ADU rules in South Gate
These are the primary sources for accessory dwelling unit regulations in South Gate: the city's own zoning code, planning department pages, and permit guides. Start here before talking to anyone: the rules below are what your permit reviewer will apply.
Rules at a glance
South Gate allows a detached ADU on any lot with a proposed or existing primary dwelling in a zone where residential use is permitted or conditionally permitted (SGMC 11.43.030(A), restated by Ord. No. 2025-01-CC, adopted 10-14-2025). On single-family lots the code lists a detached new-construction unit of up to 800 sq ft with 4-ft side and rear setbacks (11.43.030(B)(1)(b)); a larger detached unit follows the 850/1,000 sq ft caps, 4-ft side and rear setbacks, 6-ft building separation and 16-ft height in 11.43.050. Lots with an existing multifamily building may add up to eight detached ADUs (never more than the existing unit count), and lots with a proposed multifamily building two (11.43.030(B)(2)(b)). The 2018 use table that still shows 'Second Dwelling Unit' as permitted only in the NL zone yields to 11.43.030(A) and Gov. Code 66314 and 66323.
SGMC § 11.43.030(A), (B)(1)(b), (B)(2)(b) (Ord. No. 2025-01-CC, 10-14-2025); Gov. Code § 66323(a)(2), (a)(4)Conversions inside the existing or proposed home or an accessory structure (with up to 150 sq ft added for access) are allowed together with a JADU (11.43.030(B)(1)(a)), and an ADU attached to an existing home is capped at the smaller of 850/1,000 sq ft or 50 percent of the home (11.43.050(A)(2)). In existing multifamily buildings at least one ADU and up to 25 percent of the unit count may be created from non-livable space such as storage rooms, attics, basements or garages (11.43.030(B)(2)(a)). The local count rule offers the conversion ADU and the detached 800 sq ft unit as alternatives, but HCD's 3-16-2026 findings (item 3) say SB 543 lets them combine and that one more ADU under Gov. Code 66314 (detached, attached or conversion) may be added. Attached units may not change street-facing walls or existing floor and roof elevations (11.43.050(L)(1)), a design rule HCD says cannot reach state-exempt 66323 units.
SGMC §§ 11.43.030(B)(1)(a), (B)(2)(a), 11.43.050(A)(2), (L)(1); Gov. Code §§ 66314, 66323(a)(1), (a)(3)SGMC 11.43.050(A)(1) caps an ADU's total floor area at 850 sq ft with one bedroom or less and 1,000 sq ft with more than one bedroom, and (A)(2) limits an ADU attached to an existing home to the smaller of that figure or 50 percent of the home's floor area; Gov. Code 66321(b)(3) still guarantees at least 800 sq ft of interior livable space with 4-ft side and rear setbacks. The detached new-construction unit on a single-family lot is capped at 800 sq ft (11.43.030(B)(1)(b)), accessory structures on single-family lots may be converted and expanded to 1,000 sq ft (11.43.050(G)(1)), and JADUs at 500 sq ft. Heights are 16 ft detached, 18 ft within half a mile of a major transit stop or high-quality transit corridor (plus 2 ft for a roof pitch matching the house) or beside a multistory multifamily building, and for attached units 25 ft or the zone limit if lower, never more than two stories (11.43.050(E)). HCD's findings (items 2 and 7) say the caps must be measured in interior livable space and cannot apply to conversions or to detached units on multifamily lots under 66323(a)(4), which carry no state size cap.
SGMC §§ 11.43.050(A), (E), (G)(1), 11.43.030(B)(1)(b); Gov. Code §§ 66321(b), 66323(a)(2); HCD findings letter 3-16-2026, items 2 and 7SGMC 11.43.040(G)(1) says no owner must live in either the main home or the ADU, matching Gov. Code 66315. The codified 11.43.040(G)(2) still requires owner occupancy for every JADU, but Gov. Code 66333(b) as amended by AB 1154 (effective 1-1-2026) allows that requirement only when the JADU shares sanitation facilities with the main home; HCD's finding 5 flags the clause and the pending 2026 amendment narrows it accordingly. A JADU still needs a recorded deed restriction barring separate sale and fixing its size (11.43.040(F)), and an ADU sold separately to a qualified buyer under 11.43.040(H) must be the buyer's principal residence.
SGMC § 11.43.040(F), (G), (H)(3)(c); Gov. Code §§ 66315, 66333(b)Ord. No. 2025-01-CC reversed the 2021 no-parking rule: SGMC 11.43.050(H) now requires one off-street space per ADU, which may be tandem on a driveway or in setback areas. The six state exemptions are copied in: within one-half mile walking distance of public transit (11.43.020(V) counts any fixed-route bus stop), in a historic district, part of the proposed or existing home or an accessory structure, where on-street permits are required but not offered, within one block of a car share vehicle, or applied for together with a new single-family or multifamily dwelling; JADUs need none and garage spaces lost to an ADU need not be replaced. In a preferential parking district only the primary dwelling and the first permitted ADU get residential permits (8.12.090(E)(2)(a)), so a second ADU there qualifies for the permit exemption. On a plain reading the flat one-space rule exceeds Gov. Code 66314(d)(10)(A) (one space per unit or per bedroom, whichever is less) for studios and cannot reach state-exempt 66323 units (66323(b)), although HCD's March 2026 letter did not raise parking.
SGMC §§ 11.43.050(H), 11.43.020(V), 11.33.090 (Table 11.33-6), 11.33.100 (Table 11.33-7), 8.12.090(E)(2)(a); Gov. Code §§ 66314(d)(10)-(11), 66322(a), 66323(b)SGMC 11.43.060(A) requires a complete application to be approved or denied within 60 days and considered and approved ministerially, without discretionary review or hearing; the Community Development Director issues the ADU permit (11.43.020(B)) and may attach only conditions consistent with the chapter (11.43.060(C)), and a denial must list the deficiencies and how to cure them (11.43.060(D)). In practice plans go to Planning plan check by email (about two weeks), then Building and Safety plan check and a building permit, and the city offers pre-approved garage-conversion standard plans and a permit-ready new ADU plan for single-family parcels. Gov. Code 66317 adds the 15-business-day completeness notice and an appeal path; HCD's finding 12 notes the local delay rule covers only a new single-family home, not a new multifamily building.
SGMC §§ 11.43.060(A), (C), (D), 11.43.020(B); Gov. Code § 66317SGMC 11.43.040(C) lets an ADU be rented separately from the main home for terms of not less than thirty days and bars selling or conveying it separately except under 11.43.040(H), the qualified-buyer and qualified-nonprofit path that mirrors Gov. Code 66341; South Gate has not opted into 66342 ADU condominiums. The 30-day floor is lawful for ordinary ADUs under 66315, but 66323(e) and 66333(g) require terms longer than 30 days for state-exempt units and JADUs, so the local text is one day short for those. The code has no short-term rental chapter, the residential zone use table lists no lodging use and 11.21.020(B) bars unlisted uses, and code searches found no rent stabilization, just-cause or rental registry ordinance.
SGMC §§ 11.43.040(C), (F), (H), 11.21.020(B) and Table 11.21-5; Gov. Code §§ 66315, 66323(e), 66333(g), 66341The fine print: 11 caveats that can change the picture
- Which text governs: Chapter 11.43 as restated by Ord. No. 2025-01-CC (introduced 9-23-2025, adopted on consent 10-14-2025 by a 5-0 roll call, effective 30 days after final passage under its Section 5) with the clauses HCD flagged on 3-16-2026 yielding to state law. HCD's index (current to 7-14-2026) records the city's response as received (copy only by PRA request, response date not public) and the dashboard shows no later ADU letter, so the Gov. Code 66326(d) null-and-void route does not appear to have been triggered.
- Pending amendment: the Planning Commission heard a Chapter 11.43 zoning code amendment (Resolution No. 2026-11) on 9-15-2026 to answer HCD and the 2025 bills (AB 130, AB 462, AB 1154, SB 543, SB 9). The posted resolution's vote lines are blank and no council introduction appeared on agendas through 9-22-2026. The clean draft adds 'any combination' wording to 11.43.030(B), limits JADU owner occupancy to shared sanitation, exempts 66323(a)(4) units from the size caps and 66323 units from the separation and design rules, and moves the fee threshold to 750 sq ft of interior livable space, but it keeps the 850/1,000 'total floor area' wording, the one-space parking rule and the 30-day rental floor. Re-check after council adoption and the 60-day HCD submission.
- Stale use tables: Table 11.21-5 (last amended Ord. 2351, 6-26-2018) still lists 'Second Dwelling Unit (A-P)' as permitted in NL only and 'X' (not permitted) in NM, MH, CV and OS, and the urban mixed-use table has no ADU row, while 11.21.020(B) bars unlisted uses. SGMC 11.43.030(A) (2025) and Gov. Code 66314 and 66323(a) allow ADUs wherever residential or mixed-use development is allowed, including the multifamily NM zone, so the table entries yield. The 2026 Title 11 work program (PC study sessions 3-17 and 4-7-2026, council report 7-28-2026) leaves the row untouched.
- Unit counts: 11.43.030(B)(1)(b) offers the detached 800 sq ft unit 'as an alternative to (but not in addition to)' the conversion ADU, and 11.43.030(B)(2) describes only the 66323 multifamily counts. Gov. Code 66323(a) as amended by SB 543 requires ministerial approval of 'any combination' of those units, and HCD's findings (items 3 and 4) add that a 66314 ADU may be built on top of them; the local limits yield. AB 956 (Chapter 791, Statutes of 2026, effective 1-1-2027) raises the state-exempt count to two detached new-construction ADUs on a single-family lot, so the local one-unit wording falls further behind on that date.
- Measurement: Chapter 11.43 states caps as 'total floor area', while Gov. Code 66321(b) and 66313(d) set the 850/1,000 sq ft floors, the 800 sq ft unit and the 500 sq ft JADU in interior livable space (HCD items 2 and 7). The 50 percent attached limit cannot push an attached ADU below 800 sq ft of interior livable space (66321(b)(3)), and the caps cannot apply to conversions or to detached ADUs on multifamily lots under 66323(a)(4).
- State-exempt units: Gov. Code 66323(b) bars standards not authorized by 66323, so the 6-ft separation (11.43.050(D)), the design rules (11.43.050(L)) and, on a plain reading, the one-space parking rule do not apply to 66323 units (HCD items 8 and 9; HCD did not address parking). HCD item 10 also calls the 11.43.050(L)(3)-(6) design standards subjective ('consistent with the design and character', 'substantially the same', 'similar to and compatible'). The 11.43.050(L)(1) bar on changing existing roof elevations may collide with the 25-ft attached height floor in 66321(b)(4)(D) for an upper-story attached ADU.
- JADU owner occupancy and rentals: the codified 11.43.040(G)(2) universal JADU owner-occupancy rule yields to Gov. Code 66333(b) (only where sanitation is shared), and the 11.43.040(C) 'not less than thirty days' floor is one day short of the longer-than-30-day terms 66323(e) and 66333(g) require for state-exempt units and JADUs.
- Fees and utilities: 11.43.050(Q)(4) exempts only ADUs 'less than seven hundred fifty square feet' and charges proportional fees from 750 sq ft, while Gov. Code 66311.5(c) exempts ADUs of 750 sq ft of interior livable space or less and JADUs of 500 or less (HCD item 11); SB 1117 (Chapter 809, Statutes of 2026, effective 1-1-2027) limits fees on larger ADUs to the area above 750 sq ft. The separate-utility-connection clause in 11.43.040(H)(5) cannot reach 66323(a)(1) conversion units (66311.5; HCD item 6).
- Process gaps: 11.43.060(A) lets the city delay an ADU only while a new single-family dwelling application is pending, while Gov. Code 66317(a)(3) also covers a new multifamily dwelling (HCD item 12); SB 543's 15-business-day completeness notice and appeal path apply although the chapter does not restate them.
- Dates disagree across records: the 10-14-2025 minutes record adoption of Ord. No. 2025-01-CC on consent, the eCode360 history line says 10-14-2025, HCD's letter says 'adopted October 22, 2025', and the 9-15-2026 Planning Commission agenda bill says the council adopted it 9-23-2025 (the introduction) and that it took effect 10-14-2025. Agendas also misprint the number as 2025-01-0CC.
- City guidance: the retired Planning-OLD ADU page (stored link, replaced) still prints the either-or JADU count and links a dead Chapter 11.43 copy, and the January 2021 ADU and JADU handout (dropped) states the 2021 rules (no parking, 1,000 sq ft detached, deed restriction with owner occupancy). The city's pre-approved standard and permit-ready plans apply only to parcels with an existing or proposed single-family dwelling.

California statewide law also applies
California sets baseline ADU rights at the state level. Where local rules are stricter than state law allows, state law usually wins, so both are worth reading.
