- ADUs are only permitted on lots containing one- and two-family dwellings in the R-O, R-O(a), R-1 and R-2 Zone Districts; other zones are not covered by section 347-8.
- Only one ADU is permitted per lot.
- Detached ADUs must also satisfy the accessory structure requirements of the applicable zone district and Code section 347-22, and may not exceed 40 feet in length or width in any one direction.
- A deed notice recording the ADU and its use limitations must be filed with Essex County before a certificate of occupancy can issue.
- The owner must file an annual affidavit of continued compliance each January or the ADU certificate of occupancy is automatically revoked, with fines of $250 for the first 30 days of continued occupancy and up to $100 per day thereafter capped at $3,000 per thirty-day period.
- On sale of the property the new owner must apply within 60 days for a certificate of continued use, and sellers must disclose the approved ADU to prospective buyers; the ADU cannot be sold separately.
- New construction ADUs must adhere to the NJ Barrier Free Subcode; fully accessible adaptive reuse ADUs receive a 5% floor area bonus.
- For new construction, the ADU's external entrance may not face the same street as the principal dwelling's entrance if visible from the street, and no ADU window facing another residential property may be within six feet of a property line.
- Construction must commence within two years of Zoning Officer approval (one-year extension possible for good cause) or the permit may be revoked.
- Carriage house conversions are governed separately by section 347-9 as a conditional use with different standards (minimum 20,000 sq ft lot, four on-site parking spaces, no first-floor residential use).
