ADU rules in Upland
These are the primary sources for accessory dwelling unit regulations in Upland: the city's own zoning code, planning department pages, and permit guides. Start here before talking to anyone: the rules below are what your permit reviewer will apply.
Rules at a glance
Detached ADUs are permitted on lots with a proposed or existing single-family or multifamily home in every RS and RM zone except the RS-MH mobile home zone, and in the B/R-MU mixed-use zone. A state-exempt Class 1 unit (Gov. Code 66323) can be up to 800 sq ft of livable space with 4-foot side and rear setbacks on a single-family lot, and multifamily lots get up to two detached units (proposed building) or up to eight (existing building, not more than its unit count). Any other detached ADU is a locally regulated Class 2 unit under 17.37.070 (850 or 1,000 sq ft, one story, 4-foot side and rear and 25-foot front setbacks, design rules), and from 10-14-2026 eligible RS-10, RS-15 and RS-20 lots over 15,000 sq ft can add one deed-restricted bonus unit.
UMC §§ 17.37.050(A)(2), (A)(4) and (B), 17.37.060(A) (Ord. No. 2009 § 4, Exhibit A, adopted 3-9-2026, in force about 4-8-2026; restated verbatim by Ord. No. 2014 § 4, Exhibit A, adopted 9-14-2026, effective 10-14-2026); UMC § 17.04.020, Table 17.04-1Attached additions are Class 2 units capped at 850 or 1,000 sq ft and at 50 percent of the existing home, never forced below 800 sq ft, up to 25 feet or the zone height (whichever is lower) and two stories; balconies and roof decks are prohibited. Conversions of space inside a proposed or existing house or an existing accessory structure (plus up to 150 sq ft for ingress and egress) are Class 1 units with no size cap, and one JADU of up to 500 sq ft may be added inside a single-family home or its attached garage. JADUs are limited to lots zoned for single-family residences.
UMC §§ 17.37.030 (JADU), 17.37.050(A)(1), 17.37.060(A)(3) and (B)(4), 17.37.070(A) and (H)(5) (Ord. No. 2009 § 4, Exhibit A, adopted 3-9-2026, in force about 4-8-2026; restated verbatim by Ord. No. 2014 § 4, Exhibit A, adopted 9-14-2026, effective 10-14-2026)Upland splits ADUs into Class 1 (Gov. Code 66323 state-exempt units) and Class 2 (locally regulated under 66314 to 66322); the 850/1,000 sq ft caps, the 50 percent attached cap and the lot coverage limits (35 percent in RS-15 and RS-20, 40 in RS-10, 45 in RS-7.5 and B/R-MU, 50 in RS-4) apply only to Class 2 units and yield to the 800 sq ft floor. A Class 1 detached unit is capped at 800 sq ft of livable space, conversions have no cap beyond the existing space plus 150 sq ft, and a JADU is capped at 500 sq ft of interior livable space. Detached ADUs may be 16 feet tall (18 feet within a half mile of a major transit stop or high-quality transit corridor plus 2 feet for a matching roof pitch, or 18 feet on a lot with a multistory multifamily building), and Class 2 units are one story unless attached. From 10-14-2026 a bonus ADU (Ord. 2014) is capped at 800 sq ft and a bonus JADU at 500 sq ft.
UMC §§ 17.37.030, 17.37.050(A)(1)-(2), 17.37.060(B), 17.37.070(A), (D) and (K) (Ord. No. 2009 § 4, Exhibit A, adopted 3-9-2026, in force about 4-8-2026; restated verbatim by Ord. No. 2014 § 4, Exhibit A, adopted 9-14-2026, effective 10-14-2026); § 17.37.110(D)(5) (Ord. No. 2014)ADUs carry no owner-occupancy requirement at application or afterward, consistent with Gov. Code 66315. A JADU requires the owner to live in the house or the JADU only when the JADU shares sanitation facilities with the main home (or not at all when a government agency, land trust or housing organization owns the property), matching Gov. Code 66333(b) as amended by AB 1154 and SB 543. Ord. 2009 also limited the recorded deed restriction to JADUs after HCD's 7-8-2025 finding that an ADU deed restriction is an unlawful extra standard; the eCode360 text still prints the superseded universal JADU rule and ADU deed restriction. The 10-14-2026 bonus program adds an affordability deed restriction, not an owner-occupancy rule.
UMC § 17.37.060(G) and (H) (Ord. No. 2009 § 4, Exhibit A, adopted 3-9-2026, in force about 4-8-2026; restated verbatim by Ord. No. 2014 § 4, Exhibit A, adopted 9-14-2026, effective 10-14-2026); Gov. Code §§ 66315, 66333(b)The parking rule sits in 17.37.070, which applies only to Class 2 ADUs, so Class 1 units and JADUs need no space. A Class 2 ADU needs one off-street space (tandem or in setback areas allowed) unless it is within a half-mile walk of public transit, in a historic district, part of the existing or proposed home or an accessory structure, where on-street permits are required but not offered, within one block of a car share stop, or applied for together with a new home, which mirrors Gov. Code 66322(a)(1)-(6); because the rule is one space per ADU or per bedroom, whichever is less, a studio arguably needs none. Garages, carports or uncovered spaces removed or converted for an ADU need not be replaced. From 10-14-2026 a bonus ADU or bonus JADU must provide one space; the older Table 17.11-1 row ('Second Dwelling Unit: 1 space in addition to that required for a single-family unit') is superseded by Chapter 17.37.
UMC § 17.37.070 (preamble) and (G) (Ord. No. 2009 § 4, Exhibit A, adopted 3-9-2026, in force about 4-8-2026; restated verbatim by Ord. No. 2014 § 4, Exhibit A, adopted 9-14-2026, effective 10-14-2026); § 17.37.110(D)(3) (Ord. No. 2014); Gov. Code §§ 66314(d)(10)(A), 66322(a)Every ADU and JADU needs a ministerial ADU permit plus a building permit, approved without discretionary review or a hearing: the city must decide completeness within 15 business days and approve or deny a complete application within 60 days, with written appeals of incompleteness or denial decided by the Planning Commission within 60 business days, as Gov. Code 66317 requires. A unit that does not meet the objective standards may instead seek a conditional use permit under 17.37.100 (an optional path, not a requirement). The ADU permit fee on the city's application form (Rev. 05/25) is $1,160.
UMC §§ 17.37.040(A)-(C), 17.37.100 (Ord. No. 2009 § 4, Exhibit A, adopted 3-9-2026, in force about 4-8-2026; restated verbatim by Ord. No. 2014 § 4, Exhibit A, adopted 9-14-2026, effective 10-14-2026); Gov. Code § 66317Chapter 17.37 bars renting any ADU or JADU for less than 30 days regardless of when it was built, and the STR chapter (Ord. 1945, 2020) defines a short-term rental as 30 consecutive days or less and says an ADU shall not be used as one, so leases must run longer than 30 days; that satisfies the longer-than-30-days rule Gov. Code 66323(e) and 66333(g) impose for state-exempt units and JADUs. STR permits (Administrative Use Permit, business license, transient occupancy tax) go only to hosted or un-hosted stays in the host's primary residence, and vacation rentals are prohibited. ADUs and JADUs cannot be sold separately except under Gov. Code 66341; Upland has not opted into 66342 ADU condominiums, and Ord. 2009 repealed the annual rent-reporting rule. From 10-14-2026 a bonus ADU or JADU must be deed-restricted for at least 10 years as affordable to lower-income households at a rent not exceeding 80 percent of Area Median Income.
UMC § 17.37.060(D)-(E) (Ord. No. 2009 § 4, Exhibit A, adopted 3-9-2026, in force about 4-8-2026; restated verbatim by Ord. No. 2014 § 4, Exhibit A, adopted 9-14-2026, effective 10-14-2026); § 17.37.110(C)(4) (Ord. No. 2014); UMC §§ 17.23.1.010, 17.23.1.020 and 17.23.1.090(I) (Ord. 1945)The fine print: 11 caveats that can change the picture
- Codification lag: eCode360 (book through Ord. No. 2002 of 9-22-2025) still prints the Ord. 1993 version of Chapter 17.37 (ADU deed restriction, annual rent reporting, one space per ADU, universal JADU owner occupancy, building-permit-only categories). The operative text is Ord. 2009 (adopted 3-9-2026, in force about 4-8-2026), restated verbatim with a new 17.37.110 Bonus ADU Program by Ord. 2014 (adopted 9-14-2026, effective 10-14-2026); both are only in the platform's New Laws bank.
- Two tracks: Class 1 units (Gov. Code 66323 categories, which may be combined as 66323(a) allows) get only the general rules in 17.37.060, while Class 2 units must also meet 17.37.070: 850/1,000 sq ft, 50 percent attached cap, 4-foot side and rear, 25-foot front and 15-foot street-side setbacks, 7-foot separation from the home and 6 feet from other accessory buildings, lot coverage and outdoor living space minimums, matching roof slope, materials and colors, privacy screening and one story unless attached.
- Zones: Table 17.04-1 bars ADUs in the RS-MH zone, and Table 17.05-1 shows ADUs as not allowed in the C/R-MU, C/O-MU and C/I-MU mixed-use zones (permitted only in B/R-MU), while 17.37.060(A)(1) and Gov. Code 66323(a) require Class 1 units to be approved in any residential or mixed-use zone; the state rule controls for those units. JADUs are limited to lots zoned for single-family residences.
- Legacy specific-plan text: UMC 18.08.050(G) still lists a 'second dwelling unit' in the SFR-10 and SFR-7.5 specific-plan zones as a conditional use under the defunct Chapter 17.120, and 18.60.010 bars second units in San Antonio Lakes outside those zones. These predate state ADU law and yield to Gov. Code 66314, 66317 and 66323 and to the ministerial process in 17.37.040.
- Historic properties: a Class 2 ADU on or within 600 feet of a property listed in the California Register of Historical Resources must not be visible from any public right-of-way (17.37.070(J), a standard 66314(b)(1) allows). The city's 2023 guide also says ADUs on local historic properties or in historic districts need a Certificate of Appropriateness under 17.26.110 (Director review that may be referred to the Planning Commission), a discretionary step Gov. Code 66317 does not contemplate if applied to an ADU.
- Fees: 17.37.080(A) waives impact fees only for an ADU 'less than 750 square feet' of interior livable space, while Gov. Code 66311.5(c)(1) bars fees on units of 750 sq ft or less, a one-square-foot conflict the state rule controls; JADUs are exempt.
- Rental terms: the 30-day floor in 17.37.060(D) is one day short of the longer-than-30-days terms Gov. Code 66323(e) and 66333(g) require for Class 1 units and JADUs, but the STR chapter's ADU bar already requires more than 30 days for every ADU, which for Class 2 units goes one day past the 30-days-or-longer limit Gov. Code 66315 allows.
- Chaptered 2026 law effective 1-1-2027: AB 956 (Ch. 791, Stats. 2026) amends Gov. Code 66323 to allow two detached new-construction ADUs on a single-family lot under the exempt pathway, so the one-unit count in 17.37.050(A)(2) will yield, and extends the Civ. Code 714.3 and 4751 CC&R anti-restriction rule; SB 1117 (Ch. 809, Stats. 2026) amends 66311.5 so impact fees on an ADU over 750 sq ft apply only to the area above 750 sq ft, overriding the whole-unit proportional formula in 17.37.080(A)(3).
- HCD: findings of 7-8-2025 on Ord. 1993 (severability clause, attached and detached definitions, primary-dwelling definition, ADU deed restriction, completeness) were answered by Ord. 2009, which HCD called substantially compliant on 5-8-2026. Ord. 2014 must reach HCD within 60 days of adoption (by about 11-13-2026) under Gov. Code 66326(a) and its Section 6; no submission or letter was public on 2026-10-07, so re-check the dashboard after that date.
- Bonus ADU Program (17.37.110, effective 10-14-2026): lots over 15,000 sq ft in the RS-10, RS-15 or RS-20 zones with a single-family home may add one bonus ADU or JADU beyond the state-required units (800 or 500 sq ft, in the rear yard or behind the front plane of the house, 7-foot separation, one parking space, 35 or 40 percent lot coverage unless waived, no separate sale), deed-restricted for at least 10 years at a rent not exceeding 80 percent of AMI; staff estimated about 1,940 eligible lots.
- Stale official materials: the uplandadu.org guide (April 2023 standards sheet, Guidebook Version 1.0 of March 2023, Rent page requiring a deed restriction and annual rent reports), the 'ADU Process at a Glance' PDF linked from the city ADU page (an excerpt of the 2023 guidebook) and the ADU application form (Rev. 05/25, still offering a 'Building Permit Only' track and a rent-amount field) all predate Ord. 2009. The pre-approved plans cannot be used in high fire hazard areas and assume 5-foot side and rear setbacks.
Summarized from Upland's ordinance text, read October 2026; every row links the code section it came from. Rules often vary by zone and lot, so treat this as orientation, not a permit determination, and confirm with the planning department before you commit to a design.

California statewide law also applies
California sets baseline ADU rights at the state level. Where local rules are stricter than state law allows, state law usually wins, so both are worth reading.
