  • Accessory apartments are allowed only in the single-family high density (SF14) residential district; all other residential districts have no accessory apartment authorization, so most city lots cannot add one.
  • Minimum lot requirements apply: 6,000 sq ft lot area (application requirement) and 60 ft lot width (additional standard); Sec. 94-74(a)(2) repeats these as the minimum lot dimensions for single-family use with accessory apartment.
  • Any additional standard that cannot be met (lot width, size, parking, height) requires a waiver approved by the zoning board of appeals as a Class B special use permit.
  • The SF14 district regulations still reference 'accessory garage apartments as provided in subsection 94-273(d)(1)', but current Sec. 94-273 contains no garage apartment provision; Sec. 94-303 is the operative accessory apartment section.
  • Sec. 94-303(b)(4) points setbacks to 'subsection 94-305(b)(2)', which is now the general setback encroachment rules; the accessory structure setbacks actually appear in Sec. 94-304(b)(2): front 25 ft, side 5 ft, rear 5 ft minimum or 15 ft from alley centerline to an alley-facing garage door, corner same as principal structure.
  • Table III-1 in Sec. 94-71(d) also lists 'single-family dwelling and accessory apartment' as the permitted use for substandard lots (under 10,000 sq ft or 75 ft width) in the historic SF14-C5 district.
