ADU rules in Salinas
These are the primary sources for accessory dwelling unit regulations in Salinas: the city's own zoning code, planning department pages, and permit guides. Start here before talking to anyone: the rules below are what your permit reviewer will apply.
Rules at a glance
Yes. From 10-1-2026, Sec. 37-50.250 (added by Ord. 2699) permits ADUs on every lot zoned for single-family or multifamily use that has an existing or proposed home, with a building permit only: on a single-family lot, one detached new-construction unit of up to 800 sq ft on the state-exempt track (Gov. Code 66323), plus one local-track ADU of up to 1,200 sq ft that 37-50.250(c)(1)(C) says may be combined with the exempt units; on multifamily lots, up to two detached units beside a proposed building, or up to eight (never more than the existing unit count) beside an existing one. Through 9-30-2026 the same units were allowed directly under state law, because Ord. 2693 (adopted 2-24-2026, effective 3-26-2026) repealed the old local section and the use tables say ADUs 'shall be permitted pursuant to State ADU law'. ADUs are a permitted (P) use in the A, R-L, R-M, R-H, PS and New Urbanism NE, NG-1 and NG-2 districts, and Ord. 2699 adds them to all four commercial and both mixed-use districts; the NU Village Center (VC) still lists them as not permitted (see caveats).
Salinas Municipal Code Sec. 37-50.250(b)(1)(B)-(C), (b)(3)(B)(ii) and (c)(1)(B)-(C), added by Ord. No. 2699 (NCS) Sec. 11 (adopted 9-1-2026, effective 10-1-2026); Tables 37-30.10, 37-30.30, 37-30.50, 37-30.70, 37-30.90, 37-30.110, 37-30.170 and 37-30.190 as amended by Ord. No. 2693 (NCS) (2-24-2026) and Ord. No. 2699; Gov. Code 66314, 66323(a)(2), (a)(4)Yes. Attached additions, conversions of existing space (garages, basements, accessory structures) and junior ADUs are all allowed with a building permit. The state-exempt track (37-50.250(b), Gov. Code 66323(a)(1)) allows one ADU within the existing or proposed space of a single-family home or accessory structure, with up to 150 sq ft of expansion for ingress and egress, plus one JADU of up to 500 sq ft inside the walls of the home, attached garage included; the local track allows an attached addition subject to the 50 percent size rule. On multifamily lots, non-livable space such as storage rooms, attics, basements or garages can become at least one ADU and up to 25 percent of the existing unit count. JADUs are not permitted in the Mixed Use districts or the NU Village Center and need a conditional use permit in the CO and CR commercial districts under the Ord. 2699 use tables.
Salinas Municipal Code Sec. 37-50.250(b)(1)(C)(i), (iii), (b)(3)(A)(i), (b)(3)(B)(i), (c)(3)(B) and (d)(1)-(3), added by Ord. No. 2699 (NCS) (effective 10-1-2026); Tables 37-30.90 and 37-30.110 as amended by Ord. No. 2699; Gov. Code 66323(a)(1), (a)(3), 66333(d)Sec. 37-50.250(c)(3) caps a local-track detached ADU at 1,200 sq ft of gross floor area (the Gov. Code 66314(d)(5) figure) and an attached ADU that expands the existing home at 50 percent of its living area, while guaranteeing at least 850 sq ft for a studio or one-bedroom unit and 1,000 sq ft for more than one bedroom; conversions of existing space on the state-exempt track carry no size cap beyond a 150 sq ft expansion for ingress and egress, and every unit must be at least 150 sq ft. The state-exempt detached unit is limited to 800 sq ft of livable space with 4-foot side and rear setbacks and no front setback minimum, and a JADU to 500 sq ft of interior livable space. Detached units may be 16 feet tall, or 18 feet within half a mile walking distance of a major transit stop or high-quality transit corridor or beside a multistory multifamily building, plus 2 feet to match the main roof pitch, and may have two stories within those limits; attached units may reach two stories and 25 feet or the zone's height limit, whichever is lower. Through 9-30-2026 the state standards (66314(d)(4)-(5), 66321(b)) applied directly with the same headline figures.
Salinas Municipal Code Sec. 37-50.250(b)(3)(A)(ii), (c)(3)(B)(ii)-(iv), (c)(3)(C)(i)-(iii) and (d)(3), added by Ord. No. 2699 (NCS) (effective 10-1-2026); Gov. Code 66314(d)(4)-(5), 66321(b), 66323(a)(2)No. Sec. 37-50.250(c)(4)(A) states that owner occupancy is not required on a property with an ADU, matching Gov. Code 66315, which bars owner-occupancy conditions on ADUs; the repealed pre-2026 local section carried no such requirement either. For a junior ADU the owner must live in the house (in the main home or the JADU) only when the JADU shares sanitation facilities with it, a condition written into the recorded JADU deed restriction (37-50.250(d)(8)-(9), Gov. Code 66333(b) as amended by AB 1154); no owner occupancy applies when the JADU has its own bathroom or the owner is a public agency, land trust or housing organization. The city's ADU flyer still says the owner must reside on site for every JADU, which is out of date.
Salinas Municipal Code Sec. 37-50.250(c)(4)(A) and (d)(8)-(9), added by Ord. No. 2699 (NCS) (effective 10-1-2026); Gov. Code 66315, 66333(b)Sec. 37-50.250(c)(3)(G) requires no more than one off-street space per local-track ADU or per bedroom, whichever is less, which may be tandem on a driveway or in setback areas, and waives it entirely within one-half mile walking distance of public transit (any fixed-route bus stop counts under the Ord. 2699 definition in 37-10.400), in an architecturally and historically significant historic district, for a unit within the home or an accessory structure, where on-street permits are required but not offered, within one block of a car-share vehicle, or when the ADU is permitted together with a new home on the lot. Units on the state-exempt track (the 800 sq ft detached unit and conversions) need no parking (37-50.250(b)(3)(D)), JADUs need none (37-50.250(d)(4)), and a garage, carport or parking space demolished or converted for an ADU never has to be replaced. Through 9-30-2026 no local ADU parking figure existed (Table 37-50.100 still points ADUs to the repealed 37-50.250), so only the Gov. Code 66314(d)(10) cap and the 66322 exemptions applied.
Salinas Municipal Code Sec. 37-50.250(b)(3)(D), (c)(3)(G) and (d)(4), and Sec. 37-10.400 'Public Transit', as added by Ord. No. 2699 (NCS) (effective 10-1-2026); Table 37-50.100 (Sec. 37-50.360); Gov. Code 66314(d)(10)-(11), 66322(a), 66334(a)Permitted (ministerial). Both tracks need only a building permit, reviewed through the building permit process with ministerial planning review and approved without discretionary review or a public hearing (37-50.250(b)(1)(A), (c)(1)(A), (c)(2)(A)); the city must say whether an application is complete within 15 business days and act within 60 days of a complete application or the permit is deemed approved, with a written appeal decided within 60 business days (37-50.250(c)(2), Gov. Code 66317). Before 10-1-2026 the city processed ADUs the same way under state law, which staff reported it had done since 2020. Exceptions to watch: JADUs need a conditional use permit in the CO and CR commercial districts, and new homes within the Salinas Municipal Airport area of influence trigger airport-compatibility review and an avigation easement (see caveats).
Salinas Municipal Code Sec. 37-50.250(a), (b)(1)(A), (c)(1)(A) and (c)(2), added by Ord. No. 2699 (NCS) (effective 10-1-2026); Gov. Code 66317, 66320, 66323(a)From 10-1-2026, Sec. 37-50.250(f)(1) requires every ADU and JADU rental to run longer than 30 days, which is exactly what state law demands for state-exempt units (Gov. Code 66323(e)) and JADUs (66333(g)); for local-track ADUs, Gov. Code 66315 lets a city require only terms of 30 days or longer, so the local wording reaches one day past the state authorization and the section's state-law-prevails clause (37-50.250(a)) would protect a flat 30-day lease. Salinas has no short-term rental permit program: stays of less than 28 days are transient occupancy, a hotel-type commercial use (37-10.440) subject to transient occupancy tax (Chapter 32, Article IV). Landlords must register every residential rental unit, ADUs included, each year (17-01.02(j), 17-01.03), but ADUs and JADUs are exempt from the registry fee when the primary home is owner-occupied (17-01.04(d)(2)), and an owner-occupied single-family home renting out up to two units such as an ADU or JADU is exempt from the just-cause eviction article (17-02.52(b)(5)); a measure to repeal all four rental ordinances is on the 11-3-2026 ballot. An ADU can be sold separately only through the qualified-nonprofit route (66341) or, under 37-50.250(f)(3), as a condominium meeting every Gov. Code 66342 requirement, and an ADU may not be occupied until the city approves occupancy of the main home (37-50.250(f)(1)).
Salinas Municipal Code Sec. 37-50.250(a) and (f), added by Ord. No. 2699 (NCS) (effective 10-1-2026); Secs. 17-01.02(j), 17-01.03, 17-01.04(d)(2) (Ord. No. 2663 (NCS)), 17-02.52(b)(5) (Ord. No. 2682 (NCS)), 37-10.440; Gov. Code 66315, 66323(e), 66333(g), 66341, 66342The fine print: 10 caveats that can change the picture
- Regime change on 10-1-2026: Ord. No. 2699 (NCS) (Zoning Code Amendment 2026-001, introduced 8-18-2026, adopted 9-1-2026 by a 7-0 vote, effective 30 days after adoption) re-enacts Sec. 37-50.250 as a full local ADU section. From 3-26-2026 through 9-30-2026 Salinas had no local ADU section (Ord. No. 2693 (NCS), adopted 2-24-2026 after HCD's 10-8-2025 letter, repealed it and rewrote the use-table notes to 'shall be permitted pursuant to State ADU law') and applied Gov. Code 66310 through 66342 directly. The values here are the Ord. 2699 rules; their headline numbers match the state standards applied before.
- HCD submission deadline: Gov. Code 66326(a) requires the city to send Ord. 2699 to HCD within 60 days of adoption (by 10-31-2026), and 66326(d) makes an unsubmitted ordinance, or one whose HCD findings go unanswered for 30 days, null and void, in which case the state standards (same headline figures) apply. HCD's only Salinas record is the 10-8-2025 'Technical Assistance Letter - Repeal Request' (xlsx index current to 7-14-2026; Power BI dashboard queried 9-29-2026, newest row 9-21-2026). Re-check the dashboard for a submission or findings letter by 2026-11-15.
- Codification lag: Municode Supplement No. 110 (codified through Ord. No. 2696 of 6-16-2026, online 9-16-2026) still prints Sec. 37-50.250 as 'Reserved', the use-table notes 'pursuant to State ADU law', a Table 37-50.100 ADU parking row that points to the repealed section, and legacy 'Second Dwelling Units' rows in the Commercial (SPR in CO/R, NP elsewhere) and Mixed Use (NP) tables. Ord. 2699 sits uncodified in the Municode ordinance bank; after the next supplement, swap the curated bank PDF and field sourceUrls for the codified Sec. 37-50.250 node.
- Zone gaps: under the Ord. 2699 tables ADUs and JADUs remain 'NP' in the New Urbanism Village Center (VC) district even though VC allows multifamily dwellings, which conflicts with 37-50.250(b)(1)(B) and (c)(1)(B) (ADUs permitted on all lots zoned for single-family or multifamily use) and with Gov. Code 66314 and 66323(a); 37-50.250(a) and Gov. Code 66325 make state law prevail. JADUs are 'NP' in the MAF and MX mixed-use districts and the CT district and need a conditional use permit in CO and CR. NU district uses apply 'Except as set forth in each specific plan', and residential uses, ADUs included, are barred on PS-zoned land inside the Airport Overlay District (Table 37-30.170 note 13).
- Airport overlay: building permits for any new residential dwelling within the Salinas Municipal Airport 'area of influence' get airport-compatibility review and require dedication of an avigation easement before the first building permit (Secs. 37-40.420(a)(7), 37-40.430, 37-40.450). Whether staff apply this to ADUs is not documented, and Gov. Code 66315 bars standards beyond 66314; ask Planning for lots near the airport.
- Local-track standards HCD could question: 37-50.250(c)(3)(A) applies base-district lot coverage, floor-area ratio, open space, front setback and minimum lot size standards to local-track ADUs, while Gov. Code 66321(b)(3) forbids those limits from blocking an 800 sq ft ADU with 4-foot side and rear setbacks and 66314(b)(1) bars minimum lot size requirements; the 1,200 sq ft detached cap is measured in gross floor area while the state floors are interior livable space. State-exempt units are shielded by 37-50.250(b)(3)(F), which bars any objective standard not allowed by Gov. Code 66323; the California Housing Defense Fund's 6-3-2026 comment letter had faulted an earlier draft for lacking that exemption.
- Condo sale: 37-50.250(f)(3) (from 10-1-2026) says separate conveyance of the primary dwelling and ADU as condominiums is allowed if all Gov. Code 66342 requirements are met, which reads as an opt-in to the AB 1033 regime; the staff reports do not discuss it, so confirm with Planning before relying on it. The 66341 qualified-nonprofit route applies regardless.
- Rental ordinances on the ballot: the Rental Registration (Ord. 2663), Rent Stabilization (Ord. 2681), Just Cause Eviction (Ord. 2682) and Tenant Anti-Harassment (Ord. 2683) ordinances face a repeal measure the council placed on the 11-3-2026 General Election ballot (9-23-2025 vote) and remain in effect until then; 2026 registry fees are $29 per unit for units outside rent stabilization. Re-check rentalRestrictions after the result is certified (2026-12-15).
- Stale city materials (not curated): the city ADU page (salinas.gov/City-Hall/Departments/Community-Development/Accessory-Dwelling-Unit, fetched 9-29-2026) still tells applicants to sign, notarize and record a deed restriction before permit issuance and caps detached ADUs on multifamily lots at two; the ADU flyer (v/3 adu-guide-english.pdf, edited 5-15-2026) prints an 800 sq ft attached cap unless the home exceeds 1,600 sq ft, an ADU deed restriction, owner residence for every JADU and 'no second story ADU'; the 2023 guidebook's Step 7 deed restriction and the REV 9/8/2020 building checklist also predate current law. HCD's 10-8-2025 letter says deed restrictions on ADUs are barred (Gov. Code 66315). The page's pre-approved detached plan program (four plans of 495 to 749 sq ft; only 2025 plan sets accepted from 10-1-2026) and ADU hotline (831-758-7208) remain useful; re-check the page after 10-1-2026 and curate it once updated.
- 2026 state law: SB 1117 (Chapter 809, Statutes of 2026) and AB 956 (Chapter 791, Statutes of 2026) were signed on September 29, 2026 and take effect January 1, 2027. From that date AB 956 amends Gov. Code 66323 so the state-exempt pathway allows two detached new-construction ADUs on a single-family lot, with no JADU owed where two exist, and extends the Civ. Code 714.3 and 4751 CC&R anti-restriction rule to any lot zoned to allow single-family use; SB 1117 amends Gov. Code 66311.5 so impact fees on an ADU over 750 sq ft are charged only on the area above 750 sq ft. Until then the current text governs, and the unit-count and fee notes in this entry describe the pre-2027 rules.
Summarized from Salinas's ordinance text, read September 2026; every row links the code section it came from. Rules often vary by zone and lot, so treat this as orientation, not a permit determination, and confirm with the planning department before you commit to a design.

California statewide law also applies
California sets baseline ADU rights at the state level. Where local rules are stricter than state law allows, state law usually wins, so both are worth reading.
