ADU rules in Cape Coral

Rules at a glance
No zoning district authorizes a detached ADU. Under Sec. 4.1.6.A.5, any use not specifically listed in the use table is expressly prohibited, and Table 4.1.6 lists no accessory dwelling use. The only detached accessory living quarters allowed is a guest house, permitted solely in the Residential Estate (RE) district, which may not contain a kitchen (no stove or oven hookups) and is not a dwelling unit to be rented.

- Cape Coral has no ADU pathway at all. The only accessory living provision is the guest house under Sec. 5.2.11, which is allowed only in the Residential Estate (RE) zoning district, may not contain a kitchen or stove/oven hookups, and may not be rented; it provides guest accommodations only.
- The Land Development Code does define 'Accessory Dwelling Unit (ADU)' in Sec. 11.2, but the definition is never given effect: no zoning district or use-table entry authorizes the use, and under Sec. 4.1.6.A.5 any use not specifically listed is considered expressly prohibited.
- Standard single-family (R-1) lots have no accessory living option; guest houses are limited to the RE district, and the Sec. 4.1.6 use table lists no accessory dwelling, accessory apartment, or garage apartment use in any district.
- The term 'accessory dwelling' otherwise appears only in impact-fee definitions (Secs. 2-24.8 and 2-24.15), which count 'any permitted and approved accessory dwelling units' for fee purposes but do not authorize the use.
