ADU rules in Simi Valley

3 sources

These are the primary sources for accessory dwelling unit regulations in Simi Valley: the city's own zoning code, planning department pages, and permit guides. Start here before talking to anyone: the rules below are what your permit reviewer will apply.

Rules at a glance

Detached (backyard) ADU
Allowed

Detached ADUs are a permitted use in every residential and open space zone (OS, RE, RVL, RL, RM, RMod, RH, RVH and MH) and in the Mixed-Use Overlay, approved ministerially under SVMC 9-44.160 as restated by Ord. 1373 (effective 8-27-2026). The ordinance sorts them into Class 2-s, the state-exempt unit of up to 800 sq ft under Gov. Code 66323 (4-ft side and rear setbacks, no front setback, no parking), and Class 2, a local-track unit of up to 1,000 or 1,200 sq ft that keeps a 20-ft front setback, a 6-ft separation and design rules; on multifamily lots Class 6-s detached units come in the numbers 66323(a)(4) sets (up to eight beside an existing building but no more than its unit count, or two with a proposed building). On lots subject to the Hillside Performance Standards (Chapter 9-32) only 66323 units are allowed, so a detached ADU there is capped at 800 sq ft. Section C allows every combination 66323(a) authorizes; staff told the Planning Commission on 4-8-2026 that a lot can pair one state-exempt and one local-track detached ADU but not two state-exempt ones, and HCD's 9-1-2026 findings require the city to allow at least one 66314 unit alongside the 66323 units.

SVMC § 9-44.160(A)(8), (B)(2), (B)(6), (C) as restated by Ord. 1373 (adopted 7-27-2026, effective 8-27-2026); § 9-24.030 Table 2-2; § 9-26.030 Table 2-5; Gov. Code 66323(a)(2), (a)(4)
Attached or internal ADU
Allowed

Attached ADUs are allowed in the same zones: Class 3 is a newly built addition sharing at least 10 ft of wall with the primary dwelling, Class 4-sp is a conversion inside the existing or proposed primary dwelling (plus up to 150 sq ft for ingress and egress), and Class 4-sa converts an existing accessory structure. JADUs (Class 1-s, up to 500 sq ft inside an existing or proposed single-family home) remain permitted in OS, RE, RVL, RL, RM and RMod, but Ord. 1373 switched them off in the RH and RVH zones (MH already barred them) because Gov. Code 66333 confines JADUs to single-family dwellings; on multifamily lots Class 5-s conversions of non-livable space (at least one, up to 25 percent of the existing units under 66323(a)(3)) take their place. On hillside-standard lots only state-exempt units are allowed, which rules out a new-construction attached addition there but not an internal conversion or a JADU.

SVMC § 9-44.160(A)(8), (B)(1), (B)(3), (B)(4), (B)(5) as restated by Ord. 1373; § 9-24.030 Table 2-2 and note (7) as amended by Ord. 1373; Gov. Code 66323(a)(1), (a)(3), 66333
Maximum size
Detached: 800 sq ft (state-exempt), otherwise 1,000 sq ft on lots up to 8,000 sq ft and 1,200 sq ft on larger lots; attached: 850 sq ft, or 50% of the home up to 1,000 sq ft if larger; JADU 500 sq ft; conversions uncapped; detached one story and 18 ft, attached 25 ft

Ord. 1373 caps a state-exempt detached ADU (Class 2-s) at 800 sq ft and a local-track detached ADU (Class 2) at 1,000 sq ft on lots up to 8,000 sq ft and 1,200 sq ft on larger lots; an attached ADU (Class 3) may be 850 sq ft, or 50 percent of the primary dwelling up to 1,000 sq ft where that is larger, with garages and patios excluded from the home's square footage. Conversions inside existing space and multifamily units carry no stated cap, JADUs stop at 500 sq ft, and on hillside-standard lots the 800 sq ft exempt unit is the only detached option. Detached units are one story and 18 ft (20 ft near major transit to match the main roof pitch), attached units two stories and 25 ft or the zone limit (up to 30 ft with 10-ft side and 20-ft front and rear setbacks). Local-track detached units also face lot-coverage limits (no more than 40 percent of the first 10 ft of a side yard and of the 20-ft rear yard covered, half the rear-yard width open), which HCD's 9-1-2026 finding 3 says cannot block an 800 sq ft ADU with 4-ft setbacks (Gov. Code 66321(b)(3)). The ordinance does not say how square footage is measured, while the state floors (850 and 1,000 sq ft) and the 800 sq ft exempt unit are interior livable space. If the city missed HCD's 10-1-2026 response deadline, Gov. Code 66326(d) voids the ordinance and the state standards (1,200 sq ft detached on any lot, attached 50 percent of the home with the 850 and 1,000 sq ft floors) apply instead.

SVMC § 9-44.160(B)(1)-(4), Tables 4-4 and 4-4.5 and footnotes ** and ***, (F)(1) as restated by Ord. 1373; Gov. Code 66314(d)(4)-(5), 66321(b), 66323(a)(2), 66326(d); HCD findings letter of 9-1-2026, finding 3
Owner occupancy
Not required

No owner occupancy is required for any ADU, and Gov. Code 66315 forbids one. For a JADU, the deed restriction recorded before the Zoning Clearance (SVMC 9-44.160(E)(2) as restated by Ord. 1373) requires the owner to live in the main home or the JADU only if the JADU shares sanitation facilities with the primary structure, matching Gov. Code 66333(b) as amended by AB 1154, and bars selling the JADU separately. The superseded 2023 text, still printed on Municode and in the July 2023 ADU Guide, imposed owner occupancy on every JADU. An owner who uses the SB 9 urban lot split must live on the property for three years (SVMC 9-24.080), a lot-split rule rather than an ADU rule.

SVMC § 9-44.160(E)(2) as restated by Ord. 1373; § 9-24.080; Gov. Code 66315, 66333(b)
Extra parking
None for state-exempt ADUs and JADUs; 1 space for a local-track ADU unless exempt (studio, within a half-mile walk of public transit, inside the home's footprint, garage conversion, built with a new home, and more)

State-exempt ADUs and JADUs (Table 4-4) need no additional parking. A local-track ADU (Class 2 detached or Class 3 attached) needs one space unless it is a studio, sits within a half-mile walk of public transit (defined to include any fixed-route bus stop), lies within the footprint of the existing or proposed home, replaces a garage, carport or covered parking that provided required parking, is in an area where on-street permits are not offered to its occupant, is within one block of a car-share vehicle, is in an architecturally or historically significant district, or is proposed with a new single-family or multifamily home; Ord. 1373 added the last two exemptions after HCD's 2025 findings. Spaces may be uncovered or tandem on paved surfaces, the Director may waive the space where no feasible location exists, and replacement parking for a converted garage cannot be required (Gov. Code 66314(d)(11)). Because studios are exempt, one space per unit stays within the Gov. Code 66314(d)(10) cap of one per unit or per bedroom.

SVMC § 9-44.160 Tables 4-4 and 4-4.5 with footnotes **** and 1, as restated by Ord. 1373; § 9-34.060; Gov. Code 66314(d)(10)-(11), 66322(a)
Approval process
Permitted use

ADUs and JADUs are approved by right: SVMC 9-44.160(A)(3) and (A)(5) as restated by Ord. 1373 call for a ministerial Zoning Clearance with the building permit and approval or denial within 60 days of a complete application, without discretionary review or a hearing. HCD's 9-1-2026 finding 1 says the ordinance omits the 15-business-day completeness determination and the appeal process of Gov. Code 66317 and 66320, which apply directly regardless. ADUs and JADUs are exempt from the Measure N Residential Building Permit Allocation System (SVMC 9-36.020(A)(2)), and there is no coastal zone in Simi Valley.

SVMC § 9-44.160(A)(3), (A)(5) as restated by Ord. 1373; § 9-36.020(A)(2); Gov. Code 66317, 66320; HCD findings letter of 9-1-2026, finding 1
Rental restrictions
Long-term rentals allowed; state-exempt ADUs and JADUs need terms longer than 30 days (no STR); local-track ADUs can get an annual city STR permit under Ord. 1370; no separate sale

Ord. 1373 dropped the old rule that every ADU and JADU be rented for 30 days or more: SVMC 9-44.160(A)(7) now defers to state law, which requires terms longer than 30 days for state-exempt units (Gov. Code 66323(e)) and JADUs (Gov. Code 66333(g)), while local-track ADUs carry no local minimum (Gov. Code 66315 makes one optional). Ord. 1370 (adopted 6-8-2026, effective 7-9-2026) made short-term rentals of 30 days or less a permitted use in residential zones with an annual city permit (new SVMC Chapter 5-46), and the Director must deny a permit for any ADU or JADU that state law limits to terms longer than 30 days, so only local-track Class 2 and Class 3 ADUs qualify; the Council did not adopt the Planning Commission and Neighborhood Council suggestion to bar those ADUs too. Each person may hold one STR permit citywide, so an owner can short-term rent the house or the ADU but not both, and a permit needs a transient occupancy registration certificate (10 percent TOT), $500,000 of liability insurance and a Building Official inspection; staff recommended that operators be required to hold permits by 1-1-2027. ADUs cannot be sold separately (no Gov. Code 66342 condominium opt-in), and the city asks owners to complete an ADU Occupancy and Rents Survey for its Housing Element reporting.

SVMC § 9-44.160(A)(7) as restated by Ord. 1373; Ord. 1370 (SVMC §§ 5-46.05, 5-46.06, 5-46.07(b)(2), 5-46.08(d), § 9-24.030 Table 2-2, § 9-80.020); § 3-5.303; Gov. Code 66314(d)(1), 66315, 66323(e), 66333(g)
The fine print: 11 caveats that can change the picture
  • Operative text: SVMC 9-44.160 as repealed and restated in its entirety by Ord. 1373 (Z-S-2026-0001; Planning Commission recommendation 4-8-2026, introduced 6-22-2026, adopted 7-27-2026 on a 5-0 vote, effective 8-27-2026), which also removed JADUs from the RH and RVH zones in Table 2-2 and rewrote the 9-80.020 definitions of detached ADU, kitchen and efficiency kitchen. Municode (Supp. 52, codified through Ord. 1367 of 3-9-2026, online 9-4-2026) still prints the 2023 Ord. 1349 version of 9-44.160, and the city has posted no signed copy of Ord. 1373, so the adopted text is the 7-27-2026 second-reading packet on the city's Granicus portal.
  • HCD findings on Ord. 1373: HCD's 9-1-2026 letter (ADU0009118, simi-valley-adu-findings-090126.pdf, which misnumbers the ordinance as 'No. 1737') lists three violations: 9-44.160(A)(5) omits the Gov. Code 66317 and 66320 completeness and appeal steps; Section C must allow at least one 66314 unit in combination with the 66323 units on single-family and multifamily lots; and the (F)(1)(a) lot-coverage limit must yield to the 66321(b)(3) guarantee of an 800 sq ft ADU with 4-ft side and rear setbacks. State law controls on all three points. The city's response was due 10-1-2026; no response, amendment or resolution with findings appears in the Council record through 9-28-2026 or on Planning Commission agendas through 10-7-2026.
  • Gov. Code 66326(d) exposure: if the city did not answer HCD's 9-1-2026 findings within 30 days, Ord. 1373 is null and void and the city must apply the state standards (detached up to 1,200 sq ft on any lot, attached up to 50 percent of the home with the 850 and 1,000 sq ft floors), which would lift the 1,000 sq ft cap on lots of 8,000 sq ft or less. The city answered HCD's 2025 findings in 22 days (letter of 11-20-2025) and told HCD it applies state ADU law directly where its code conflicts, so a timely response is likely but unconfirmed; re-check the HCD index and dashboard and the Council record by 2026-11-15.
  • Hillside lots: 9-44.160(A)(8) limits ADUs on lots subject to the Hillside Performance Standards (Chapter 9-32: parcels outside the valley-floor boundary line, minus the 9-32.040 exceptions such as residential lots legally subdivided by 7-21-1986 that need no grading on visually prominent ridgelines, on slopes over 20 percent or over 1,000 cubic yards) to Gov. Code 66323 units: internal conversions, JADUs and one detached unit up to 800 sq ft. Local-track Class 2 and Class 3 units are unavailable there; HCD has not commented on the clause.
  • Local-track design rules (Table 4-4.5) apply only to Class 2 and Class 3 units: a 20-ft front setback (waived for Class 3 units of 800 sq ft or less), a 6-ft separation for detached units that cannot be used to preclude an 800 sq ft ADU, matching materials and colors (Class 3) or one shared material and color (Class 2), no windows above the first 10 vertical feet of a wall plane, no second-story windows facing neighbors without 10-ft side and 20-ft rear setbacks, and a street-facing entrance only where it is the sole location meeting building-code egress. State-exempt units get only 4-ft side and rear setbacks and the one-story 18-ft limit; Table 4-4 says no other local development or design standards apply to them.
  • Stale city materials: the Planning Division page still says the ADU ordinance is 'currently undergoing updates' and sends readers to the Municode text and the July 2023 ADU Guide (showpublisheddocument 23858), which print the superseded Ord. 1349 rules (one ADU or JADU per lot unless the ADU is a detached 800 sq ft unit, an 800 sq ft attached floor, 800 sq ft caps beside SB 9 units and on hillside slopes, universal JADU owner occupancy, and a 30-day rental minimum for every unit). The guide is not curated; read the Ord. 1373 text instead.
  • Unit counts and 2026 chaptered law: Section C defers to Gov. Code 66323(a) 'as may be amended'. Staff told the Planning Commission on 4-8-2026 that a lot can hold one state-exempt and one local-track detached ADU but not two state-exempt detached units; AB 956 (Ch. 791, Stats. 2026, effective 1-1-2027) raises the 66323 count to two detached new-construction ADUs on a single-family lot with no JADU owed where two exist, so that reading changes on 1-1-2027 without local action. SB 1117 (Ch. 809, Stats. 2026, effective 1-1-2027) limits impact fees on ADUs over 750 sq ft to the area above 750 sq ft; 9-44.160 has no fee formula of its own. Re-check both on or after 1-1-2027.
  • SB 9 interplay: SVMC 9-24.080(E) (Ord. 1352, unchanged by Ord. 1373) allows one ADU per primary unit in a Two-Unit Residential Development and up to four units per parcel including ADUs, but only two dwelling units (ADUs included) on each parcel created by an urban lot split; the urban lot split also carries a three-year owner-occupancy requirement that does not apply to ordinary ADUs.
  • Short-term rentals: Ord. 1370 (Z-S-2025-0006; adopted 6-8-2026, effective 7-9-2026) adds STRs to Table 2-2 as a permitted use in OS, RE, RVL, RL and RM and, excluding apartments, in RMod, RH, RVH and MH, defines an STR as occupancy for 30 consecutive days or less, and adds SVMC Chapter 5-46 (annual permit, nuisance response plan, TOT registration, $500,000 insurance, Building Official inspection before issuance and each renewal, two adults and two children under 12 per bedroom, vehicles limited to off-street spaces). The Planning Commission (3-4-2026) had recommended a citywide ban, which the Council rejected. Staff recommended enforcement with permits required by 1-1-2027, and the November 2026 ballot carries a measure raising the TOT from 10 to 12 percent.
  • Codification watch: when Municode codifies Ords. 1368 to 1374, Table 2-2 will need two different note (7) texts (Ord. 1370's apartment exclusion for STRs and Ord. 1373's single-family limit for JADUs), and the 9-44.160 node (TIT9DECOSIVAMUCO_CH9-44STSPLAUS_9-44.160ACDWUNMI, still titled 'Accessory Dwelling Units (Ministerial)') should then replace the Granicus packet as the directory's code link.
  • Record discrepancies: Ord. 1373's recital dates HCD's first letter 10-25-2025 and the 6-22-2026 staff report says 10-30-2025, while the letter itself is dated 10-29-2025 (HCD's dashboard lists 10-30-2025). Separate sale: the city has no Gov. Code 66342 condominium opt-in, and the JADU deed restriction bars selling a JADU apart from the house.

Summarized from Simi Valley's ordinance text, read October 2026; every row links the code section it came from. Rules often vary by zone and lot, so treat this as orientation, not a permit determination, and confirm with the planning department before you commit to a design.

California statewide law also applies

California sets baseline ADU rights at the state level. Where local rules are stricter than state law allows, state law usually wins, so both are worth reading.
