Rules at a glance

Detached (backyard) ADU
Allowed

A detached ADU is a principal permitted use (P) in every residential district (RL, RLM, RM and RH in Table 9.03.2), in the Mixed-Use district and in the Workforce Housing Overlay, and Sec. 9.04.190(d)(1) allows ADUs on any lot zoned for single-family or multifamily use that holds a proposed or legally developed dwelling. A single-family lot may carry one detached new-construction ADU in addition to one attached or converted ADU and one JADU; a lot with an existing multifamily building may add up to eight detached ADUs (never more than its existing unit count), and a lot with a proposed multifamily building up to two. Ord. No. 25-03 (adopted 10-8-2025) restated the section and added ADUs to the RH column of the use table.

RSMMC Sec. 9.04.190(d)(1), (e)(2)(b), (e)(3) (Ord. No. 25-03, 10-8-2025); Sec. 9.03.070 Table 9.03.2; Sec. 9.03.150 Table 9.03.16; Sec. 9.03.160 Table 9.03.18; Gov. Code 66323(a)(2), (a)(4)
Attached or internal ADU
Allowed

Attached ADUs (additions) and converted ADUs inside the home, an attached garage or an accessory structure are allowed by right on the same lots, one attached or converted ADU plus one JADU per single-family lot, and on existing multifamily buildings at least one and up to 25 percent of the existing unit count in non-livable space such as storage rooms, attics, basements or garages. An attached or converted ADU needs independent exterior access. JADUs (150 to 500 sq ft) must sit within the walls of a proposed or existing single-family home, an attached garage included, on a lot zoned for single-family use.

RSMMC Sec. 9.04.190(d)(2), (e)(2)(a), (e)(3)(a)(i) and (b)(i), (e)(8), (f)(1)-(2); Gov. Code 66323(a)(1), (a)(3)
Maximum size
Detached 1,200 sq ft; attached 1,200 sq ft or 50% of the primary dwelling, whichever is less, never below 800 sq ft; conversions uncapped; JADU 500 sq ft; detached height 16 ft (18 ft near major transit or beside a multistory multifamily building, plus 2 ft for roof pitch)

Sec. 9.04.190(e)(4) caps a detached ADU at 1,200 sq ft of total floor area and an attached ADU at the lesser of 1,200 sq ft or 50 percent of the existing primary dwelling, but never so low that an 800 sq ft unit is barred; converted ADUs that add no floor area are uncapped, and an accessory-structure conversion may add up to 150 sq ft for ingress and egress. The minimum is 150 sq ft, and JADUs run 150 to 500 sq ft. A detached unit may be 16 ft tall, 18 ft within one-half mile walking distance of a major transit stop or high-quality transit corridor (plus 2 ft to match the main roof pitch) or on a lot with a multistory multifamily building; an attached unit may reach the zone height or 25 ft, whichever is lower, and two stories. Lot coverage, floor area ratio, open space, front setback and minimum lot size standards are waived where they would block an 800 sq ft unit (e)(5), and state-exempt detached ADUs on multifamily lots are not held to the 1,200 sq ft cap (h)(6).

RSMMC Sec. 9.04.190(e)(4)-(5), (f)(2), (h)(6); Sec. 9.01.120 (floor area, gross); Gov. Code 66314(d)(4)-(5), 66321(b)(2)-(4), 66323(a)(2), (a)(4)
Owner occupancy
Not required

Sec. 9.04.190(g)(3)(a) states that owner occupancy of either the primary dwelling or the ADU is not required, consistent with Gov. Code 66315. For JADUs the code still requires the owner to live in the JADU or the main home in every case, through (g)(3)(b) and the deed restriction in (f)(9)(c); since 1-1-2026 Gov. Code 66333(b) allows that condition only where the JADU shares sanitation facilities with the main home and bars it where the JADU has its own bathroom, so the local clause yields for separate-bath JADUs. The recorded JADU deed restriction (one JADU, no separate sale, size and attributes) remains required before the building permit issues.

RSMMC Sec. 9.04.190(f)(9), (g)(3); Gov. Code 66315; Gov. Code 66333(b) (amended by Stats. 2025, ch. 507 (AB 1154), effective 1-1-2026)
Extra parking
1 space for a new attached or detached ADU unless exempt; none for state-exempt (Gov. Code 66323) units, conversions, JADUs, ADUs filed with a new dwelling, or within 1/2 mile of transit

Sec. 9.04.190(e)(7) requires one off-street space for an attached or detached ADU, which may sit in a setback area or as tandem parking on a driveway, and garage, carport or uncovered spaces removed for an ADU need not be replaced. No space is required within one-half mile walking distance of public transit, in a historic district, for converted ADUs, where on-street permits are required but not offered, within one block of a car-share station, or when the ADU is filed together with a new single-family or multifamily dwelling; (h)(6) excuses state-exempt ADUs under Gov. Code 66323 from (e)(7), and (f)(6) adds no parking for JADUs. The code does not say whether a single-family detached unit larger than 800 sq ft still counts as the state-exempt 66323(a)(2) unit (66323(a)(2)(A) lets a city cap that unit at 800 sq ft of livable space; the city's text neither imposes nor waives the cap), and Gov. Code 66314(d)(10)(A) limits parking to one space per unit or per bedroom, whichever is less, which on a plain reading the one-space rule exceeds for a studio.

RSMMC Sec. 9.04.190(e)(7), (f)(6), (h)(6); Gov. Code 66314(d)(10)-(11), 66322(a)(1)-(6), 66323(a)(2), 66334(a)
Approval process
Permitted use

An ADU or JADU needs the city's ADU application (Planning Division form and fee) and a building permit; the Development Services Director approves or disapproves a complete application ministerially, without discretionary review or a public hearing, within the time state law allows (Gov. Code 66317: a 15-business-day completeness determination and 60 days to act), and Table 9.08.1 lists ADUs as a Planning Director decision with no hearing. Review is limited to compliance with Sec. 9.04.190, nonconforming zoning conditions need not be corrected, a detached-garage demolition permit is issued with the ADU permit, and state-exempt units under Gov. Code 66323 are approved ministerially without the local standards that state law displaces.

RSMMC Sec. 9.04.190(h)(1)-(6); Sec. 9.08.030 Table 9.08.1; Gov. Code 66317, 66323
Rental restrictions
Long-term rental allowed; ADU rentals must run longer than 30 days (31-day minimum) and JADUs likewise under Gov. Code 66333(g); no STR program (the city counts among Orange County's STR-ban cities); no separate sale except under Gov. Code 66341

Sec. 9.04.190(g)(2) requires any rented ADU to be let for a term longer than 30 days and prohibits short-term rental of 30 days or less, and (g)(1) lets an ADU or JADU be rented separately but never sold or conveyed apart from the primary residence except under Gov. Code 66341. Ord. No. 25-03 deleted the old JADU short-term-rental bar after HCD's 10-11-2024 finding that state law then set no JADU rental minimum, but Gov. Code 66333(g) (effective 1-1-2026) now requires JADU rentals to run longer than 30 days, as 66323(e) does for state-exempt ADUs; for ordinary ADUs Gov. Code 66315 lets a city require terms of 30 days or longer, so the local rule is one day stricter than that floor. The municipal code has no short-term rental chapter or permit and treats any use not listed in a zone as prohibited (Sec. 9.03.050); the 2024-2025 Orange County Grand Jury report lists Rancho Santa Margarita among the 19 Orange County cities that ban STRs, and the city's 8-14-2025 response agreed with the findings directed at those cities.

The fine print: 9 caveats that can change the picture
  • Operative text: RSMMC Sec. 9.04.190 as amended and restated by Ord. No. 25-03 (ZCA 25-001; Planning Commission recommendation 8-6-2025 after a continuance from 7-2-2025, Council introduction 9-10-2025 and adoption on consent 10-8-2025, both 4-0; effective about 11-7-2025), codified in Municode Supplement 39 (codified through Ord. No. 25-06 of 10-8-2025, online 2-23-2026) and matching the adopted ordinance. No ordinance of any kind was introduced or adopted at a 2026 Council or Planning Commission meeting through the 9-9-2026 Council meeting (the 10-14-2026 agenda was not yet posted on 10-7-2026).
  • HCD: findings letters of 8-10-2022 (on Ord. No. 21-02) and 10-11-2024 (six findings on Ord. No. 23-01: legacy statute citations, unit combinations, an 800 sq ft cap whenever a JADU exists, the missing 66322(a)(6) parking exemption, a JADU rental minimum and JADU garage replacement parking) are both marked response received, and Ord. No. 25-03 was the city's answer. Its Section 8 directed submission to HCD within 60 days, but no public record confirms the submission and HCD has issued no letter on Ord. No. 25-03 (Excel index current to 7-14-2026; dashboard newest row 10-5-2026). Gov. Code 66326(d), which voids an ordinance not submitted within 60 days, took effect 1-1-2026, after that 60-day window closed.
  • State law already overrides parts of the codified text that predate the 1-1-2026 amendments: the universal JADU owner-occupancy clause ((f)(9)(c), (g)(3)(b)) yields to Gov. Code 66333(b) for JADUs with their own bathroom; the local JADU rules omit the longer-than-30-days rental term that 66333(g) now requires; and the code states size limits in total floor area (the zoning code measures gross floor area from exterior wall faces) while Gov. Code 66321(b)(2)-(3) sets the 850/1,000 sq ft floors and the 800 sq ft guarantee in interior livable space, which matters mainly for the 800 sq ft floor on attached units.
  • Fees: Sec. 9.04.190(j)(1) waives impact fees only for an ADU under 750 sq ft and charges proportional fees from 750 sq ft, while Gov. Code 66311.5(c)(1) exempts an ADU of 750 sq ft of interior livable space or less and a JADU of 500 sq ft or less, so a unit of exactly 750 sq ft is fee-exempt under state law. The city collects the TCA Foothill/Eastern and County of Orange road fee programs, and the ADU application lists those road fees as a pre-permit payment without mentioning the state exemption.
  • Chaptered 2026 law, effective 1-1-2027: SB 1117 (Stats. 2026, ch. 809) amends Gov. Code 66311.5 so impact fees on an ADU over 750 sq ft attach only to the area above 750 sq ft, replacing the proportional formula in (j)(1); AB 956 (Stats. 2026, ch. 791) amends 66323 to allow two detached new-construction ADUs on a single-family lot under the state-exempt pathway (no JADU owed where two exist), overriding the one-detached-unit count in (e)(3)(a)(ii), and extends the Civ. Code 714.3 and 4751 CC&R anti-restriction rule to any lot zoned to allow single-family use. Re-read the count and fee notes after 1-1-2027.
  • State-exempt (Gov. Code 66323) units skip the local parking, front and side/rear setback and multifamily detached size rules under (h)(6), but the code does not say whether a single-family detached unit over 800 sq ft still counts as the 66323(a)(2) unit; ask the Planning Division which track a detached unit falls under before relying on the parking exemption.
  • JADU parking: (f)(6) reads 'No additional off-street parking is required for a JADU beyond that required at the time the existing primary dwelling was constructed'; the 9-10-2025 staff report says the rewrite clarifies that no off-street parking is required when an attached garage becomes a JADU, consistent with Gov. Code 66334(a), which bars any additional parking as a condition of a JADU permit, so the clause should not be read to demand replacement of the main home's garage spaces.
  • City ADU application (Revised Sept. 2020, still the form on the Forms and Policies page): it recommends, but does not require, homeowner association approval before submittal, and it asks for the recorded JADU deed restriction before final inspection while (f)(9) requires recording before the building permit issues. CC&R limits on ADUs are a private matter between the owner and the association, subject to the Civ. Code 4751 anti-restriction rule.
  • Lots in a specific plan or planned unit development also follow that plan's standards to the extent state law allows (Sec. 9.04.190(e)(5)); Local-track ADUs must also meet the accessory-structure material rules of Sec. 9.04.020(c)(2) (no metal siding, exposed metal supports, cloth, canvas, plastic sheeting or corrugated materials). The municipal code contains no coastal-zone or historic-district overlay.

California sets baseline ADU rights at the state level. Where local rules are stricter than state law allows, state law usually wins, so both are worth reading.
