall (18 ft within one-half mile walking distance of a major transit stop or high-quality transit corridor, plus 2 ft for a roof pitch matching the home, and 18 ft beside a multistory multifamily building); on single-family lots the code also limits them to one story and bars them above a detached garage or carport ((G)(3)(c), (J), (K)). HCD's 5-20-2026 findings say state law requires the full Gov. Code 66323 allotment plus at least one local-standards unit and allows height limits only in feet, so the either-or structure and the story limits yield to state law (Gov. Code 66321(b)(4), 66323(a), 66325(a)).

Norwalk Municipal Code § 17.04.210(D)(1), (E), (F), (G)(3), (J), (K) and (Y)(2)-(3) (Ord. 25-1762, adopted 12-2-2025); §§ 17.05.010(L), 17.05.100(K), 17.05.200(K), 17.05.310(H), 17.05.400(K); Gov. Code 66321(b)(4), 66323(a), 66325(a); HCD findings letter 5-20-2026, items 2 and 7
Attached or internal ADU
Allowed

Attached additions and conversions of existing space (attached garages, storage areas or similar uses, and accessory structures) are allowed, and conversions of existing permitted structures carry no size cap (§ 17.04.210(G)(1), (H)(5)). On multifamily lots at least one ADU, and up to 25 percent of the existing unit count, may be created in non-livable space such as storage rooms, garages or basements ((Y)(3)(a)). One JADU of up to 500 sq ft may be created inside a single-family home, including an attached garage, but the code bars JADUs on lots with a multifamily dwelling or with two detached single-family dwellings ((F)(2)(b), (F)(6), (G)(2)); HCD's finding 5 says a two-home lot that did not use an urban lot split is entitled to the full Gov. Code 66323(a)(1)-(2) allotment, JADU included. Attached ADUs may be 25 ft tall or the zone height limit, whichever is lower, and the local design rules require a side or rear entrance and no exterior staircase ((K)(2), (O)(5)), which HCD says cannot be applied to JADUs. An ADU may not be attached to an existing detached accessory structure that does not meet current ADU setbacks ((G)(3)(a)), a rule HCD's finding 6 says conflicts with Gov. Code 66314(d)(7) and 66321(b)(3).

Norwalk Municipal Code § 17.04.210(B), (F)(2)(b), (F)(6), (G)(1)-(3), (H)(4)-(5), (K)(2), (O)(5), (Y)(2)(b) and (Y)(3)(a) (Ord. 25-1762); Gov. Code 66314(d)(7), 66323(a)(1), 66333; HCD findings letter 5-20-2026, items 5, 6 and 9
Maximum size
850 sq ft (studio or 1 bedroom) or 1,000 sq ft (2+ bedrooms) for local-standards ADUs, attached also capped at 50% of the home (state law still guarantees 800 sq ft); 800 sq ft for the state-exempt detached ADU; conversions of existing space uncapped; JADU 500 sq ft; 150 sq ft minimum; detached 16 ft (18 ft plus 2 ft roof pitch near major transit), attached 25 ft

Section 17.04.210(H) caps a new detached ADU at 850 sq ft for a studio or one bedroom and 1,000 sq ft for more than one bedroom, and a new attached ADU at the same figures and at 50 percent of the existing or proposed home; conversions of existing permitted structures are uncapped, JADUs are limited to 500 sq ft, and every ADU must be at least 150 sq ft. Local-standards units must also fit the zone's lot coverage and FAR ((I)), but Gov. Code 66321(b)(3) requires that percentage, coverage and FAR limits still allow an ADU of at least 800 sq ft of interior livable space with 4-ft side and rear setbacks (HCD finding 8). The state-exempt detached ADU is capped at 800 sq ft ((Y)(2)(a)(i)), the limit Gov. Code 66323(a)(2)(A) allows, while the code's 800 sq ft cap on detached ADUs beside multifamily buildings ((Y)(3)(b)(iv), (Y)(3)(c)(iv)) yields because 66323(a)(4) authorizes no size cap (HCD finding 12). The headline 850/1,000 figures equal the state floors in Gov. Code 66321(b)(2), although the code never says its caps are measured in interior livable space.

Owner occupancy
Not required

Norwalk imposes no owner-occupancy requirement on ADUs, which Gov. Code 66315 bars. The codified JADU rules still require owner occupancy for every JADU, backed by a recorded covenant, and the JADU definition bars JADUs on property owned by a corporate entity or LLC (§ 17.04.210(B), (Q)(1)). Since 1-1-2026, Gov. Code 66333(b) (as amended by SB 543 and AB 1154) allows a JADU owner-occupancy requirement only where the JADU shares sanitation facilities with the main home, and never where the owner is a government agency, land trust or housing organization; HCD's finding 11 told the city to narrow subsection Q accordingly, and the state rule controls under Gov. Code 66325(a). The September 2026 ADU checklist still asks JADU applicants for a grant deed, an electricity bill and a covenant preparation fee; a recorded JADU deed restriction on separate sale and size remains required by Gov. Code 66333(c).

Extra parking
1 off-street space per local-standards ADU (tandem on the driveway allowed) unless within 1/2 mile walk of public transit or another state exemption applies; none for JADUs, state-exempt units or ADUs inside the home or an accessory structure; lost garage or carport spaces need not be replaced

Section 17.04.210(L)(2) requires one off-street space for each ADU, which may be provided as tandem parking on a driveway, and (L)(1) requires none for a JADU; garage, carport or covered spaces demolished or converted for an ADU need not be replaced ((L)(3)). No parking applies where the ADU is within one-half mile walking distance of public transit (defined as any bus stop or train station with fixed routes and set fares), in a historic district, within the home or an accessory structure, where on-street permits are required but not offered, within one block of a car share vehicle, or filed with a new home that meets one of those tests ((L)(4)), mirroring Gov. Code 66322(a). State-exempt units are approved notwithstanding subsections (A) through (U), so the parking rule does not reach them ((Y)(1)). Read plainly, the one-space rule exceeds Gov. Code 66314(d)(10)(A) for studio ADUs (one space per unit or per bedroom, whichever is less), and an ADU must share the existing driveway unless a second one is taken from an alley ((M)(1)).

Approval process
Permitted use

ADU and JADU applications are reviewed ministerially 'in conformance with this Code and Sections 66310 to 66342' and, when filed with a new home, still without discretionary review or a hearing (§ 17.04.210(C)(1), (C)(5)); state-exempt units get a building permit ministerially ((Y)(1)). Applications go to the Planning Division with the ADU checklist and are filed through the city's online permit portal, and the 2025 Housing Element Annual Progress Report marks every 2025 ADU application as ministerial (118 ADUs permitted and 32 completed that year). The code counts the deemed-approval clock as 60 business days and lets the Community Development Director deny an application when the applicant responds slowly ((C)(3)), while Gov. Code 66317(a) requires a completeness decision within 15 business days and approval or denial within 60 days (HCD finding 1). The Director may waive design standards found infeasible ((O)(13)).

Rental restrictions
Long-term rental allowed; every ADU and JADU rental must exceed 30 consecutive days and short-term rentals are prohibited; no separate sale except through Gov. Code 66341; no rent stabilization or rental registration

Section 17.04.210(D)(2) requires every ADU and JADU rental to run longer than 30 consecutive days and prohibits short-term rentals. That matches Gov. Code 66323(e) for state-exempt units and 66333(g) for JADUs but is one day stricter than Gov. Code 66315, which lets a city require only terms of 30 days or longer for ordinary ADUs. ADUs may be rented but not sold or conveyed separately except as Gov. Code 66341 provides for qualified nonprofit sales ((D)(3)), so the city has not opted into 66342 ADU condominiums. The Municipal Code has no short-term rental permit program, rent stabilization or rental registration (eCode360 searches on 2026-10-07 found only this section and the SB 9 urban dwelling rules), and urban dwellings built under Ord. 26-1768 likewise may not be rented for less than 30 consecutive days.

Norwalk Municipal Code § 17.04.210(D)(2)-(3) (Ord. 25-1762); Ord. 26-1768, Exhibit A, § 17.05.110(L)(5) (adopted 4-7-2026, uncodified); Gov. Code 66315, 66323(e), 66333(g), 66341
The fine print: 14 caveats that can change the picture
  • HCD findings, 5-20-2026 (ADU0008452): HCD found twelve violations in Ord. 25-1762 (the 60-business-day clock, the either-or unit structure, the SB 9 two-unit and lot-split bans, the two-home lot combinations, the nonconforming accessory structure rule, the one-story and over-garage limits, the missing 800 sq ft exception to lot coverage and FAR, JADU entrance and exterior stair rules, the entrance-visibility rule, universal JADU owner occupancy, and the 800 sq ft cap on multifamily detached units) with a response due 6-19-2026. HCD's index (current to 7-14-2026) marks it 'Response received', yet no amending ordinance or Council resolution appeared on any City Council or Planning Commission agenda through the 10-6-2026 Council meeting, so the codified text governs except where the flagged clauses yield to state law (Gov. Code 66325(a)).
  • Void-ordinance exposure: Gov. Code 66316 makes a noncompliant ADU ordinance null and void, with the state standards (including the 1,200 sq ft detached cap of 66314(d)(5)) applying until a compliant ordinance is adopted, and 66326(d) voids an ordinance not submitted to HCD within 60 days of adoption; HCD's letter confirms it received Ord. 25-1762 but no public record dates the submission. The city still administers § 17.04.210 (application packet revised September 2026), and Ord. 25-1762 itself recited that the ADU code it replaced was 'currently null and void'.
  • Unit combinations: § 17.04.210(D)(1)(a) bars combining a local-standards ADU with any state-exempt unit, while Gov. Code 66323(a) requires ministerial approval of 'any combination' of the exempt units and HCD's finding 2 says the city must also allow at least one 66314 unit. From 1-1-2027, AB 956 (Ch. 791, Stats. 2026) amends 66323 to allow two detached new-construction ADUs on a single-family lot under the exempt pathway (no JADU owed where two exist) and extends the Civ. Code 714.3 and 4751 CC&R rule to any lot zoned for single-family use, so the local count of one exempt detached unit ((F)(1)(b)(i), (Y)(2)(a)) yields from that date.
  • SB 9: § 17.04.210(D)(1)(b)-(c) bars ADUs on lots with a Gov. Code 65852.21 two-unit project or an urban lot split, and Ord. 26-1768 (ZTA 2026-01, adopted 4-7-2026, effective about 5-7-2026, still uncodified; new § 16.02.500 and § 17.05.110(L)(3) Urban Dwellings) bars an urban dwelling on a lot with an ADU or JADU and any ADU or JADU after an urban dwelling is built. HCD's findings 3 and 4 say ADU law still applies to two-unit projects that do not also split the lot (Gov. Code 65852.21(f)) and that an ADU or JADU may be the second unit on a split lot (66411.7(j)).
  • Height and stories: § 17.04.210(G)(3)(c), (K)(3) and (K)(4) limit detached ADUs on single-family lots to one story and bar ADUs above a detached garage or carport; HCD's finding 7 says state law allows height limits only in feet (Gov. Code 66321(b)(4)). The code also caps plate height at 8 ft per story ((K)(5)) and steps second stories back an extra 5 ft from the front, interior side and street side ((J)(2)).
  • State-exempt unit standards: besides the multifamily 800 sq ft cap HCD flagged, § 17.04.210(Y)(2)(b)(v) caps an exempt ADU created inside the home or an accessory structure at 800 sq ft or 50 percent of the home, whichever is less; Gov. Code 66323(a)(1) sets no size cap for units within existing or proposed space and 66323(b) bars standards the section does not authorize (not flagged by HCD).
  • Design: subsections (O)(5) (side or rear entrance and no exterior staircase for attached ADUs and JADUs) and (O)(6) (a detached ADU's entrance may not face or be visible from the public right-of-way) were flagged by HCD as findings 9 and 10 (no design standards on JADUs under Gov. Code 66323(b), staircase limits only 'where feasible', visibility is not objective); the other local-track design rules (matching materials and roof pitch, enclosed stairs, no upper balconies, window placement) apply only to non-exempt units and the Director may waive them ((O)(13)).
  • Zones: § 17.04.210(E)(3) bars ADUs and JADUs on lots in the Commercial and Manufacturing zones, yet Table 17-A (§ 17.11.010) permits multifamily housing in conjunction with commercial or office development in C-1 and C-3 (conditionally in C and O and P/O) and § 17.04.505(B) allows mixed-use developments in those zones; Gov. Code 66314 (areas zoned to allow multifamily residential use) and 66323(a) (residential or mixed-use zones) may require ADUs on such lots. HCD did not flag this.
  • R-H horse-property zone: § 17.04.210(G)(3)(d) subjects ADUs in the R-H zone to § 17.05.350(E), a subsection the codified section no longer contains after Ord. 25-1762 restated (B) and deleted (C); § 17.05.350(D) bars habitable buildings within 90 ft (lots over 150 ft deep) or 20 ft of the Los Angeles Flood Control Channel.
  • Parking details: § 17.04.210(L)(3) waives replacement of garage, carport and covered spaces but not the uncovered spaces Gov. Code 66314(d)(11) also protects, the (L)(4)(f) new-home exemption cross-references only items (a) through (d), and the September 2026 checklist still asks conversion and multifamily applicants for an off-street parking replacement plan.
  • Fees: § 17.04.210(W)(1) charges impact fees on ADUs '750 square feet or larger', while Gov. Code 66311.5(c)(1) bars impact fees on an ADU of 750 sq ft of interior livable space or less (a conflict at exactly 750 sq ft). From 1-1-2027, SB 1117 (Ch. 809, Stats. 2026) amends 66311.5 so fees on an ADU over 750 sq ft attach only to the area above 750 sq ft, replacing the proportional formula in (W)(1).
  • Accessory living quarters: § 17.04.210(F)(1)(c) lets a lot with only one dwelling have either an ADU or an accessory living quarter (cabana, pool house, recreation room, workshop or similar R-occupancy building) but not both; the quarter may be converted into an ADU, and a JADU remains possible.
  • City materials: the ADU page's 'ADU Guidebook' link now points to an error page (the 2025 'NORWALK ADU GUIDE.pdf' returns 404), and the 2026 ADU Application Packet (application revised 03/2026, checklist revised 09/2026) still treats state-exempt and local units as alternative tracks (it lists a 66314 detached unit as 801-1,000 sq ft) and collects JADU owner-occupancy documents.
  • Re-check by 2026-12-15: PrimeGov Planning Commission and City Council agendas (starting with the 10-14-2026 Planning Commission) for the zoning text amendment answering HCD's 5-20-2026 findings, eCode360 New Laws for its ordinance, and the § 17.04.210 history line; then re-read unit combinations, story limits, JADU owner occupancy and the multifamily size cap.

Summarized from Norwalk's ordinance text, read October 2026; every row links the code section it came from. Rules often vary by zone and lot, so treat this as orientation, not a permit determination, and confirm with the planning department before you commit to a design.

California sets baseline ADU rights at the state level. Where local rules are stricter than state law allows, state law usually wins, so both are worth reading.
