These are the primary sources for accessory dwelling unit regulations in Santee: the city's own zoning code, planning department pages, and permit guides. Start here before talking to anyone: the rules below are what your permit reviewer will apply.

Rules at a glance

Detached (backyard) ADU
Allowed

Detached ADUs are a permitted use (P) in all eight residential districts (HL, R-1, R-1A, R-2, R-7, R-14, R-22, R-30). On a single-family lot one new-construction detached (or attached) ADU of up to 800 sq ft with 4 ft side and rear setbacks needs only a building permit under the state-exempt track (§ 13.10.045(F)(1)(b)), and it can be combined with a converted ADU and a JADU; larger detached units go through the local track in subsection (G). On multifamily lots up to two detached ADUs are allowed, or up to eight beside an existing multifamily building as long as they do not outnumber the existing homes. Detached height is 16 ft, 18 ft within one-half mile of a major transit stop (plus 2 ft to match the main roof pitch) and 18 ft on a lot with a multistory multifamily building, matching the state floors.

Attached or internal ADU
Allowed

Attached ADUs, conversions and JADUs are allowed. Under the state-exempt track one converted ADU (inside the existing or proposed home or an existing accessory structure, plus up to 150 sq ft for entry) and one JADU need only a building permit, and the 800 sq ft new-construction unit in (F)(1)(b) may itself be attached. Larger attached units follow subsection (G) and may reach the zone's height limit (35 ft and two stories in the HL, R-1, R-1A and R-2 districts). JADUs (500 sq ft of interior livable space, inside a single-family home including an attached garage) are limited to lots zoned for single-family homes and need a recorded deed restriction before occupancy.

Santee Municipal Code § 13.10.045(C)(7), (D)(1)(c), (D)(7)(d), (D)(8), (F)(1)(a)-(b) and (G)(1)(b) (Ord. 631)
Maximum size
Local-track ADUs 850 sq ft (studio or 1 bedroom) or 1,000 sq ft (2+ bedrooms) of interior livable space, attached also capped at 50% of the existing home; 800 sq ft streamlined (state-exempt) detached or attached unit; conversions existing space + 150 sq ft; JADU 500 sq ft; detached height 16 ft (18 to 20 ft near major transit)

Section 13.10.045(G)(1) caps local-track ADUs at 850 sq ft of interior livable space for a studio or one-bedroom unit and 1,000 sq ft for two or more bedrooms, and an attached unit added to an existing home is further limited to 50 percent of the home's floor area; lot coverage (25 to 75 percent by zone), front setback and open-space rules can never push a unit below 800 sq ft. The streamlined state-exempt unit is capped at 800 sq ft of total floor area, conversions at the existing space plus 150 sq ft for entry, and JADUs at 500 sq ft. Two warnings: the city's own ADU Guide (Version 2, 'As of July 2026') prints maximums of 800 to 1,200 sq ft for attached and detached units, which the code does not support, and HCD's 5-11-2026 letter says the newest Santee ordinance on file is from 2023, so if Ord. 631 never reached HCD within 60 days it is void under Gov. Code 66326(d) and the state standards (1,200 sq ft detached, 50 percent of the home attached, 800 sq ft always allowed) would apply. Ask the Planning Division which cap it applies before designing a unit over 850 sq ft.

Santee Municipal Code § 13.10.045(C)(7), (F)(1)(a)-(b), (G)(1) and (G)(3) (Ord. 631); Gov. Code 66314(d)(4)-(5), 66321(b)(2)-(3), 66326(d)
Owner occupancy
Not required

Section 13.10.045(D)(6)(a) states that ADUs are not subject to an owner-occupancy requirement, as Gov. Code 66315 requires. A JADU needs an owner living on the property (in the main home or the JADU) only when it shares sanitation facilities with the main home; a JADU with its own bathroom, or a property wholly owned by a governmental agency, land trust or housing organization, is exempt, which already tracks Gov. Code 66333(b) as amended by AB 1154 and SB 543. The JADU deed restriction covers separate sale and size, not occupancy.

Santee Municipal Code § 13.10.045(D)(6) and (D)(8) (Ord. 631); Gov. Code 66315, 66333(b)
Extra parking
None for streamlined (state-exempt) units, conversions and JADUs; 1 space per local-track ADU unless within 1/2 mile walking distance of public transit or another state exemption applies

The streamlined units in subsection (F) carry no parking requirement. A local-track ADU under subsection (G) needs one off-street space, which may sit in a setback or be tandem, unless it is within one-half mile walking distance of public transit (any fixed-route bus stop or train station counts), in a historic district, part of the home or an accessory structure, where on-street permits are required but not offered, within one block of a car-share stop, or applied for together with a new home on the same lot. Garages, carports and covered spaces removed for an ADU need not be replaced; the code omits uncovered spaces, but Gov. Code 66314(d)(11) covers them too. Read literally the one-space rule also reaches a studio, while Gov. Code 66314(d)(10)(A) caps parking at one space per unit or per bedroom, whichever is less; the city guide describes parking as required only for units over 800 sq ft more than one-half mile from transit.

Santee Municipal Code § 13.10.045(C)(13)-(14), (F) and (G)(6) (Ord. 631); Gov. Code 66314(d)(10)-(11), 66322(a)
Approval process
Permitted use

ADU and JADU applications are approved ministerially with only a building permit, without discretionary review or a hearing, under both the streamlined track (F) and the local track (G). The city must decide completeness within 15 business days and approve or deny a complete application within 60 days or it is deemed approved, and an applicant may appeal an incompleteness finding or a denial in writing to the City Council, which must answer within 60 business days. Sites inside the Gillespie Field Airport Influence Area get an aviation compatibility check that can add sound attenuation or an overflight notification, but the airport plan treats ADUs on individual lots as compatible.

Santee Municipal Code § 13.10.045(E), (F)(1) and (G) (Ord. 631); Gov. Code 66317
Rental restrictions
No rentals shorter than 30 days (31+ days for JADUs and state-exempt units under state law); no short-term rentals; no separate sale except through Gov. Code 66341

Section 13.10.045(D)(3) bars renting any ADU or JADU for a term shorter than 30 days regardless of when it was built, which is lawful for ordinary ADUs under Gov. Code 66315; for JADUs (66333(g)) and units approved on the state-exempt track (66323(e)) state law requires terms longer than 30 days, so those need at least 31 days. ADUs may be rented but not sold or conveyed separately from the lot except as Gov. Code 66341 allows (qualified nonprofits); Santee has not opted into the 66342 ADU-condominium regime. The Municipal Code has no short-term rental permit chapter (the phrase appears only in the SB 9 sections), and the city's 2026 ADU Guide states that short-term rentals are not allowed in the city.

The fine print: 10 caveats that can change the picture
  • HCD exposure (Gov. Code 66326(d)): HCD's 5-11-2026 Technical Assistance Letter, Repeal Request (ADU0008359) says the newest Santee ADU ordinance on file is from 2023, meaning Ords. 615 and 618 (2024) and Ords. 630 and 631 (2025-2026) were not on file, and asked for a response by 6-10-2026. Neither HCD's letter index (current to 7-14-2026) nor its dashboard (rows through 10-5-2026) records a response, and no public record shows Ord. 631 (adopted 1-14-2026; its Section 6 told the City Clerk to submit it within 60 days) reaching HCD. If it was not submitted within 60 days the ordinance is null and void and the state standards apply until a compliant ordinance is adopted and submitted. Re-check the dashboard and the city's response.
  • The city's ADU Guide (adu-jadu-guide.pdf, Version 2, 'As of July 2026', PDF created 8-26-2026) diverges from the code: it prints 800 to 1,200 sq ft maximums for attached and detached ADUs (the code says 850/1,000 sq ft of interior livable space for local-track units), says completeness is decided within 30 days (code and Gov. Code 66317: 15 business days), and states that the city does not allow the sale of ADUs (66341 nonprofit conveyances are allowed by the code). It is not curated; confirm the applied size cap with Planning.
  • Rental term: the local 30-day floor in § 13.10.045(D)(3) is one day short for JADUs and state-exempt units, where Gov. Code 66333(g) and 66323(e) require terms longer than 30 days; state law controls.
  • Parking: the one-space rule for local-track ADUs reaches studios although Gov. Code 66314(d)(10)(A) caps parking at one space per unit or per bedroom, whichever is less, and the no-replacement rule omits uncovered spaces that 66314(d)(11) also protects.
  • Fees: § 13.10.045(H)(1)(a) exempts only ADUs smaller than 750 sq ft and does not measure interior livable space, while Gov. Code 66311.5(c)(1) bars impact fees on an ADU of 750 sq ft of interior livable space or less; the 2019 to 2024 ADU fee waiver in (H)(1)(c) expired 9-27-2024. The city guide's FY 2026-27 worksheet prices a 751 sq ft ADU at $13,728.28 and a 1,200 sq ft ADU at $21,936.00 in impact fees. SB 1117 (Chapter 809, Statutes of 2026, effective 1-1-2027) limits impact fees on an ADU over 750 sq ft to the area above 750 sq ft, which changes the proportional formula in (H)(1)(b).
  • AB 956 (Chapter 791, Statutes of 2026, effective 1-1-2027) amends Gov. Code 66323 to allow two detached new-construction ADUs on a single-family lot under the state-exempt pathway (no JADU owed where two exist), overriding the one-unit count in § 13.10.045(F)(1)(b) from that date, and extends the Civil Code 714.3 and 4751 CC&R anti-restriction rule to any lot zoned for single-family use.
  • Standards outside § 13.10.045 that the city applies to ADUs: § 13.10.040(G) six-foot separation between an ADU and main buildings, § 13.10.040(J)(2) CALGreen Tier 2 voluntary measures for all new residential units including ADUs, and § 13.10.040(K)(2)(a) a 2 kW solar PV system on every new detached ADU. Applied to a state-exempt unit these may conflict with Gov. Code 66323(b), which bars objective standards that section does not authorize.
  • Unit combinations: the code expressly allows the (F)(1)(a) conversion and JADU with the (F)(1)(b) 800 sq ft unit, and (F)(1)(c) with (F)(1)(d) on multifamily lots, but is silent on adding a local-track (G) ADU to the state-exempt units; HCD reads Gov. Code 66323 as also requiring at least one 66314 unit in combination.
  • JADUs are limited to lots zoned for single-family homes (the city guide lists HL, R-1, R-1A and R-2) and require a recorded deed restriction before the certificate of occupancy. Local-track ADUs within 600 ft of a California Register historic resource must be placed so they are not visible from the public right-of-way (§ 13.10.045(G)(7)).
  • Gillespie Field Airport Influence Area: the Planning Division screens ADU sites for aviation compatibility review, which can require sound attenuation or recording an overflight notification; the airport land use plan allows single-family homes and ADUs on individual lots in Safety Zones 2 and 5. Santee is inland, so no coastal-zone rules apply.

Summarized from Santee's ordinance text, read October 2026; every row links the code section it came from. Rules often vary by zone and lot, so treat this as orientation, not a permit determination, and confirm with the planning department before you commit to a design.

California statewide law also applies

California sets baseline ADU rights at the state level. Where local rules are stricter than state law allows, state law usually wins, so both are worth reading.
