ADU rules in Clearwater
These are the primary sources for accessory dwelling unit regulations in Clearwater: the city's own zoning code, planning department pages, and permit guides. Start here before talking to anyone: the rules below are what your permit reviewer will apply.
Rules at a glance
ADUs are a Level One (Flexible Standard Development) permitted use in the LDR, LMDR, and MDR residential districts, with detached units expressly contemplated (separate detached setback and height rows, and a shipping container may serve as a detached ADU if it fully complies with the Florida Building Code and is architecturally treated with windows, doors, cladding, porches, and/or decks). Detached ADUs may not be located between the right-of-way and the principal structure and are limited to 15 feet in height, up to 20 feet through Level One approval.

Citywide, a residential use on residentially zoned property excludes rentals for periods of less than 31 days or one calendar month, whichever is less, and Sec. 3-919 sets prima facie evidence standards for enforcing that in residential districts, so an ADU there cannot be used as a short-term or vacation rental.

- Chart 2-100 (current through Supp. 55 Update 1) lists ADUs as permitted in the LDR, LMDR, MDR, C, T, D, O, I, and IRT districts only; the MHDR, HDR, MHP, US 19, OSR, and P columns are blank, so ADUs are not a listed use in those districts.
- One ADU is allowed per parcel, and only on a parcel with conforming density.
- District tables set minimum lot area and width for the ADU use: 10,000 sq ft and 50 ft in LDR, 5,000 sq ft and 50 ft in LMDR, 3,000 sq ft and 30 ft in MDR.
- Design standards require a consistent architectural style with the principal dwelling; detached units need similar window style, paint scheme, and roof design; shipping-container ADUs are allowed only if Florida Building Code compliant and architecturally treated to a residential appearance as determined by the Community Development Coordinator.
- Mobile homes and recreational vehicles may not be used as accessory dwelling units (Sec. 8-102 definition).
- ADUs are exempt from the general accessory structure standards of Article 3 Division 2 except the location rule (Sec. 3-203.A, not between the right-of-way and the principal structure) and the height rule (Sec. 3-203.D), per Sec. 3-202.I as amended by Ord. 9758-24.
- In nonresidential districts (read in full for Commercial, Sec. 2-703.A), the ADU standard differs: one unit subordinate and accessory to a principal permitted use, capped at 25 percent of the principal use's floor area, with title vested in the ownership of the principal use.
