These are the primary sources for accessory dwelling unit regulations in San Rafael: the city's own zoning code, planning department pages, and permit guides. Start here before talking to anyone: the rules below are what your permit reviewer will apply.

Rules at a glance

Detached (backyard) ADU
Allowed

Detached ADUs are allowed by right on any lot zoned for single-family or multifamily residential use with an existing or proposed home: Table 14.04.020 marks ADUs and JADUs "P" (permitted by right) in the R, DR, MR, HR and PD districts, and Table 14.05.020 marks them "P" in the GC, NC, O, C/O, R/O and FBWC districts. A compliant unit needs only a building permit. Beside the local-standards unit (up to 1,000 sq ft), subsection E guarantees the state-exempt detached unit of up to 800 sq ft with 4 ft side and rear setbacks (Gov. Code 66323(a)(2)). On a multifamily lot the local cap of two detached ADUs (E.4) yields to the state count of up to eight, never more than the existing units (66323(a)(4)(A)(ii)).

SRMC § 14.16.285.B and E (Ord. No. 2002, 2021; Ord. No. 2013, 2022); Tables 14.04.020 and 14.05.020; Gov. Code § 66323(a)
Attached or internal ADU
Allowed

Attached additions, internal conversions of the home or of an existing accessory structure, and JADUs (up to 500 sq ft within the walls of a single-family home) are all allowed by right in the same districts. Conversions have no size cap and need no new setbacks, with up to 150 sq ft of expansion for ingress and egress (E.1; Gov. Code 66323(a)(1)). In multifamily buildings, ADUs may be created only in existing non-livable space, at least one and up to 25 percent of the existing units (E.3; 66323(a)(3)). One JADU is allowed per lot (C.2.a).

SRMC § 14.16.285.B.1, B.3, B.4, C.2.a and E.1, E.3; Gov. Code § 66323(a)(1), (3)
Maximum size
1,000 sq ft detached; attached 1,000 sq ft or 50% of the home, whichever is less, with 800 sq ft always allowed; conversions uncapped; JADU 500 sq ft

Table 14.16.285 caps a detached ADU at 1,000 sq ft and an attached ADU at 1,000 sq ft or 50 percent of the existing home, whichever is less; the city page and Gov. Code 66321(b)(3) guarantee at least 800 sq ft whatever the percentage, lot coverage or floor area ratio. Internal conversions are uncapped, JADUs are limited to 500 sq ft, the minimum unit is 150 sq ft, and the state-exempt detached unit is capped at 800 sq ft (E.2). The table's 16 ft height for every new unit yields to Gov. Code 66321(b)(4): 16 ft detached, 18 ft within one-half mile of a major transit stop or high-quality transit corridor (plus 2 ft for a matching roof pitch) or on a lot with a multistory multifamily building, and 25 ft or the zone's lower limit attached; the city page already applies those heights, with 17 ft in the Eichler-Alliance overlay. Since 1-1-2026 the state minimums are measured in interior livable space, while the local text speaks of floor area. The 2021 ordinance is exposed to Gov. Code 66316 after HCD's unanswered 2-27-2026 repeal-request letter; a void reading would substitute the state default of 1,200 sq ft detached (66314(d)(5)).

SRMC § 14.16.285.C.1 (Table 14.16.285), C.3.b and E.2; Gov. Code §§ 66314(d)(4)-(5), 66316, 66321(b)
Owner occupancy
Not required

No owner-occupancy rule applies to ADUs: 14.16.285 imposes none and Gov. Code 66315 bars one. The codified JADU clause (C.2.c) still requires owner occupancy for every JADU, but since 1-1-2026 Gov. Code 66333(b) allows that only when the JADU shares sanitation facilities with the main home, so a JADU with its own bathroom needs no owner on site. A recorded JADU deed restriction barring separate sale and fixing its size remains required (C.2.d; 66333(c)).

SRMC § 14.16.285.C.2.c-d; Gov. Code §§ 66315, 66333(b)-(c)
Extra parking
1 space per new attached or detached ADU unless exempt; none for conversions, JADUs, state-exempt units or within 1/2 mile walking distance of transit

The code requires one space per new attached or detached ADU, which may be tandem on a driveway, anywhere on the lot, covered or uncovered, but none for internal conversions, JADUs, units within one-half mile walking distance of public transit, units in a historic district, where on-street permits are not offered to the occupant, or within one block of a car-share vehicle (C.5.b). The city page adds the state exemption for an ADU applied for together with a new home (Gov. Code 66322(a)(6)), and subsection E state-exempt units carry no parking standard (66323(b)). Garages, carports or covered spaces demolished or converted for an ADU need not be replaced (C.5.c), and 66314(d)(11) extends that to uncovered spaces. On a plain reading of 66314(d)(10)(A) (one space per unit or per bedroom, whichever is less), the flat one-space rule cannot reach a studio ADU.

SRMC § 14.16.285.C.5 and Table 14.16.285; Gov. Code §§ 66314(d)(10)-(11), 66322(a), 66323(b)
Approval process
Permitted use

Ministerial: an ADU or JADU meeting the standards "shall only be subject to issuance of a building permit" with no discretionary review or public hearing (14.16.285.C), applications are filed online as a General Permit Requiring Plan Review, and the city must act within 60 days of a complete application (D.1; Gov. Code 66317(a)(3)). State law adds the 15-business-day completeness notice and a written appeal path to the Council or Planning Commission (66317(a)(2), (d)), which the 2021 code lacks. Subsection E units (conversions, the 800 sq ft detached unit, multifamily conversions and detached units) are approved ministerially without the local development and design standards.

SRMC § 14.16.285.C, D and E; Gov. Code § 66317
Rental restrictions
Long-term rentals allowed, no separate sale; ordinary ADUs may be registered short-term rentals by a primary-resident host (not alongside the whole main home); JADUs and state-exempt units only for terms longer than 30 days

ADUs and JADUs may be rented but not sold separately from the main home (C.2.b, C.4.b), except through the qualified-nonprofit path the code cites as legacy 65852.26 (now Gov. Code 66341); no ADU condominium opt-in under 66342 was found. Ordinary local-standards ADUs have no minimum rental term and may be offered as short-term rentals (under 30 days) through the city's Short-Term Rental Program (Chapter 10.110 and Resolution 14737, 2019): the host must be a Permanent Resident whose primary residence is on the property, must register annually ($170 first time, $135 renewal) and remit transient occupancy tax, and may not rent the whole main home and the ADU at the same time. State-exempt units under subsection E must be rented for terms longer than 30 days (Gov. Code 66323(e); the local E.5 says not less than 30 days), and since 1-1-2026 so must JADUs (66333(g)), overriding the city FAQ that lists JADUs as eligible short-term rentals.

SRMC §§ 14.16.285.C.2.b, C.4.b, E.5, 14.03.030, Ch. 10.110; Res. No. 14737 (11-4-2019) § 4; Gov. Code §§ 66315, 66323(e), 66333(g), 66341
The fine print: 14 caveats that can change the picture
  • Regime: the codified SRMC 14.16.285 is the Ord. No. 2002 text (adopted 12-6-2021; Ord. No. 2013 of 8-1-2022 only added an SB 9 cross-reference to subsection B), unchanged through Municode Supp. No. 37 (codified through Ord. No. 2057 of 12-1-2025). The city ADU page (last modified 11-8-2024) says that where the 2022 ordinance conflicts with newer state ADU law "the state law standards apply", so the operative rules are the local text as overridden by Gov. Code 66310 to 66342.
  • HCD sent a Technical Assistance Letter - Repeal Request on 2-27-2026 (ADU0007915): the newest San Rafael ordinance on file is from 2021, and HCD asked by 3-29-2026 for either an explanation of compliance or a plan to repeal or amend. Neither HCD's index (current to 7-14-2026) nor its dashboard (current to 10-5-2026) records a response. Because the 2021 text conflicts with state law on several points, it is exposed to Gov. Code 66316 (a noncompliant ordinance is null and void and state standards apply, including 1,200 sq ft for detached ADUs under 66314(d)(5)); maxSize is low confidence for that reason.
  • Pending: a 2-24-2026 Planning Commission study session listed "An updated accessory dwelling unit ordinance" and an updated SB 9 ordinance among 2026 zoning items, and the 6-1-2026 strategic plan update expected the next zoning amendments at the Planning Commission over the summer; every Planning Commission meeting from 5-26-2026 through 9-29-2026 was cancelled and no ADU item reached the Council through 10-5-2026. Re-check agendas from October 2026.
  • Overridden local clauses: the one-ADU-per-lot rule (C.4.a) and the rule that the subsection E categories cannot be combined yield to the unit combinations of Gov. Code 66323(a); the two-detached-ADU cap on multifamily lots (E.4) yields to up to eight, never more than the existing units (66323(a)(4)(A)(ii)); the 16 ft height for attached units yields to 25 ft or the zone's lower limit (66321(b)(4)(D)); the universal JADU owner-occupancy clause (C.2.c) yields to 66333(b); and E.5's not-less-than-30-days rental rule yields to the longer-than-30-days rule of 66323(e).
  • Size measurement: the local caps are stated in floor area, while since 1-1-2026 the state minimums for local caps (850 sq ft, 1,000 sq ft for more than one bedroom, the guaranteed 800 sq ft unit) are measured in interior livable space (Gov. Code 66321(b)(2)-(3)).
  • Eichler and Alliance Homes overlay (-E/A): homes are capped at 17 ft and one habitable floor (14.14.020), and 14.16.285.C.3.b caps ADUs at the height of the existing house or 17 ft, whichever is less; where the existing house is lower than 16 ft that clause falls below the 16 ft detached floor of Gov. Code 66321(b)(4)(A).
  • Parking: the flat one-space rule reaches studio ADUs, beyond the one-per-unit-or-per-bedroom-whichever-is-less ceiling of Gov. Code 66314(d)(10)(A) on a plain reading, and the code's exemption list omits the new-home exemption of 66322(a)(6), which the city page lists.
  • Short-term rentals: the 2020 FAQ on the city's STR program page still lists JADUs as eligible; Gov. Code 66333(g) has required JADU rentals longer than 30 days since 1-1-2026. The STR rules are set by council resolution (Resolution 14737, adopted 11-4-2019 with a one-year review) under Chapter 10.110 (Ord. No. 1976); no later amendment was found.
  • Fees: Ord. No. 2066 (Transportation Mitigation Fee Program, new SRMC 3.33.090(a)(6), introduced 6-15-2026 and on the 7-20-2026 agenda for adoption) exempts ADUs "of less than seven hundred fifty (750) square feet" under legacy 65852.2(f)(3), and the city page waives fees for ADUs "less than 750 sq feet", while Gov. Code 66311.5(c)(1) bars impact fees on ADUs of 750 sq ft of interior livable space or less; the companion park fee Ord. No. 2065 has no ADU exemption, so the state rule controls. SB 1117 (Ch. 809, Stats. 2026, effective 1-1-2027) limits impact fees on ADUs over 750 sq ft to the area above 750 sq ft.
  • AB 956 (Ch. 791, Stats. 2026, effective 1-1-2027) amends Gov. Code 66323 to allow two detached new-construction ADUs on a single-family lot under the state-exempt pathway (no JADU owed where two exist), so the local one-detached-unit counts (C.4.a, E.2) yield further from that date; re-read 66323 after 1-1-2027.
  • Process: the code lacks the 15-business-day completeness notice and the appeal path of Gov. Code 66317(a)(2) and (d), which apply directly, and D.3.b's joint-processing option (the ADU "is subject to the same review procedures and requirements as the separate construction") conflicts with 66317(a)(3) where that construction needs discretionary review.
  • SB 9 lots: on parcels created by an urban lot split that carry an SB 9 housing development, 14.16.282.C.1.f (Ord. No. 2013) allows only one ADU or one JADU beside a single primary unit and restricts ADUs where two primary units exist.
  • City page flags: the city ADU page's multifamily FAQ still says a maximum of two detached ADUs (state law has allowed up to eight since 1-1-2025), it states the fee waiver as "less than 750 sq feet", it is silent on the 2025 JADU changes, and its 2020 single-family and multifamily checklists predate them. The Pre-Approved ADU Plans page says the city has no pre-approved plans yet, and the /adu2020/ link on the Permits Requiring Plan Review page returns 404.
  • No coastal permit layer: the zoning code has no coastal-zone provisions (a quoted Municode search for "coastal zone" returns 0 hits).

Summarized from San Rafael's ordinance text, read October 2026; every row links the code section it came from. Rules often vary by zone and lot, so treat this as orientation, not a permit determination, and confirm with the planning department before you commit to a design.

California statewide law also applies

California sets baseline ADU rights at the state level. Where local rules are stricter than state law allows, state law usually wins, so both are worth reading.
