Rules at a glance

Detached (backyard) ADU
Allowed

Detached ADUs are a permitted ("P") use in every residential district on Table 7-1 (AE, SR, R1, R2, R3, R4, MDR and RMPD), and sec. 16-3.07.030(a)(4)(xii) lets an ADU be "either attached or detached from the primary dwelling or converted from existing space within the primary dwelling." Ordinance No. 2469 (adopted 9-1-2026, effective 10-1-2026) keeps the local count of one ADU plus one JADU per single-family lot but adds "unless otherwise allowed by State ADU Law," so the Gov. Code sec. 66323(a) combination of a conversion ADU, one detached new-construction ADU and a JADU still applies. On a lot with an existing multifamily building the same ordinance raised the detached count from two to eight, never more than the number of existing units. The land use table lists no ADUs in the commercial, industrial, public and civic, or Health and Wellness Overlay districts.

Victorville Municipal Code sec. 16-3.07.010 (Table 7-1); sec. 16-3.07.030(a)(2)(i), (a)(4)(v), (a)(4)(vi), (a)(4)(xii), as amended and renumbered by Ord. No. 2469
Attached or internal ADU
Allowed

Attached ADUs, including additions and conversions of space inside the house or an attached garage, are permitted in the same residential districts under sec. 16-3.07.030(a)(4)(xii) and the attached-unit standards in (a)(5): 4 ft side and rear setbacks for new space, none for converted space, and a height of 25 ft or the zone height for the main house, whichever is lower. JADUs of up to 500 sq ft of interior livable space must sit within the walls of an existing or proposed single-family home and are limited to lots zoned for single-family use (Table 8-3 allows one in AE, S-R, R-1, R-MPD and single-family sites in MDR, and none in R-2, R-3 or R-4). In a mixed-use zone an ADU may occupy only the residential area, never converted commercial, parking or storage space.

Victorville Municipal Code sec. 16-3.07.030(a)(4)(iii), (a)(4)(iv), (a)(4)(xii), (a)(5), (a)(7)(i); sec. 16-3.08.020 (Table 8-3), as amended by Ord. No. 2469
Maximum size
850 sq ft (studio or one bedroom) or 1,000 sq ft (more than one bedroom), attached or detached; JADU 500 sq ft; height 16 ft detached (18 ft with a roof pitch matching the house), 25 ft attached

Sec. 16-3.07.030(a)(5)(i) and (a)(6)(i) cap attached and detached ADUs at 850 sq ft with one bedroom or less and 1,000 sq ft with more than one bedroom, each now qualified by "unless otherwise permitted by State ADU Law"; there is no percent-of-house cap and Table 8-3 sets no lot coverage limit. Those figures equal the Gov. Code sec. 66321(b)(2) floor, which state law states in interior livable space, while Victorville's text (and Table 8-1's "850 sq. ft. maximum") names a measurement basis only for JADUs. Units built under Gov. Code sec. 66323 face only the limits that section allows: a conversion keeps to the existing space plus up to 150 sq ft for ingress and egress, the detached new-construction unit on a single-family lot may be held to 800 sq ft, and the up to eight detached units on a multifamily lot carry only height and setback limits. Detached height is 16 ft, or 18 ft when the roof pitch matches the main house (Table 8-3 note 6, added by Ord. No. 2469) or for multistory development in multifamily districts; attached ADUs may reach 25 ft or the zone height for the main house, whichever is lower.

Victorville Municipal Code sec. 16-3.07.030(a)(5)(i), (a)(5)(iii), (a)(6)(i), (a)(6)(vii), (a)(7)(i); sec. 16-3.08.020 (Tables 8-1 and 8-3), as amended by Ord. No. 2469; Gov. Code sec. 66321(b), 66323(a)-(b)
Owner occupancy
Not required

No owner-occupancy rule applies to ADUs, consistent with Gov. Code sec. 66315. Ordinance No. 2469 narrowed the JADU clause, sec. 16-3.07.030(a)(4)(ix), to a JADU "that shares sanitation facilities with the primary dwelling" (the owner lives in either the house or the JADU), matching Gov. Code sec. 66333(b), and the recorded JADU covenant in (a)(4)(xv) now requires owner occupancy only "to the extent allowed by State ADU Law." Municode (Supp. 57) still prints the earlier universal JADU owner-occupancy clauses until the next supplement codifies the ordinance. The three-year owner-occupancy affidavit in sec. 16-3.08.050 applies to SB 9 urban lot splits, not to ADUs.

Victorville Municipal Code sec. 16-3.07.030(a)(4)(ix), (a)(4)(xv)(c), as amended by Ord. No. 2469; Gov. Code sec. 66315, 66333(b)
Extra parking
None for ADUs or JADUs (citywide)

Table 21-1 in sec. 16-3.21.030 lists "Accessory Dwelling Unit (ADU & JADU)" with a parking requirement of "None," a row added by Ordinance No. 2461 (adopted 11-18-2025, effective 12-18-2025), and the ADU standards table (Table 8-3) defers to that article. Ordinance No. 2469 deleted the last ADU-related parking rule, the duty to replace garage parking when a JADU converts an attached garage. The Planning Commission's 7-8-2026 late addition memorandum states that "parking is not required for ADUs and JADUs." No local rule requires replacing a garage, carport or space demolished or converted for an ADU, and Gov. Code sec. 66314(d)(11) forbids one.

Victorville Municipal Code sec. 16-3.21.030 (Table 21-1, Ord. No. 2461); sec. 16-3.08.020 (Table 8-3); Ord. No. 2469 (deleting former sec. 16-3.07.030(a)(6)(iv))
Approval process
Permitted use

Sec. 16-3.07.030(a)(3), added by Ordinance No. 2469, requires ADU and JADU applications to be "approved or denied ministerially" within 60 days of a complete application, with a completeness decision within 15 business days and written comments on any denial; Table 7-1 marks both uses "P" (permitted) in residential districts. Applications go through Building Division plan check, whose ADU and JADU submittal list asks for a Joshua Tree Inspection Report when square footage is added, grading plans for detached units, and a percolation report or septic tank size where sewer is unavailable. Staff and Building Official decisions can be appealed to the Planning Commission within ten days (sec. 16-2.02.010 to 16-2.02.030 and 16-2.02.050). The Planning Commission's 7-8-2026 memorandum confirms that "the City approval process remains non-discretionary."

Victorville Municipal Code sec. 16-3.07.030(a)(3)(i)-(iii), as added by Ord. No. 2469; sec. 16-3.07.010 (Table 7-1); sec. 16-2.02.010 to 16-2.02.050
Rental restrictions
Rentals of 30 days or more only (longer than 30 days for JADUs and state-exempt units); no short-term rentals; no separate sale; city Rental Business License with annual inspection

Sec. 16-3.07.030(a)(4)(x) lets an ADU or JADU be rented separately but bars separate sale except for a qualified nonprofit sale under state law (Gov. Code sec. 66341); the city has not opted into Gov. Code sec. 66342 ADU condominiums. Sec. 16-3.07.030(a)(4)(xi) sets a rental term of "not less than thirty days" for ADUs and JADUs, which rules out short-term rentals and is lawful for local-track ADUs under Gov. Code sec. 66315, while Gov. Code sec. 66333(g) and 66323(e) require terms longer than 30 days for JADUs and state-exempt units. Victorville has no separate short-term rental ordinance; its business license classification for rental property (sec. 16-7.06.080) lists "short term rental" only as a kind of single-family rental property. Any parcel occupied for rent by someone other than the owner needs a Rental Business License, issued after an initial exterior inspection and renewed yearly after an annual inspection (sec. 16-6.05.030(g), 16-6.05.050 and 16-6.05.070, as amended by Ord. No. 2464 of 4-7-2026).

Victorville Municipal Code sec. 16-3.07.030(a)(4)(x)-(xi), as amended by Ord. No. 2469; sec. 16-6.05.030(g), 16-6.05.050, 16-6.05.070; sec. 16-7.06.080; Gov. Code sec. 66315, 66323(e), 66333(g)
The fine print: 11 caveats that can change the picture
  • Codification lag: Municode (Supp. No. 57, codified through Ord. No. 2466 of 4-7-2026) still prints the pre-2469 text of sec. 16-3.07.030(a), including universal JADU owner occupancy, a two-detached-ADU limit on multifamily lots, a JADU garage-replacement parking rule and legacy Gov. Code sec. 65852.2 citations. The signed Ordinance No. 2469 (effective 10-1-2026) in Municode's ordinance bank controls; it renumbers former subsections (a)(3) to (a)(6) as (a)(4) to (a)(7), and the citations here use the new numbers.
  • HCD submission: Gov. Code sec. 66326(a) requires Victorville to send Ordinance No. 2469 to HCD within 60 days of its 9-1-2026 adoption (by about 10-31-2026); under sec. 66326(d) an unsubmitted ordinance is null and void and the city must apply the state standards alone (sec. 66314(d)(4)-(5): an attached ADU up to 50 percent of an existing house, a detached ADU up to 1,200 sq ft). HCD's 5-11-2026 Technical Assistance letter (dashboard case ADU0008346, labeled a repeal request) said the 2023 ordinance on file might be outdated and asked for a response by 6-10-2026; no response is posted, and the dashboard (newest statewide row 9-23-2026) shows no findings on Ordinance No. 2469.
  • State-exempt units: the applicability clause added by Ordinance No. 2469 (sec. 16-3.07.030(a)(2)) makes units built under Gov. Code sec. 66323 "only subject to those provisions of this Chapter allowed by State ADU law," so the local size caps, the matching colors and materials rules, the separate-entrance rule for attached ADUs (not on the same wall plane as the main entrance) and the bar on converting a house until it is "substandard in size as a single-family residence" (sec. 16-3.07.030(a)(4)(xiv); Table 8-1 sets a 1,400 sq ft single-family minimum) do not bind them. A California Housing Defense Fund comment to the Planning Commission on 7-8-2026 flagged these clauses; the city kept them for local-track units.
  • Height detail: Table 8-3 as amended by Ordinance No. 2469 sets detached ADUs at 16 ft, 18 ft in multifamily districts for development over one story (note 5) and 18 ft when designed to match the roof pitch of the main house (note 6); sec. 16-3.07.030(a)(6)(vii) allows more beside a taller single-story house (up to its height) or where state law permits, as Gov. Code sec. 66321(b)(4)(B) does near major transit (18 ft plus 2 ft for an aligned roof pitch).
  • JADU zoning: sec. 16-3.07.030(a)(4)(iii) and Table 8-3 confine JADUs to lots zoned for single-family use (none in R-2, R-3 or R-4), while Gov. Code sec. 66323(a)(1) requires ministerial approval of a JADU on any lot with a proposed or existing single-family dwelling in a residential or mixed-use zone; the 66323 applicability clause should carry such a JADU.
  • Septic lots: sec. 16-3.07.030(a)(4)(viii) requires a sewer connection "unless sewer is unavailable or unfeasible as determined by the city engineer in conjunction with a variance or other exemption," a step that could add discretion; Gov. Code sec. 66317(a)(1) requires ministerial approval notwithstanding local variance ordinances, and sec. 66323(f) limits the septic showing for state-exempt units to a percolation test no older than five years (ten if recertified).
  • Impact fees: City Council Policy CP-22-01 (attached to the 7-19-2024 Development Advisory on the Building Division's Advisories page) exempts "ADUs less than 750 sq. ft." from development impact fees and capacity charges, one square foot short of Gov. Code sec. 66311.5(c)(1), which bars impact fees on an ADU of 750 sq ft of interior livable space or less and requires proportional fees above that. SB 1117 (Chapter 809, Statutes of 2026, effective 1-1-2027) amends sec. 66311.5 so impact fees on an ADU over 750 sq ft are charged only on the area above 750 sq ft.
  • AB 956 (Chapter 791, Statutes of 2026, effective 1-1-2027) amends Gov. Code sec. 66323 to allow two detached new-construction ADUs on a single-family lot under the state-exempt pathway, with no JADU owed where two exist; from that date the local one-ADU count in sec. 16-3.07.030(a)(4)(v) yields through its "unless otherwise allowed by State ADU Law" clause.
  • SB 9 and small-lot projects (sec. 16-3.08.050, added by Ord. No. 2461): a lot created by an urban lot split may hold no more than two units including ADUs and JADUs, a two-unit project without a lot split may add up to two ADUs or JADUs (four units in all), and no ADU or JADU is allowed on a parcel created through a small-lot subdivision.
  • Specific plans and planned unit developments set their own land uses: Table 7-1 omits SP, PUD, MU1, MU2 and LDRIO (its legend ties MU1, MU2 and LDRIO to R-3, R-4 and R-1 allowances). The Old Town Specific Plan was amended by Ordinance No. 2470 (PLAN26-00013; adopted 9-15-2026, effective 30 days after final passage, about 10-15-2026) to allow ADUs with any residential unit in its RM, RMO, RMH, MUR, MURO, MUS, MUSO and LI districts and JADUs in RM and RMO, with OTSP sec. 4.5.1 applying VMC sec. 16-3.07.030.
  • Re-verification: after about 10-31-2026 confirm that HCD received Ordinance No. 2469 and watch the dashboard for findings; when Municode publishes the next supplement, confirm codification, the renumbered subsections and the new Table 7-1 rows; after 1-1-2027 re-read the 66323 unit count and the impact fee caveat.

Summarized from Victorville's ordinance text, read October 2026; every row links the code section it came from. Rules often vary by zone and lot, so treat this as orientation, not a permit determination, and confirm with the planning department before you commit to a design.

California statewide law also applies

California sets baseline ADU rights at the state level. Where local rules are stricter than state law allows, state law usually wins, so both are worth reading.
