ADU rules in Lee County
These are the primary sources for accessory dwelling unit regulations in Lee County: the county's own zoning code, planning department pages, and permit guides. Start here before talking to anyone: the rules below are what your permit reviewer will apply.

County zoning applies only outside city limits. If your property is inside a city or town, that municipality's own ADU ordinance governs instead, even though it sits within Lee County.

An accessory dwelling unit is defined as a living unit subordinate to a single-family home which is either attached with cooking facilities, or detached with or without cooking facilities. Detached units qualify only under the accessory dwelling unit track (subject to Lee Plan density), not the density-exempt accessory apartment track, which is attached only. Listed as permitted (P) in agricultural, most one and two family (RSA, RS-1 through RS-5, TFC-1, TFC-2), RM-2 through RM-10 multifamily, several commercial (C-1A, C-1, C-2, C-2A, CS-1), and RPD and MPD planned development districts, and only when accessory to a lawfully permitted single-family dwelling; not permitted in RSC-1, RSC-2, TF-1, or Airport Noise Zone B under the county-wide tables.

- These rules cover unincorporated Lee County only; incorporated cities (Fort Myers, Cape Coral, Bonita Springs, Sanibel, Fort Myers Beach, Estero) have their own codes.
- Lee County runs a two-track scheme: an accessory apartment (attached, no cooking facilities, exempt from Lee Plan density except on Gasparilla Island per Sec. 34-2255) versus an accessory dwelling unit (attached with a kitchen or detached with or without one), and only one of either type is allowed per principal single-family residence.
- Accessory dwelling units count against Lee Plan density, calculated using the maximum total (bonus) density of the future land use category, and are presumed to be site-built affordable housing units that must pay applicable impact fees (Sec. 34-1177(a)(2) as amended by Ord. 25-09).
- The use is district-dependent: not permitted in RSC-1, RSC-2, TF-1, most commercial districts, or Airport Noise Zone B under the county-wide tables, and a special exception may be required in RPD and MPD planned developments (Sec. 34-934 note 21).
- Within the Captiva community plan area, RSC-2 estate lots of at least 43,560 sq ft may instead have up to two accessory dwelling units in addition to the principal home, with a seven-day minimum rental period and one lease at a time (Secs. 33-1626, 33-1628(d)).
