ADU rules in Vista
These are the primary sources for accessory dwelling unit regulations in Vista: the city's own zoning code, planning department pages, and permit guides. Start here before talking to anyone: the rules below are what your permit reviewer will apply.
Rules at a glance
Detached ADUs are permitted in the R-1-B, R-1, E-1, A-1, O-R (open space residential overlay), R-M and M-U zones and in specific plan areas that allow one-family dwellings by right (the city's July 2025 FAQ says specific plans that allow residential uses by right, and the Mar Vista Specific Plan adopted by Ord. 2025-09 allows ADUs under Chapter 18.31). On a single-family lot the code allows one detached new-construction ADU with 4-foot side and rear setbacks, which may be paired with a JADU; Gov. Code 66323(a), as amended by SB 543 effective 1-1-2026, also requires the city to approve it in combination with a converted ADU. On a lot with an existing multifamily building, § 18.31.040.B.1 still caps detached ADUs at two, but 66323(a)(4) allows up to eight (never more than the existing unit count, two beside a proposed multifamily building), and the city's July 2025 FAQ already applies the eight-unit figure. Approval is ministerial (see permitType).
Vista Development Code §§ 18.31.020(A), 18.31.040(A)(2)-(3) and (B)(1) (Ord. 2022-16 as amended by Ord. 2024-02); Gov. Code 66323(a)Attached additions, ADUs within the proposed space of a new home, conversions of existing space in the home or an accessory building (with up to 150 sq ft of expansion for ingress and egress), and ADUs built as a second story over the home or over a detached garage or guesthouse are all allowed; a conversion of existing space is permitted on any lot in a zone that allows one-family or multiple dwellings by right. Existing multifamily buildings may convert non-livable space (storage rooms, attics, basements, garages) into at least one ADU and up to 25 percent of the existing unit count. A JADU of up to 500 sq ft must sit entirely within an existing one-family dwelling with its own entrance and an efficiency kitchen, one per lot, and JADUs are not permitted on lots with multiple dwellings. The July 2025 FAQ adds that stacked ADUs (one ADU atop another) are not permitted, a rule the code text does not state.
Vista Development Code §§ 18.31.010, 18.31.020(B), 18.31.040(A)(1) and (B)(2)-(3), 18.31.050(A)(2) and (B), 18.31.070(B), 18.31.100(C)-(D); Gov. Code 66333Section 18.31.050 caps attached and detached new-construction ADUs at 850 sq ft of floor area with fewer than two bedrooms and 1,200 sq ft with two or three bedrooms (no more than three bedrooms, Ord. 2024-02), and an attached ADU may not exceed 50 percent of the home's floor area, though Gov. Code 66321(b)(3) guarantees at least 800 sq ft of interior livable space whatever the percentage. Conversions of an existing accessory building or part of the home have no size limit, a JADU is capped at 500 sq ft, and every unit needs at least 150 sq ft; the code does not define how 'floor area' is measured, while the state floors are stated in interior livable space. The codified copy of § 18.31.050.A.1 prints the detached cap as '1,200 square feet if it has two bedrooms', but the signed Ord. 2024-02 (adopted 3-26-2024) and its staff report say 'two or three bedrooms', matching §§ 18.31.040.A.2.b and 18.31.050.A.2, so the adopted text governs. Section 18.31.070 holds every ADU to one story and 16 ft (a second-story unit is measured from the existing first-floor ceiling), which yields to 66321(b)(4): 25 ft for an attached ADU (R-1 and R-M allow 35 ft and two stories), 18 ft plus 2 ft for matching roof pitch for a detached ADU within half a mile walking distance of a major transit stop or high-quality transit corridor, and 18 ft beside a multistory multifamily building.
Vista Development Code § 18.31.050 as restated by Ord. 2024-02 § 2; §§ 18.31.040(A)(2)(b), 18.31.070, 18.28.020, 18.34.020; Gov. Code 66321(b)(2)-(4)Chapter 18.31 imposes no owner-occupancy requirement on ADUs, and Gov. Code 66315 bars one (the city's August 2024 FAQ said ADUs are not subject to owner occupancy). For JADUs, § 18.31.100.A still requires the owner to live in the main home or the JADU in every case, backed by a recorded deed restriction (§ 18.31.100.F), and both city FAQs repeat that rule. Since 1-1-2026, Gov. Code 66333(b) as amended by AB 1154 allows an owner-occupancy requirement only where the JADU shares sanitation facilities with the home, and never where the owner is a governmental agency, land trust or housing organization, so the universal local clause is overridden for JADUs with their own bathroom. The deed restriction barring separate sale of a JADU and fixing its size remains valid under 66333(c).
Vista Development Code § 18.31.100(A) and (F); Gov. Code 66315, 66333(b)-(c)Section 18.31.080.A requires one additional covered or uncovered space per ADU on top of the zone's residential minimum, which may be tandem on the paved driveway or on a side or rear yard driveway unless the Building Official finds that infeasible. No space is required within one-half mile walking distance of public transit (defined to include bus stops), within an architecturally and historically significant historic district, for a unit within the footprint of the proposed or existing home or accessory building, where on-street permits are required but not offered, or within one block of a car share vehicle; a JADU in an attached garage needs no replacement space. State law narrows the rule further: 66314(d)(10)(A) caps parking at one space per unit or per bedroom, whichever is less (none for a studio on a plain reading), and 66323(b) bars any parking standard on units approved under the state-exempt pathway, such as an 800 sq ft detached unit with 4-foot setbacks. Section 18.31.080.B.1 still requires replacing uncovered spaces an ADU eliminates, but AB 1170 added uncovered parking spaces to the 66314(d)(11) ban on replacement parking from 1-1-2026, so that clause is overridden. The city's July 2025 FAQ dropped its parking answer, and how staff apply these state overrides is undocumented.
Vista Development Code §§ 18.31.010 ('Public Transit'), 18.31.080(A)-(C); Gov. Code 66314(d)(10)-(11), 66322(a), 66323(b)An ADU or JADU application that meets the chapter's standards is reviewed and approved ministerially by the Community Development Department within 60 days of a complete application and is deemed approved if the city does not act (§ 18.31.120.B); the submittal is a site plan, floor plan and elevations with the building permit application, and Gov. Code 66317 adds the 15-business-day completeness determination and bars any hearing. When an ADU is applied for together with a new home, the city may hold the ADU decision until it acts on the home, but the ADU review stays ministerial (§ 18.31.120.C). Some lots first need grading clearance from the Land Development Engineering Division, and septic lots need San Diego County Health Department clearance, before building plans are accepted. Four pre-approved plans (499 to 1,149 sq ft) waive plan-check fees on lots with an existing single-family home.
Vista Development Code § 18.31.120(A)-(C); Gov. Code 66317(a); City of Vista ADU pageADUs and JADUs may be rented, but §§ 18.31.030.C and 18.31.100.E set a minimum rental term of no less than 30 consecutive days, which Gov. Code 66315 allows for ordinary ADUs; for JADUs (66333(g)) and units approved under the state-exempt pathway (66323(e)) state law requires terms longer than 30 days, one day more than the local text. Rentals of 30 consecutive days or less need a short-term rental permit, a business license and TOT registration under VMC Chapter 8.34 (Ord. 2024-05, adopted 5-28-2024, program effective 7-1-2024), whose definition expressly excludes 'any accessory dwelling unit permitted under Chapter 18.31', and the city's ADU and STR pages say STRs are not permitted in ADUs or JADUs. An ADU may not be sold separately except to a qualified buyer under the nonprofit provision (§ 18.31.030.B, citing legacy 65852.26, now Gov. Code 66341), a JADU may never be sold separately (§ 18.31.100.B and F), and the city has adopted no Gov. Code 66342 ADU-condominium ordinance.
Vista Development Code §§ 18.31.030(B)-(C), 18.31.100(B), (E) and (F); Vista Municipal Code §§ 8.34.020, 8.34.050 (Ord. 2024-05); Gov. Code 66315, 66323(e), 66333(g), 66341The fine print: 14 caveats that can change the picture
- Codification error: the city's codified copy of § 18.31.050.A.1 (Laserfiche entry 11093, page stamped 'Vista 03/26/2024') caps a detached ADU at '1,200 square feet if it has two bedrooms', dropping the 'or three' that the signed Ord. 2024-02 (adopted 3-26-2024, 4-1, effective 4-26-2024) and its staff report adopted; §§ 18.31.040.A.2.b and 18.31.050.A.2 print 'two or three bedrooms', so a three-bedroom detached ADU may reach 1,200 sq ft.
- Height: § 18.31.070 limits every ADU to one story and 16 ft, but Gov. Code 66321(b)(4) guarantees 25 ft for an attached ADU in Vista's R-1 and R-M zones (35 ft and two stories for the home), 18 ft plus 2 ft for matching roof pitch for a detached ADU within half a mile walking distance of a major transit stop or high-quality transit corridor, and 18 ft for a detached ADU beside a multistory multifamily building.
- Unit counts: the code and both city FAQs describe one ADU (attached or detached) plus one JADU on a single-family lot, but Gov. Code 66323(a) as amended by SB 543 (effective 1-1-2026) requires ministerial approval of any combination of a converted ADU, one detached new-construction ADU and a JADU; on lots with an existing multifamily building § 18.31.040.B.1 still caps detached ADUs at two while 66323(a)(4) allows up to eight (never more than the existing unit count), which the July 2025 FAQ already applies.
- Chaptered 2026 law, effective 1-1-2027: AB 956 (Chapter 791, Statutes of 2026) raises the state-exempt count of detached new-construction ADUs on a single-family lot from one to two, so the one-detached-unit limit in § 18.31.040.A.2 yields from that date; SB 1117 (Chapter 809, Statutes of 2026) limits impact fees on an ADU over 750 sq ft to the area above 750 sq ft, which changes the proportional fee formula in § 18.31.110.B. Re-read both on or after 1-1-2027.
- JADU owner occupancy: § 18.31.100.A and both city FAQs (August 2024 and July 2025) still require owner occupancy for every JADU; Gov. Code 66333(b) as amended by AB 1154 limits it to JADUs that share sanitation with the main home from 1-1-2026.
- Rental terms: the local minimum of 'no less than 30 consecutive days' (§§ 18.31.030.C and 18.31.100.E, repeated on the city ADU page) is lawful for ordinary ADUs under 66315, but JADUs (66333(g)) and state-exempt units (66323(e)) must rent for longer than 30 days; the city STR page's line that state law requires ADU rentals longer than 30 days overstates the rule for ordinary ADUs.
- Parking overrides: the uncovered-space replacement rule in § 18.31.080.B.1 conflicts with Gov. Code 66314(d)(11) as amended by AB 1170 (effective 1-1-2026); the one-space rule reaches studios although 66314(d)(10)(A) caps parking at one space per unit or per bedroom, whichever is less; 66323(b) bars parking standards on state-exempt units; and the local exemption list mirrors 66322(a)(1) to (5) but omits (a)(6), the ADU applied for together with a new home (subject to that paragraph's proviso).
- Setbacks and separation: new ADUs keep the home's front setback, a 10 ft street-side setback on corner lots and a 5 ft eave-to-eave separation from other buildings (§ 18.31.060); the front and corner setbacks yield where they would block an 800 sq ft unit with 4 ft side and rear setbacks (66321(b)(3)), and 66323(b) bars standards beyond the 4 ft side and rear setbacks and the height limits for state-exempt units.
- SB 9 lots: Chapter 18.96 (Ord. 2022-18) allows no more than two units including ADUs and JADUs on a parcel created by an urban lot split, four on a parcel using only the two-unit development provisions, and no ADU or JADU on a parcel using both.
- HCD has never sent Vista an ADU-law letter: the ADU letter index (current to 7-14-2026) has no Vista row and the Power BI dashboard (queried 2026-10-07) lists only Housing Element Law letters (rezone inquiry 7-8-2024, rezone corrective action 9-3-2024, inquiry on Programs 16 and 19 dated 12-3-2025). No public record shows Ords. 2022-16 or 2024-02 reaching HCD within 60 days, and the chapter was not amended for the 2024 and 2025 state changes, so a void argument under Gov. Code 66326(d) or 66316 exists; it would substitute the state standards (for example 1,200 sq ft for any detached ADU, against the local 850 sq ft one-bedroom cap), though the city administers Chapter 18.31 and nothing suggests a void finding.
- Pending: P25-0150, movable tiny home regulations (staff proposed 150 to 430 sq ft MTHs as primary homes or as a state-mandated ADU type in R-1, R-1-B, A-1 and E-1, no parking, 30-day minimum rental); the council sent draft regulations to the Planning Commission 5-0 on 2-10-2026, but no Commission agenda carried it through 8-18-2026 and the 10-6-2026 meeting was canceled.
- City ADU page links two FAQs: the July 2025 FAQ (body) and an August 2024 FAQ (Resources) that still prints the two-detached multifamily cap and the old parking answer; both state the universal JADU owner-occupancy rule, so neither is curated.
- Legacy citations: § 18.31.030.B cites Gov. Code 65852.26 (now 66341) and §§ 18.31.040.A.4 and 18.31.100 cite 65852.22 (now 66333); Vista is a charter city and its ordinances recite charter authority, but Gov. Code 66312 applies the ADU chapter to charter cities.
- Fees: development impact fees do not apply to ADUs of 750 sq ft or less and are proportional above that (§ 18.31.110.B), school fees apply from 500 sq ft, and § 18.31.110.E waives all impact fees for an ADU occupied for ten years by a lower-income household or a caregiver or family member under a recorded regulatory agreement (the city's ADU Fee Waiver Program).
Summarized from Vista's ordinance text, read October 2026; every row links the code section it came from. Rules often vary by zone and lot, so treat this as orientation, not a permit determination, and confirm with the planning department before you commit to a design.

California statewide law also applies
California sets baseline ADU rights at the state level. Where local rules are stricter than state law allows, state law usually wins, so both are worth reading.
