ADU rules in Riverside County
These are the primary sources for accessory dwelling unit regulations in Riverside County: the county's own zoning code, planning department pages, and permit guides. Start here before talking to anyone: the rules below are what your permit reviewer will apply.
Unincorporated areas only
County zoning applies only outside city limits. If your property is inside a city or town, that municipality's own ADU ordinance governs instead, even though it sits within Riverside County.

Detached ADUs are permitted by right in unincorporated Riverside County on any lot zoned for single-family use, or in any zoning classification that permits a one-family dwelling, that holds or will hold a single-family home, and on multifamily lots (Ord. 348 § 19.802.A, as rewritten by Ord. 348.5056, in effect since October 15, 2026). A single-family lot may carry one new attached or detached ADU plus a conversion ADU, and units may be combined in any quantity state law allows, such as one detached ADU, one conversion ADU and one JADU (19.802.D.1). A lot with an existing multifamily building may add up to eight detached ADUs (never more than its existing unit count) and a lot with a proposed one up to two (19.802.D.2.a, tracking Gov. Code 66323(a)(4)). A detached ADU may be a manufactured home, and the old code's bars on lots with unpermitted dwellings or constrained water or sewer service are gone.
Ord. 348 §§ 19.801.A.1, 19.802.A, 19.802.D (Ord. 348.5056 § 1, adopted 9-15-2026, effective 10-15-2026); Gov. Code §§ 66314, 66323(a)Attached ADUs (one per single-family lot, with its own exterior entrance; interior access to the main home is allowed) and conversion ADUs within the existing or proposed space of a home or accessory structure are permitted (Ord. 348 §§ 19.802.D.1, 19.802.J). A conversion ADU may add up to 150 sq ft beyond the existing structure for access (19.802.E.3.c). On multifamily lots, conversion ADUs may be built in non-livable space such as storage rooms, attics, basements or garages, up to 25 percent of the existing units and never fewer than one (19.802.D.2.b). A JADU of up to 500 sq ft of interior livable space fits entirely inside a single-family home (an attached garage counts as part of the home), one per lot, and is not allowed on multifamily lots (19.803.A, D).
Ord. 348 §§ 19.802.D, 19.802.E.3.c, 19.802.J, 19.803.A, 19.803.D (Ord. 348.5056 § 1); Gov. Code §§ 66323(a)(1)-(3), 66333"A detached ADU established on a lot containing an existing or proposed single-family dwelling shall be not exceed one thousand six hundred (1,600) square feet of floor area," and an attached ADU "shall not exceed 50 percent (50%) of the floor area of the existing primary dwelling or one thousand six hundred (1,600) square feet of floor area, whichever is less," though the 50 percent rule never blocks an attached ADU of at least 1,000 sq ft (Ord. 348 § 19.802.E.3). Detached ADUs on multifamily lots follow Gov. Code 66323(a)(4) with no county size cap, every ADU must be at least 150 sq ft, and a JADU is 150 to 500 sq ft of interior livable space (19.802.E.2, 19.803.E). Detached ADUs may be 16 feet tall, or 18 feet on a lot with a multistory multifamily building or within half a mile walking distance of a major transit stop (plus 2 feet to match the main roof pitch); attached ADUs may be 25 feet or the zone height, whichever is less, and no more than two stories (19.802.F). The state-exempt pathway still guarantees an 800 sq ft detached unit with 4-foot side and rear setbacks regardless of these caps (Gov. Code 66323(a)(2)).
Ord. 348 §§ 19.802.E, 19.802.F, 19.803.E (Ord. 348.5056 § 1); Gov. Code §§ 66321(b), 66323(a)"Property owners shall not be required to occupy, or reside within, either the primary dwelling or ADU located on the same lot" (Ord. 348 § 19.802.B, effective October 15, 2026), matching Gov. Code 66315; the 2020 code's owner-occupancy rule for ADUs permitted after June 1, 2025 is repealed. JADUs are the exception: where a JADU shares sanitation facilities with the main home, the owner must live in the home or the JADU as a principal residence unless state law exempts the owner (19.803.B.1; Gov. Code 66333(b)), and a deed restriction barring separate sale of the JADU is recorded before final building permit (19.803.C.2). The county's second units no longer require owner occupancy either (19.805.B.1).
Ord. 348 §§ 19.802.B, 19.803.B-C, 19.805.B.1 (Ord. 348.5056 § 1); Gov. Code §§ 66315, 66333(b)The county requires "One (1) parking space per ADU or per bedroom within the ADU, whichever is less," which may be tandem on an existing driveway or in a side or rear setback (Ord. 348 § 19.802.I.1-2). No parking or replacement parking is required for an ADU within half a mile walking distance of public transit, in an architecturally and historically significant historic district, within a proposed or existing primary residence or accessory structure, where on-street parking permits are required but not offered to the occupant, or applied for together with a new home when another exemption applies, and a garage, carport or space demolished or converted for an ADU need not be replaced (19.802.I.3). JADUs need no parking (19.803.H). The ordinance omits the state's car-share exemption, which still applies within one block of a car share vehicle through Gov. Code 66322(a)(5) and the ordinance's own rule that state law prevails (19.801.B.2.a).
Ord. 348 §§ 19.801.B.2.a, 19.802.I, 19.803.H (Ord. 348.5056 § 1); Gov. Code §§ 66314(d)(10)-(11), 66322(a)"Applications for an Additional Residential Accommodation shall be reviewed and processed ministerially," and the Planning Director or designee "shall approve an application upon determining that the proposed development complies with the objective requirements of this Article" and state law, following the Gov. Code 66317 and 66335 timelines (Ord. 348 § 19.809.A): a completeness decision within 15 business days and approval or denial within 60 days of a complete application, with no hearing. Clearances from Environmental Health (septic systems and wells), water and sewer providers, Flood Control, the Airport Land Use Commission and Fire are checked within that ministerial review and need no separate discretionary entitlement (19.809.B). Unpermitted ADUs and JADUs built before 2020 can be legalized under Gov. Code 66311.7 (19.809.C). Building and Safety offers free permit-ready ADU plans of 499, 625, 749 and 909 sq ft for eligible single-family lots.
Ord. 348 § 19.809 (Ord. 348.5056 § 1); Gov. Code §§ 66311.7, 66317, 66335"An Accessory Dwelling Unit may be rented separately from the primary dwelling," but may not be sold or conveyed separately except as state law requires, such as the Gov. Code 66341 qualified-nonprofit path; the county has not opted into Gov. Code 66342 ADU condominiums (Ord. 348 § 19.802.C). The rewritten article sets no minimum rental term for ADUs, while "A JADU shall not be rented for periods of less than thirty (30) days" (19.803.B.3), and state law requires terms longer than 30 days for JADUs and for ADUs approved under the state-exempt pathway (Gov. Code 66323(e), 66333(g)). The county's short-term rental ordinance (Ord. 927.3, effective September 24, 2026) says a short-term rental "may include any accessory dwelling unit (ADU), junior ADU, second unit, guest quarter, or ranchet unit not otherwise prohibited by state law" but excludes units under "other legal requirements prohibiting this type of rental," so a county-standards ADU appears eligible for an annually renewed STR certificate, subject to occupancy and parking limits, the 500-certificate cap in Idyllwild and Pine Cove, the Temecula Valley Wine Country caps, and one certificate per lot where a lot holds several dwellings. Confirm STR eligibility with the Planning Department before booking short stays.
Ord. 348 §§ 19.802.C, 19.803.B.3 (Ord. 348.5056 § 1); Ord. 927.3 §§ 4, 8.g; Riverside County Code § 5.84.040; Gov. Code §§ 66315, 66323(e), 66333(g), 66341The fine print: 10 caveats that can change the picture
- Scope: this entry covers only the unincorporated areas of Riverside County (about 400,000 residents), administered by the TLMA Planning Department and Building and Safety; the 28 incorporated cities, including the City of Riverside (its own directory entry), write their own ADU rules.
- Which text governs: since October 15, 2026 ADU permits run under Ord. 348 Article XIXj as rewritten by Ord. 348.5056 (Change of Zone No. 2600012; introduced September 1 and adopted unanimously September 15, 2026; effective 30 days after adoption), with state law prevailing wherever the two conflict (19.801.B.2.a). The county's online code (Municode Chapter 17.294, Supp. No. 84, covering ordinances through August 25, 2026) still prints the superseded 2020 chapter, with its 1,000 sq ft detached cap, owner-occupancy sunset and 30-day rental bar for every ADU, until Municode codifies Ord. 348.5056; rely on the adopted ordinance until then.
- HCD review: HCD's May 14, 2025 findings letter listed 19 conflicts between the 2020 chapter and state law; the county answered (HCD's index records the response as received) and amended the ordinance by Ord. 348.5056, which HCD's June 2026 preliminary review said integrated most recommendations. Under Gov. Code 66326(a) the county must send the adopted ordinance to HCD within 60 days of adoption (about November 14, 2026), and HCD has said a formal letter may follow; HCD's letter dashboard, current through October 19, 2026, lists no 2026 ADU letter for the county.
- Additional Residential Accommodations family: the county groups ADUs with county-only types that are not state-law ADUs. Second units (lots over 7,200 sq ft; 1,600 sq ft on 20,001 sq ft to 2 acre lots, 2,500 sq ft on 2.01 to 4 acres, 200 percent of the home over 4 acres; no taller than the home; 1 or 2 parking spaces; no rentals under 30 days) and guest quarters (no kitchen, not rentable, 70 to 1,000 sq ft, one parking space) count against the detached allowance, and a lot with a detached second unit gets no detached ADU unless state law requires it. Ranchet units and multiple owner group (MOG) mobilehome units exist only in the Eastern Coachella Valley. SB 9 units are a seventh type; an SB 9 two-unit project cannot be combined with a second unit, and lots created by an SB 9 urban lot split get no ADU or other accommodation.
- Ord. 348.5056 drafting artifacts (text, not rules): 19.802.E.3.b.ii cites 'Government Code Section 6632(a)(4)' for 66323(a)(4); several sections say utilities 'shall comply with Section 19.801(C)', a subsection that does not address utilities; the second-unit size table starts at 20,001 sq ft lots although second units are allowed on lots over 7,200 sq ft; and the parking exemption list drops the car-share exemption, which Gov. Code 66322(a)(5) still supplies.
- State-exempt pathway (Gov. Code 66323): regardless of the county standards, the county must ministerially approve a conversion ADU plus a JADU within existing or proposed space, one new detached ADU of up to 800 sq ft with 4-foot side and rear setbacks on a single-family lot, conversion ADUs up to 25 percent of existing multifamily units, and up to eight detached ADUs on a lot with an existing multifamily building; rentals of these units must exceed 30 days (66323(e)). From January 1, 2027, AB 956 (Chapter 791, Statutes of 2026) raises the exempt count to two detached new-construction ADUs on a single-family lot.
- Site constraints common in the unincorporated county: septic lots need Environmental Health approval and well-served lots Environmental Health clearance, and Flood Control, water and sewer providers, Fire and Airport Land Use Commission requirements apply by location (19.809.B); the free permit-ready ADU plans require a single-family-zoned site outside environmental constraint areas and outside flood hazard areas unless Flood Control pre-approves the plans.
- Short-term rentals: Ord. 927.3 (adopted August 25, 2026, effective September 24, 2026) requires an annually renewed STR certificate everywhere in the unincorporated county, caps Idyllwild and Pine Cove at 500 certificates with a 150-foot spacing rule, caps the Temecula Valley Wine Country districts, and issues one certificate per lot where a lot holds several one-family dwellings, which must then be rented together; Ord. 671.25 sets STR registration fees of $1,077 initial and $775 renewal from October 25, 2026. The reading that county-standards ADUs may hold STR certificates rests on the absence of an ADU term bar in Ord. 348.5056 and has not been confirmed by the Planning Department.
- Fees: no impact fees on an ADU of 750 sq ft or less or a JADU of 500 sq ft or less, and proportional fees above that (Gov. Code 66311.5(c)); from January 1, 2027 SB 1117 (Chapter 809, Statutes of 2026) limits impact fees to the area above 750 sq ft. The Western Riverside MSHCP mitigation fee exemption for ADUs and JADUs tracks state law (Riverside County Code 4.62.100.C-D), and WRCOG's TUMF exempts ADUs and JADUs (Ord. 824.20, effective June 12, 2026).
- Re-verify: by about November 16, 2026 for HCD's response to the county's Gov. Code 66326(a) submittal of Ord. 348.5056 (an unanswered finding would trigger the 66326(d) null-and-void rule); at the next Municode supplement, which should codify Ord. 348.5056 and will likely renumber the Chapter 17.294 sections; when the county publishes its ARA Handbook, matrix table and eligibility checklists (all marked 'Coming Soon' on October 23, 2026); and after January 1, 2027 for SB 1117 and AB 956.
Summarized from Riverside County's ordinance text, read October 2026; every row links the code section it came from. Rules often vary by zone and lot, so treat this as orientation, not a permit determination, and confirm with the planning department before you commit to a design.

California statewide law also applies
California sets baseline ADU rights at the state level. Where local rules are stricter than state law allows, state law usually wins, so both are worth reading.
