ADU rules in Oceanside

5 sources

These are the primary sources for accessory dwelling unit regulations in Oceanside: the city's own zoning code, planning department pages, and permit guides. Start here before talking to anyone: the rules below are what your permit reviewer will apply.

Rules at a glance

Detached (backyard) ADU
Allowed

Detached ADUs are allowed on any lot zoned for single-family or multifamily use that has an existing or proposed dwelling. Oceanside currently processes every ADU under state law alone: its ADU page (fetched 2026-09-28) says the city 'does not currently have a compliant Accessory Dwelling Unit (ADU) ordinance', that information based on Zoning Ordinance Article 30, Section 3006 is 'no longer applicable', and that 'State ADU Law would apply to all ADU applications', the result Gov. Code 66316 and 66326(d) prescribe for a noncompliant ordinance. Under that law a unit detached from the home on the same lot is allowed (66314(d)(3)), and on a single-family lot the city must ministerially approve one detached new-construction ADU with 4-foot side and rear setbacks in addition to a conversion ADU and a JADU (66323(a)(1) and (a)(2)). A lot with an existing multifamily building may add up to eight detached ADUs, never more than the number of existing units, and a lot with a proposed multifamily building up to two (66323(a)(4)). Coastal-zone lots also need a coastal development permit (see permit type), and lots created by an SB 9 urban lot split may not add ADUs.

Attached or internal ADU
Allowed

Attached ADUs (additions sharing a wall with the home), units created inside the home or an attached garage, conversions of accessory structures, and JADUs are all allowed under the same state-law regime. Gov. Code 66314(d)(3) covers units attached to or located within the proposed or existing primary dwelling, including attached garages and storage areas, and 66323(a)(1) requires ministerial approval of one conversion ADU within the space of a single-family home or an existing accessory structure (an accessory structure may grow by up to 150 sq ft for ingress and egress) plus one JADU of up to 500 sq ft built within the walls of the single-family home (66333(d); HCD's June 17, 2026 Finding 5 notes a JADU may not go in a detached accessory structure). In existing multifamily buildings, ADUs may be created in non-livable space such as storage rooms, garages and attics: at least one, and up to 25 percent of the existing units (66323(a)(3)). The inapplicable 2026 text barred converting the livable space of multifamily units (Section 3006.B.5.d), which HCD's Finding 7 said conflicts with 66314.

Gov. Code §§ 66313(d), 66314(d)(3), 66323(a)(1), (a)(3), 66333(d); HCD findings to Oceanside, June 17, 2026 (Findings 5, 7)
Maximum size
1,200 sq ft detached; attached up to 50% of the existing home but at least 800 sq ft; 800 sq ft state-exempt detached unit; conversions not size-capped; JADU 500 sq ft

With no compliant local ordinance, the state figures apply as HCD's March 2026 ADU Handbook reads them (the city's ADU page names that handbook as the source of the applicable standards and hosts a copy): for an agency without a compliant ordinance, 1,200 sq ft of interior livable space for a new detached ADU and up to 50 percent of the existing home for an attached ADU, but at least 800 sq ft (Gov. Code 66314(d)(4) and (d)(5), 66321(b)(3)). The state-exempt detached unit on a single-family lot may be held to 800 sq ft of livable space (66323(a)(2)(A)), conversions of existing space are limited only by that space (plus up to 150 sq ft of accessory-structure expansion for ingress and egress), detached units beside a multifamily building under 66323(a)(4) carry no floor-area cap (66323(b)), and a JADU may not exceed 500 sq ft of interior livable space (66313(d)); since SB 543 (January 1, 2026) sizes are measured as interior livable space. The inapplicable Section 3006.D.1 as adopted March 25, 2026 set a 150 sq ft minimum, a 1,200 sq ft detached cap and a 50 percent attached cap with an 850 or 1,000 sq ft 'Statewide Exemption ADU' floor, which HCD's Finding 12 faulted. Height: HCD's handbook says State ADU Law itself sets no height limit and an agency may impose one only through a compliant ordinance, so the void ordinance's 16, 18 and 25-foot figures do not bind; any future ordinance must allow at least those heights (66321(b)(4)).

Owner occupancy
Not required

No owner-occupancy requirement applies to an ADU: Gov. Code 66315 bars any standard beyond 66314, 'including an owner-occupant requirement', and HCD's handbook adds that only an ADU sold to a qualified buyer under 66341 may carry one. JADUs are the exception: under 66333(b), as amended by AB 1154 effective January 1, 2026, the owner must live in the main home or the JADU only when the JADU shares sanitation facilities with the main home (not when it has its own bathroom, or when the owner is a governmental agency, land trust or housing organization), and a deed restriction barring separate sale and fixing the JADU's size and attributes must be recorded (66333(c)). Oceanside's inapplicable Section 3006 also required a recorded covenant for every ADU (3006.E.5), which HCD's June 17, 2026 Finding 25 called a prohibited additional standard, and its JADU owner-occupancy wording drew HCD's Finding 1; the city's 2020 covenant forms are no longer posted on its ADU page.

Extra parking
At most 1 space per ADU or per bedroom, whichever is less (state cap; none for studios); none within 1/2 mile walking distance of transit, for units within the home or an accessory structure, for state-exempt units or JADUs; lost garage spaces need no replacement

Oceanside has no enforceable local ADU parking rule: the only one was Section 3006.D.5.a ('One additional off-street parking space shall be required per unit'), which the city's ADU page now treats as inapplicable, and the Article 31 parking schedule has no ADU row. State law caps any ADU parking requirement at one space per unit or per bedroom, whichever is less, allowed as tandem parking on a driveway (66314(d)(10)), so a studio needs none (HCD's June 17, 2026 Finding 22), and bars any parking standard within one-half mile walking distance of public transit (a bus stop counts, 66313(m)), in an architecturally and historically significant historic district, for a unit within the proposed or existing home or an accessory structure, where on-street permits are required but not offered to the ADU occupant, within one block of a car-share vehicle, or when the ADU is permitted with a new home on a qualifying parcel (66322(a)). HCD's handbook adds that no parking may be required for 66323 state-exempt units, JADUs need none (66334(a)), and garage, carport or uncovered spaces demolished or converted for an ADU need not be replaced (66314(d)(11)). No city page says whether staff now asks for the one space on a non-exempt ADU, so the value states the state ceiling.

Approval process
Permitted use

ADUs and JADUs are approved ministerially through a building permit with no hearing: Gov. Code 66320 requires an agency without a compliant ordinance to approve or disapprove ADU applications ministerially under 66317, which sets a 15-business-day completeness determination, approval or denial within 60 days of a complete application (deemed approved if the city misses it), written reasons on a denial, and an appeal decided within 60 business days (66317(a), (b), (d); 66335 mirrors this for JADUs). The Building Division's pre-approved ADU page routes applicants through its online building permit application, and pre-reviewed detached ADU plans are approved within 30 days under AB 1332, though the city's pre-approved plan library listed no plans on 2026-09-28. In the coastal zone a coastal development permit under the certified Local Coastal Program is also needed, but it must be decided within 60 days concurrently with the building permit, without a public hearing, and the decision cannot be appealed to the Coastal Commission (66329(a), (c), as amended by AB 462 effective October 10, 2025); the certified Section 3006.C.4 likewise subjects coastal ADUs to the LCP 'except for that no public hearing shall be required'.

Rental restrictions
Long-term rental (31+ days) allowed; no short-term rentals at any property with an ADU or JADU permitted on or after 9-9-2017 (main home included); new non-hosted STRs banned in residential zones outside the coastal zone; no separate sale (no condo opt-in)

An ADU may be rented separately from the main home but not sold or conveyed separately (Gov. Code 66314(d)(1)), apart from the 66341 qualified-nonprofit path; Oceanside has adopted no 66342 condominium ordinance (HCD's Finding 24 invited one). The city's short-term rental page and STR FAQ (PDF created June 30, 2026) say that if an ADU or JADU 'was permitted on or after September 9, 2017 neither the ADU, JADU, nor the primary residence can be used as a STR', citing Zoning Ordinance 3006(E)(3) ('Neither the ADU/JADU nor the primary dwelling unit shall be rented for a term of less than 31 days'), a rule the Coastal Commission's 2018 staff report supported when Section 3006 entered the LCP; planning staff screen this when an owner applies for the transient occupancy tax certificate that precedes an STR permit. State law independently requires rentals of 66323 state-exempt units and of JADUs to run longer than 30 days (66323(e), 66333(g)) and lets a city require terms of 30 days or longer for other ADUs (66315). City Code Chapter 24 separately bans new non-hosted STRs in every residential zone outside the coastal zone (Sec. 24.6(c), since February 10, 2024), requires an annual STR permit, a two-night minimum and occupancy caps, and will cap non-hosted STRs west of Coast Highway at 480 once LCPA24-00001 is certified.

The fine print: 10 caveats that can change the picture
  • Regime: Oceanside applies state ADU law alone. Its ADU page (fetched 2026-09-28 with a full browser header set) says the city 'does not currently have a compliant' ADU ordinance, that information based on Zoning Ordinance Section 3006 is 'no longer applicable', and that the HCD ADU Handbook sets out the applicable standards; the last Wayback capture (2026-04-08) still described the 2022 ordinance, so the notice went up between April 8 and September 28, 2026. No repeal, amendment or HCD-response resolution appears in the council's Legistar record from March 25 through the September 16, 2026 meeting, so the switch is documented only by the web notice; values follow Gov. Code 66310 through 66342 as HCD's March 2026 handbook reads them.
  • Local text still on the books: Section 3006 as rewritten by Ord. No. 26-OR0104-1 (ZA25-00004; introduced March 11 and adopted March 25, 2026, both 5-0; effective April 24, 2026 outside the coastal zone and in the coastal zone only upon Coastal Commission certification of LCPA25-00002) opens by saying state law controls in any conflict, and the city's own Article 30 PDF (posted June 13, 2024) still prints the 2022 version (Ord. No. 22-OR0114-1). Both versions carry rules stricter than state law (one parking space per unit, a 50 percent attached cap, front-yard setback rules, a uniform 4-foot staircase setback, a one-foot eave projection limit, a recorded covenant for every ADU); do not rely on them unless the city adopts a compliant ordinance.
  • HCD enforcement: findings of May 20, 2025 on Ord. No. 22-OR0114-1 (11 findings, response due June 19, 2025, none recorded in HCD's index); a technical assistance letter of February 27, 2026 (index: response received, copy only by Public Records Act request); and findings of June 17, 2026 on Ord. No. 26-OR0104-1 (26 findings, response due July 17, 2026). HCD's index is current only to July 14, 2026, so it cannot show whether the city answered the June letter; under Gov. Code 66326(d) an ordinance whose findings go unanswered for 30 days is null and void, and 66316 voids any noncompliant ordinance, either of which supports the city's notice.
  • Coastal zone: Oceanside's LCP was certified in 1985, and Section 3006 entered its implementation plan through LCP-6-OCN-18-0055-1 (Commission staff recommended certification with two modifications in September 2018: coastal ADUs follow the LCP except that no public hearing is required, and garage conversions and ADUs above garages must respect habitat preserve buffers and geologic stability setbacks, now 3006.C.4 and 3006.D.3.i). The 2022 rewrite was never certified (March 11, 2026 staff report), and no Commission action on the 2026 amendment (LCPA25-00002) was found. Coastal ADUs need a coastal development permit decided within 60 days, without a hearing and without appeal to the Commission (Gov. Code 66329(a), (c)); the city has not said how it reconciles the certified Section 3006 text with state standards on coastal lots, so confirm with Planning. Coastal status can be checked on the city's Land Use and Zoning GIS map.
  • Short-term rental tension: the STR program still enforces Zoning Ordinance 3006(E)(3) against properties with an ADU or JADU permitted on or after September 9, 2017, although the ADU page says Section 3006 information no longer applies. For state-exempt 66323 units and JADUs the over-30-day term is state law regardless (66323(e), 66333(g)); for other ADUs it rests on the local text, which Gov. Code 66315 authorizes. Coastal-zone STRs (outside ADU properties) remain allowed pending certification of LCPA24-00001, which would cap non-hosted permits west of Coast Highway at 480 and bar new non-hosted STRs in the R-1 zone.
  • SB 9 lots: the city's SB 9 page bars ADUs and JADUs on lots created by an urban lot split (Gov. Code 65852.21(f) and 66411.7(j), both amended by SB 1426, Stats. 2026, ch. 56, effective June 30, 2026, without changing those clauses); on an unsplit lot each SB 9 unit may have one ADU or JADU, up to four units in all, and units created under SB 9 must be rented for terms longer than 30 days (65852.21(e)).
  • Fees: the inapplicable Section 3006.D.6.a waived all city impact fees on ADUs and JADUs; City Code Sec. 32D.4(b) exempts ADUs under 750 sq ft from the parks impact fee, and Gov. Code 66311.5(c) bars impact fees on ADUs of 750 sq ft or less of interior livable space and requires proportional fees above that. Whether the city still waives fees on larger ADUs is not stated. SB 1117 (Chapter 809, Statutes of 2026, signed September 29, 2026) charges fees only on the area above 750 sq ft from January 1, 2027.
  • 2026 state law: SB 1117 (Chapter 809, Statutes of 2026) and AB 956 (Chapter 791, Statutes of 2026) were signed on September 29, 2026 and take effect January 1, 2027. From that date AB 956 amends Gov. Code 66323 so the state-exempt pathway allows two detached new-construction ADUs on a single-family lot, with no JADU owed where two exist, and extends the Civ. Code 714.3 and 4751 CC&R anti-restriction rule to any lot zoned to allow single-family use; SB 1117 amends Gov. Code 66311.5 so impact fees on an ADU over 750 sq ft are charged only on the area above 750 sq ft. Because Oceanside applies state law directly, both changes apply here on that date without local action.
  • Unpermitted units: Gov. Code 66311.7 bars denying a permit for an unpermitted ADU or JADU built before January 1, 2020 unless correcting a violation is necessary under Health and Safety Code 17920.3.
  • Re-verification: re-check after the city adopts a compliant ADU ordinance or answers HCD (the Planning Commission's 2026 workplan lists an ADU update hearing), when LCPA25-00002 reaches the Coastal Commission, and whenever the ADU page wording changes; the next ordinance may reinstate local size, height, parking and rental rules.

Summarized from Oceanside's ordinance text, read September 2026; every row links the code section it came from. Rules often vary by zone and lot, so treat this as orientation, not a permit determination, and confirm with the planning department before you commit to a design.

California statewide law also applies

California sets baseline ADU rights at the state level. Where local rules are stricter than state law allows, state law usually wins, so both are worth reading.
